The minutes of the regular meeting of Monday, July 6th 1953, were approved as read. Moved by Huey, seconded by Huza, that the City Clerk is hereby authorized to give notice to contractors, by publication,.as required by law, for the construction of an irrigation system on Fair Avenue in L.I.D, No. 75,7; °said bids to be received on Monday, July 27th 19539, at 10:00 otclock A.M., carried: B urns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the City Clerk is hereby authorized to give notice to contractors by publication as required by law, for the construction of an irrigation system on Lots 21 and 22, of Yakima Heights Residence.Sites, in L.I.D. No. 758; said bids to be received on Monday, July 27th 1953, at 10 :00 o'clock A.M., carried: Burns, Huza and Huey voting aye on roll call Moved by Huey, seconded by Huza, that the City Clerk is hereby authorized to give notice to contractors by publication as required by law, for the construction of a curb and gutter district on 255th Avenue South in L.I.D. Noe 759; said bids to be received on Monday, July 27th 19 53, at 10:00 otclock A.M., carried :. Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Huey, that the Mayor be authorized to sign a renewal of the permit for the transient use by Military Aircraft of Yakima Municipal Airport, with the Department of Air Force, U.S.A.., carried: Burns, Huza, and Huey voting aye on roll call. Moved by Huza, se cor.Lded by Burns, that this being the postponed hearing on Resolution No. C -1064, providing for the construction of curbs and .gutters on 35th Avenue South from Tieton Drive to West; Chestnut Street etc., and there being no further protest to said assessment, or any part thereof, it was ordered that Ordinance No. B ®1475, creating a Local Improvement District for said district, be passed as read, carried: Burns and Huza voting aye on roll call, Huey voting No. ORDINANCE NO. Bm1471i, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters, establishing • Local Improvement District, providing for the method of payment therefor, and-creating • special fund.. Moved by Huey, seconded by Huza, that Ordinance No. Bm1476, rezoning Lots 7 to 16, both inclusive, of Block 230, original townsite of North Yakima (now Yakima)° from Business district to Commercial district, be passed as read9 carried: Burns, Huza and Huey voting aye on roll call. Moved by Burns, seconded by Huza, that Ordinance No. B -1477, amending the milk ordinance, be passed as read9 carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 147rr, AN ORDINANCE amending Ordinance No. B -1059 entitled, "AN ORDINANCE relating to the production, handling, sale and disposition of fluid milk and fluid milk products intended or used as such.for human consumption; establishing standards and defining terms; providing for the grading and inspection of such products; providing for the creation of milk inspection units; providing for the issuance and cancellation of certificates of approval, permits and licenses; defining the powers and duties of certain officers; defining offenses and prescribing penalties therefor; repealing Ordinance No. B -296 and amendment; thereto', and requiring certain tests for Brucellosis, commonly known as Bang's Disease. Moved by Huey, seconded by Huza, that Resolution No. C -1071, being a R solution of Intent- ion to construct a sewer system on West Prasch Avenue and other property more particularli, described in said resolution, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION N0, C- 10';'1, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the lots and tracts of land included within the following described district, by constructing pipe sewers with the necessary Wye branches, manholes, flush tanks and water connections therefor; all of said improvements to be construction in full. accordance with the plans and specifications to: be prepared by the City Engineer and filed with the City Clerk. T he district to be served by and specially benefited by and assessed for the above - described improvement is situate within the City of Yakima, Yakima County, Washington, and is bounded as follows: Beginning at the intersection of the center lines of West'Prasch Avenue and 18th Avenue South, thence southerly along the center line of 18th Avenue South a distance of 152.5 feet, thence westerly and parallel with West Prasch Avenue to 20th Avenue South, thence southerly along 20th Avenue South a distance of 135 feet, thence westerly and parallel with the corporate limits of the City of Yakima to a point 141.2 feet east of the east line of 22nd Avenue South, thence northerly and parallel with 22nd Avenue South to Nob Hill Boulevard, thence easterly along Nob Hill Boulevard to 17th Avenue,South, thence southerly along 17th Avenue South to the center line of West Prasch Avenue, thence westerly along said center line to the point of beginning. All persons who may desire to object to said proposed improvement are hereby notifie to appear and present such objection, if any, at a meeting of the City Commission to be held at its offs cis . 1_n the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 1Q.'61clock A.M:..' on Monday, the 3rd day of August, 1953; which time and place are ; -hereby`fiked for the hearing of all matters relating to said proposed improve- ment or objections thereto, and for determining the method of payment for said improvemen ; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. (continued on page 421) 1 1 1 1 1 1 1 JULY 13, 1953 (Continued from page 420) The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, inspection, surveying, advertising, pulbication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. Burns, Huza and Huey voting aye on roll call:' RESOLUTION NO. C -1072, WHEREAS, it is necessary to install concrete slabs and supporting trusses across the mill spillway ditch on North 4th Street near "H" Street; and WHEREAS, the same may be done more expeditiously and economically by the City Street Department, without the necessity of advertising for bids; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the City Commission does hereby declare that an emergency exists with reference thereto, and the City Street Department is hereby directed to install concrete slabs and supporting trusses across the mill spillway ditch on North 4th Street near "H "° Street and it shall not be necessary to advertise for bids therefor. G. W. BURNS Mayor providing for a fund to. fund for payment of fees to purchase said warrants ated as read, carried: RESOLUTION N0. C -1073, WHEREAS, the City Commission of the City of Yakima heretofore employed Homer M. Hadley as a'consulting engineer with reference to the Lenox Overpass for the preparation of plans and specifications therefor and other services in connect- ion therewith, for the agreed sum of $9,000.00,, of which the sum of $4,500.00 is now due and payable; and WHEREAS, the employment of said consulting engineer could not have been reasonably foreseen at the time of the adoption of the 1953 budget; and an emergency for the pay- ment of said indebtedness is hereby declared to exist for the raason that said indebted- ness is, now due'and owing, but no funds have so far been set aside or received for the payment thereof; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That there is hereby established'a special fund known as "The Lenox Overpass Const- rudtion Fund "'.for the payment of costs and expenses arising from the proposed 'construct- ion of the Lenox Overpass, into which said fund shall be paid.all of the moneys derived from the s ale of bonds for the construction of said Lenox Overpass:. T hat the City Treasurer is hereby authorized, empowered, and directed to issue to said Homer M. Hadley, an emergency warrant in the sum of $4,500.00, upon the presentation of 'a proper voucher for the payment thereof for said services; and that the funds for the payment thereof in the said sum of $4,500.00 be borrowed by said Lenox Overpass Const- ruction Fund from out of any investment fund of said City, that the same be repaid to said investment fund on or before six months after the date hereof, together with interns thereon at the rate of four (4) per cent per annum from the date of payment until repaid. That Ordinance No. B-1470 entitled , "AN ORDINANCE providing for the expenditure.,of funds not yet provided for in the 1953 budget, for the payment for the services of Hammer M. Hadley�� consulting engineer, with reference to the Lenox Overpass; and declaring an emergency , approved on July 6, 1953, is hereby repealed. ADJOURNED MEETING, WEDNESDAY, JULY 15, 1953, 10 o'clock A.M. The City Commission met pursuant to adjournment, Mayor Burns and Commissioners Huza and Huey present on roll call. This being the time set for the adjourned hearing on Resolution No. C -1060, providing for the improvement of the east side of 26th Avenue South beginning at a point 100 ft.
