The minutes of the regular meeting of Monday, August 31st, and adjourned meetings thereof, were approved as read. This being the time for receiving bids for paving various alleys in the City of Yakima, L.I.D. No. 761, the bid of Lone Pine Paving Company in the sum of $2,664.30 being the only bid received; It was moved by Huey, seconded by Huza, that said bid be awarded to said Lone Pine Paving Company, and the Mayor and City Clerk authorized to enter into a contract on behalf of the-City of Yakima, for doing said. work upon the filing of the proper bond required by law, carried:- Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Burns, that the City Engineer having reported the completion of the.South 28th and 29th Avenue South Curb and Gutter District, L.-I.D. No. 756, by the contractor, said work,is hereby accepted., and the City Engineer authorized to prepare an assessment roll for said district, and the City Clerk, instructed to give notice of hearin; on said roll for Monday, the 28th day of September 1953, at 10 ltclock A.M., carried: Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns, that the City Attorney ascertain the probable cost and information required for an-actuary report on the sufficiency of the present Firements Relief & Pension Fund for 1954, without the necessity of an appropriation therefor in the 1954 budget, carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that this being the time for the hearing on assessment roll, L.I.D. No. 749, providing for the construction of curbs and gutters oh 4th Avenue South and other streets in said district, and there being no objections in writing or othe wise to said improvement, or any part thereof, it is ordered that Ordinance No. B -1489, confirming said assessment roll and every part thereof, be passed as read, carried: Burns,.Huza and Huey voting aye on roll call. ORDINANCE NO. B -14891 AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 749 as created and established by Ordinance No. B -1433 of the Ordinances of the City of Yakima. Moved by Huey, seconded by Huza, that this being the time for the hearing on the.assess- ment roll in L.I.D. No. 752, providing for the improvement of 22nd Avenue South and Bonnie boon, and there being no objections in writing, or otherwise, to said improvement, or.any part thereof;- It is ordered that Ordinance No. B -1490, confirming said assessment roll, and every part thereof, be passed as read, carried: Burns, Huza and Huey voting aye on roll call., ORDINANCE NO. S' -1490, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 752 as created and established by Ordinance No. B -1451 of the Ordinances of the City of Yakima. Moved by Huey, seconded by Burns, that Ordinance No. B -1491, rezoning the South 127 feet of Lots 1 and 2, of Homer Boggess Acre Tracts No. 1, from "B" Residence District, to Limited Business District, be passed as read, carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. P -14911 AN ORDINANCE rezoning certain property at 45 West Meade Avenue from Residence District 11311 to Limited Business District. Moved by Huza, seconded by Huey, that Resolution.No. C -1081, providing for additional counsel at the trial of eminent domain pertaining to the Lenox Avenue Overpass, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION N0. C =1081, A RESOLUTION employing additional counsel to assist in the trial of eminent domain proceedings pertaining to Lenox.Avenue Overpass. WHEREAS, there is now pending in the Superior Court of the State of Washington in and for the County of Yakima an eminent domain proceeding instituted by the City of Yakima entitled, i1City of Yakima,-a municipal Corporation., plaintiff vs. Washington Canners Cooperative, a corporation, defendantT1 being Cause No. 38834 in said court; and WHEREAS, it is deemed advisable that additional counsel skilled and experienced in eminent domain proceedings be retained to assist the city attorney in the prosecution and presentation of said cause on behalf of the City of Yakima, now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE'CITY OF YAKIMA: That Preston, Thorgrimson & Horowitz, attorneys at law of Seattle, Washington, be and they are hereby retained as additional counsel to assist the city attorney of the City of Yakima in the presentation of said cause,; and as compensation for such services the City of Yakima shall pay the following sums: The sum of $500.00 to cover the services rendered by said firm of attorneys in the preparation of said cause for trial, and the sum of $150 per day for each day expended by said firm or any member thereof while within the City of Yakima, either for the purposes of preparation or trial of said, cause; the City shall further reimburse said firm of attorneys for any.out- of- pocket expenses which they may incur in the performance of said services. C -10821 WHEREAS, the City of Yakima is in need of an access road from Ahtanum Road north to the south boundary line of the Yakima Municipal Airport; BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the City of Yakima accept a deed from Leroy J. Schreiner and Faye N. Schreiner, his wife, of the following described real estate situated in Yakima County, Washington, to -wit: The West 1.5 feet of that part of the South -west Quarter of the Northwest Quarter of Section 2, Township 12 North, Range 18 E.W.M., lying south of the south boundayr line of the Yakima Municipal Airport, without payment of any compensation therefor, but upon the condition that the City agrees, at its expense, to construct an oil surface road thereon and that the City will pay the expense of moving the fence now located thereon or constructing a new fence along the edge of said roadway. That the City of Yakima purchase from Clark A. Swanson, also known as Gus Swanson, and Louisa Swanson, his wife, and Roll.E. Davis and Stella Davis, his wife-, the following described real estate situated in Yakima County, Washington: The East 15 feet of that part of the East half of the Southeast Quarter of the Northeast Quarter of Section 3, Township 12 North, Range 18 E.W.M., lying south of the south boundayr line of the Yakima Municipal Airport, and that the City pay therefor the sum of $750.00 and also pay the expense of moving the fence therefrom to the outside edge of said strip of land. That the City construct an oil surface road along said 30 foot strip of land from Ahtanum Road to the southern boundary line of the Yakima Municipal Airport for the purpose of an access: road to the southern portion of said airport. That the said purchase price of said property and'all other costs and expenses incidental to carrying out the terms and provisions hereof shall be paid out of -the Mu- nicipal Airport Improvement Fund from the proceeds derived from the sale of the bonds issue pursuant to Ordinance No. R -1482. Naches Ave. from East "I" St. to East 11K 11 Street by constructing concre- te curbs and gutter:, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -10832 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve North Naches Avenue from East "I" Street to East 11K11 Street by grading, ballasting, surfacing and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and speci- fications to be prepared by the City engineer and filed with the City Clerk. The district to be served by and assessed for the above described improvement is situate in the City of Yakima, Yakima County, Washington) and described as follows, to -wit Beginning at the southeast corner of the intersection of East T1K" Street and North Naches Avenue; thence easterly along the south line of East "K"- Street 147.5 feet; thence southerly and parallel with North Naches Avenue to the north line of East "I:" Street; thence westerly along -said north line 345 feet; thence northerly and parallel with North Naches Avenue to the south line of East 11K11 Street; thence easterly along said south line to the point of beginning. All persons who may desire to object to said proposed improvement are hereby notifiec to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 otclock a.m., on Monday, the 28th day of September, 1953; which time and place are hereby fixed for the hearing of all matters relating tp said proposed improve- ment or objections thereto, and for determining the method of payment for said improvement and the City Clerk is hereby directed to give due notice of said hearing and of the inten- tion to make the aforesaid improvement. The cost and expense of said improvement, including the engineering, inspection, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
