The City Commission met in regular session, Mayor Burns and Commissioners Huza and Huey present on roll call. The minutes of the regular meeting of Monday, November 16th 1953, were approved as read. The City Engineer having reported the completion of the Fair Avenue Irrigation District, L.I.D. No. 757, by the contractor; it was moved by Huey, seconded by Huza, that the City Engineer is hereby instructed to prepare an assessment roll for said district, and the Cit] Clerk authorized to give notice of hearing on said roll by publication as required by law, for Monday, December 14th 1953, at 10 :00 o'clock A.M., carried: Burns, Huza and.Huey voting aye on roll call. ORDINANCE NO. B' -151$, AN ORDINANCE naming Blackburn Street, the same being the street parallel with and half way between Stewart Street and Lenox Avenue, extending east and west from Eighth Avenue South. Moved by Huey, seconded by Burns, that Ordinance No. B -151$, naming Blackburn Street, said street being parallel with and half way between Stewart Street and Lenox avenue, extending east and west, be passed as read, carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that Resolution No. C -1092, providing for the improvement of Blocks 200, 201 and 202 Walker Addition and 202 and 203 LaSalle Addition bey piping the Union Ditch Companys open irrigation ditch on the west side of Fair Avenue between Pacific Avenue and Washington Street be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. R'SOLUTION NO. C -1092, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following described property by piping the Union Ditch Company's open irrigation ditch on the west side of Fair Avenue between Pacific Avenue and Washington Street, situate in the City of Yakima, Yakima County , Wash. to -wit: Lots 1, 2, 3, 4, Block 200 Walker Addition Lots 13, 14, 15, 16 Block 200 Walker Addition Lots 1, 2, 3, 4 Block-201 Walker Addition Lots 13, 14, 15, 16 Block 201 Walker Addition Lots 1, 2, 3, 4 Block 202 Walker Addition Lots 13, 14, 15, 16 Block 202 IlaSalle Addition Lots 11 2, 3, 4 Block 203 LaSalle Addition All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A.m., on Monday, the14th day of December, 1953; which time and place are hereby fixed for the hearing of all matters relating to said proposed improve- ments or objections thereto; and for determining the method of payment for said improve- ment; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. This improvement is to be constructed in full accordance with the plans -and specifi- cations to be prepared by the City Engineer and filed with the City Clerk. Thirty (30%) per cent of all construction costs, plus all overhead, including the engineering, inspection, advertising, publication of notices and all other expenses inci- dent to the construction of said improvement, shall be levied and asseEsed against the property in the proposed district. Fifty (50 %) per cent of the construction costs are to be borne by the Union Ditch Company and Twenty (20 %) percent of said construction costs are to be borne by the City of Yakima. The City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. BURNS Mayor Moved by Huey, seconded by Huza, that Resolution No. C -1093, providing for the payment of judgments in the sum of $1,933.33, in the matter of the L.I.D. No. 680 Continguency Fund to certain individuals described in said resolution, is hereby adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLTITION NO. C -10932 WHEREAS, the City of Yakima is now holding the sum of $2,923.17 in ,the Local Improvement District No. 680 Contingency Fund, which sum was deducted and re- tained from the contract price under contract between said City and Bosko Construction Company and Pat Barkley for certain local improvement district construction work; and . WHEREAS, the four creditors hereinafter named have heretofore recovered judgments against said contractors, Bosko Construction Company, Inc. and Pat Barkley, in the respect. ive amounts hereinafter stated, including principal, interest, and costs, and each of the same has caused Writ of Garnishment to be served upon the City of Yakima; and the matter having been duly considered, and the City Commission being of the opinion that the said four judgments should be fully paid out of said fund; and 1,%TIEREAS, all other creditors' claims, if any, against said contractors or against the Citv of Yakima with reference thereto are now fully barred by the Statute of Limitations; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the City Treasurer is hereby authorized and directed to pay out of said Conting- ency Fund, the following amounts to the said following named ,judgment creditors, to -wit: Great American (being the Ass Fred Webb Lentz Hardware E. BURNS Mayor Moved by Huza, seconded by Burns, that Resolution No. C -1094, authorizing the Mayor and City Clerk to execute a lease on behalf of the City of Yakima, with Ralph H. and Virginia S. Richardson, husband and wife, for property at the.Municipal Airport, be- adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C- 1091, WHEREAS, RALPH R. RICHARDSON-and VIRGINIA S. RICHARDSON, Husband and wife, Lessees, are desirous of entering into a lease with the City of Yakima for a period of twenty (20) years with an option to renew for ten (10) additional years, and it is considered for the best interests of the City of Yakima to enter into a lease with said Lessees; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION: That it is for the best interests of the City of Yakima that a lease with Ralph R. Richardson and Virginia S. Richardson, husband and wife, for a portion of the Yakima Municipal Airport premises, more fully described in said lease, for a period of twnety (20) years from and after November 1, 1953, with an option to renew said lease for an additional period of ten-years (10), be executed, in the form heretofore mutually agreed upon, a copy thereof being attached hereto. The Mayor and City Clerk are hereby authorized, empowered and directed to execute said lease for and on behalf of the City of Yakima. ADOPTED BY THE CITY COMMISSION this 23rd day of November, 1953.
