The City Commission met in regular session, Mayor Burns and Commissioners: Huza and Huey present on roll call. The minutes-of the regular meeting of Monday, April 5th, 1954, and adjourned meeting the of, were approved as read. Moved by Huey, seconded by Huza, that this being the time for receiving bids for body chassis and hoist for truck for the Street Department, the following were received: Burrows Motor Co. 22 ton truck, cab and chassis, in the sum of $3,700.002 sales tax $111.00, less trade -in of Studebaker�Dump Truck in the sum of $400.00, -or a total of $3,411.00 for said truck; for hoist and body $4521.$0, plus-$45.66--state sales tax or a total of x'1,567.46 for hoist and body; said bid being the only complete bid received:- It is ordered that said bid be awarded to the Burrows Motor Co. for a total of $4,978.46, carried:, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the bill of the town of Union Gap, in the sum of x548.78, for quarterly treatment of sewage at its plant, be allowed, and the City Water Department authorized to issue a warrant on the City Water Fund, in payment therefor, carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the City Clerk is hereby authorized and instructed to return the check of Foster & Marshall in the sum of $20,500.00 which was deposited with their bid for the $400,000.00 Lenox Avenue Overpass to said company; the same being requested by them pending the outcome of the appeal to the Supreme Court on the validity of said bond issue, carried: Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns, that Resolution No. C -1116, pertaining to the payment of certain bills incurred in the proceedings of the construction of the Lenox Avenue Overpass, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -11161 WHEREAS, the City of Yakima has heretofore made payments in the total sum of $4,640.40 in connection with the Lenox Avenue overpass, out of funds der- ived from the issuance of warrants upon the Lenox Avenue overpass fund which was created by ordinance No. B= 1.470, and said ordinance was later repealed by ordinance No. B -14$7, and said warrants are now issued and outstanding; now WHEREAS, additional bills have been incurred with reference to said Lenox Avenue Overpass for various legal services and expenses in connection therewith, and approved vouchers have been received and are now on hand for the total additional sum of x2,8$7.28; and certain additional bills have been incurred in connection therewith but vouchers therefor have not yet been received; and WHEREAS, it was contemplated that the indebtedness herein referred to be paid out. of the Lenox Avenue overpass bond issue in the sum of $400,000.00 heretofore authorized by vote,of the people of said city, but one certain taxpayer and wife are prosecuting an appeal to the state Supreme Court involving the validity of said bond issue which will result in substantial delay in the issuance of said bonds; and by reason of said facts an emergency exists and funds should be provided for the payment of the indebtedness herein referred to without further delay; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: 1. That there be taken and transferred from the city street fund to said Lenox - Avenue overpass fund such sums of money as may be needed, not exceeding the total sum of $9,000.00, for the payment of said outstanding warrants hereinabove referred to in the total sum of x4,640.40, and that said warrants together with interest thereon be forth- with paid as herein provided, and that there be also paid therefrom out of said money to be transferred and taken from the said city street fund, the said approved, unpaid vouch now on hand in the total sum of x2,$$7.2$, and such other sums as-; -may be needed and re- quired for services and expenses in connection with said Lenox Avenue overpass, not exceeding the total sum hereinabove stated. 2. That said city street fund shall be later reimbursed for all sums taken pursuant to this resolution as soon as possible after the issuance of said Lenox Avenue bond issue out of the proceeds of sale thereof. ADOPTED by the City Commission of the City of Yakima this 12th day of April, 1954.
