The minutes of the regular meeting of Monday, October 5th and adjourned meeting thereof were passed as read„ Moved by Huey, seconded by Burns, that the request of J. C. Whittle, Street Superintendet for a leave of absence from January 1, 1954 until March 1, 1954 be granted, motion carrie Moved by Huza, seconded by Burns, that Milton Martin, Superintendent of Yakima Public schools be appointed as a Member to the City Library Board of Trustees with voting power, carried: Burns, Huza and Huey voting aye on roll call. Moved by Burns, seconded by Huey, that Mrs. Peter G. MacKintosh be appointed for a term oft-5,.' -years as a member of the City Library Board, motion carried: Burns and Huey voting aye on roll call, Huza.not voting. Moved by Burns, seconded by Huza, that the City Clerk be instructed to advertise for bids for the purchase of one washer and one extractor for the Police Department., bids.to be received on Monday, November 2nd, 1953, at 10 otclock a.m., carried: Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Huey, that Resolution No. C -1087 relative to the payment.of expenses incurred by the witnesses employed by the City with reference to the Lenox Ave. Overpass case recently tried, said expnses to be paid from Street Fund and in the event of the subsequent issuance of a bond issue for said proposed Lenox Avenue Overpass, said Street Fund be reimbursed therefor, motion carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -10879 BE IT RESOLVED BY THE CITY COTvU,�ISSION OF THE CITY OF YAKIMA: That there shall be paid out of the street fund of said city all witness fees and expenses incurred by the witnesses employed by said city with referenct to the Lenox Avenue overpass case recently tried, upon written approval thereof jointly by the City Attorney and the City Clerk, not exceeding the total sum of Three Thousand Dollars ($3,000.00), and also the attorneys? fees and expenses of Preston, Thorgrimson and Horowitz, Seattle attorneys, pursuant to and in accordance with the resolution for the employment of said attorneys heretofore adopted., upon written approval of the amount thereof by the City Attorney and the City Clerk. That in the event of the subsequent issuance of a bond issue for said proposed Lenox Avenue overpass, that the said street fund be reimbursed therefor out of the proceeds of such bond issue. BURNS Mayor Moved by Huza, seconded by Huey, that Resolution No. C -10$$, being a resolution of Intention to improve Lots 4, 5, & 6 of Philips Suburban Tracts by constructing a pipe sewer with the necessary wye branches, manholes, flush tank and water connections there- for, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -10881 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the lots and tracts of land included within the following described district by constructing a pipe sewer with the necessary Wye branches, manhole, ('lush tank and water connection therefor, all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district; to be served by and especially benefited by and assessed for the above described improvement is situate within the City of Yakima, Yakima County, Washing- ton, and is described as follows: Lots 4, 5, and 6 of Philips Suburban Tracts, according to the records on file in the office of the County Auditor, Yakima County, Washington. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commiss- ion to be held at its office in the City Hall in the City of Yakima, Yakima County, tiATashington, at the hour of ten otclock A.M., on Monday, the 2nd day of November, 1953, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk, is hereby direct.-d to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right - of -way easements, engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the prop- erty legally and properly assessable therefor as provide by law and as above described; and the City Engineer is hereby directed-to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other'information required by law to be by him submitted.
