The City Commission met in regular session, Mayor Burns and Commissioners Carpenter and
Huey present on roll_ call.
The minutes of the regular meeting of March 9th 1953, and adjourned meeting thereof were
approved as read.
Moved by Huey, seconded by Burns, that this being the time for the hearing on Resolution
No. C -1045 providing; for the construction of Curbs and Gutters on South 4th Avenue from
Logan Avenue to Mead Avenue, and there being no objections in writing or otherwise to
said improvement or any part thereofs it is ordered that Ordinance No. B -1433> creating
L.I.D. No. 749 be passed as read, carried; Burns, Carpenter m d Huey voting aye on roll

ORDINANCE NO. B -1433, AN ORDINANCE providing for the improvement of certain property by
grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing
a Local Improvement District, providing for the method of payment therefor; and creating
a, special fund.
Moved by 'Carpenter, seconded by Burns, that Ordinance No. B -1434 heretofore introduced
on Monday March 9th providing for an expenditure of funds not included in the 1953 budget,
for the purpose of employing a traffic consultant in the sum of $1,164.00 to be paid from
the City Street Fund is hereby read by letter by the City 'Clerk and passed on its third
reading, carried Burns, Carpenter and Huey voting aye on roll call.
ORDINANCE NO. B -1434, AN ORDINANCE providing for the expenditure of funds, not provided
for in the 1953 budget, for the purpose of employing a traffic survey consultant'and
declaring an emergency:
Moved by Huey, seconded by Carpenter, that Ordinance No. B -1435, rezoning the North 2
of Lots 1 and 2., McCrimmon and Needham's subdivision from "C" residence district to
"Business District "'y be passed as read, carried; Burns, Carpenter and Huey voting aye on
roll call.
ORDINANCE NO.- B -1435, AN ORDINANCE rezoning the north one -half of Lots 1 and 2, McCrimmon
and Needham's subdivision, from "'C " residence district to "business District'.
Moved by Huey, seconded by Burns, that Resolution No. C -1047 providing for a hearing for
the 4racation of a portion of Bitterroot Way is hereby adopted and said hearing set for
Monday, April 6, 1953- at 10 : °OO. o' clock A.M.,Carried, Burns, Carpenter and Huey voting
aye on roll call.
RESOLUTION NO C -1047, WHEREAS, JOHN A WHITTEN, Jr. and E. GRACE WHITTEN, husband and wife
and RALPH HALLAUER and MARY ELIZABETH HALLAUER, husband and wife, have petitioned the
City Commission of the city of Yakima, Washington, to vacate that portion of Bitterroot
Way, a street in the Uplands, an addition to the city of Yakima, W shington, which
portion of street is described as;
That portion of Bitterroot Way as shown on the plat of The Uplands, accord
to the plat thereof recorded in Volume a-0" of Plats, page 28, records of
Yakima County, Washington, described as follows.-
Beginning at the Northeast corner of Lot 11 Block 5 of said Plat, thence
North 0`3461 East 60 feet to the northerly right of way line of Bitterroot Way
and the true point of beginning; thence west and perpendicular to the east
line of Lot 1 of said plat extended, 1285 feet, more or less, to the west
line of said subdivision;, thence North 0 481 west along the west line of said
subdivision to the northerly right of way line of Bitterroot Way; thence
southeasterly along the northerly right of way line of Bitterroot Way to the
true point of beginning,
which petition has been filed with the City Clerk of said city of Yakima, vilashington, and
WHEREAS, said petition is signed by the owners of more than two - thirds of the
private property abutting upon said portion of Bitterroot Way sought to be vacated; now,
therefore,
BE IT RESOLVED BY T E CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON:
That said petition shall be heard and determined on Monday, the 6th day of
April, 19 53 .
BE IT FURTHER RESOLVED that the City Clerk of the city of Yakima, Washington
give twenty (20), days notice of the pendency of said petition by a written notice posted
in three of the most public places in the city of Yakima, and a like notice in s
conspicuous place on that portion of Bitterroot Way sought to be vacated; which notice
shall contain a statement that said petition to vacate said portion of Bitterroot Way
hereinabove described has--been filed; describing the said portion of Bitterroot Way;
together with a statement of the time and place fixed for the hearing of said petition.

ment of Uplands Way from 42nd Avenue North to 46th Avenue West and other streets by
construting concrete curbs and gutters, be adopted as read, carried: Burns, Carpenter
and Huey voting aye on roll call.
RESOLUTION NO. C -1048, BE IT RESOLVED BY THE CITY COTvMISSION OF THE fCITY OF YAKIMA, WASH.
That it is its intention to improve Uplands Way from 42nd Avenue North to
46th Averse North; Avalanche Avenue, west from 42nd Avenue. North; 44 -th Avenue North from
SnoiAtmountain Road to Uplands Way; 46th Avenue North from Snowmountain Road to Sunset.

fications to be prepared by the City Engineer and filed with the .City Clerk.
The district to be served bIT and assessed for the above - described improvement is
situate in Yakima County, Washington, and described as follows, to -wit:
Beginning at a point on the- south side of Sunset Avenue, 40 feet east of the
northwest corner of Lot 4, Block 17, The Uplands, thence southerly and parallel,
with 46th Avenue North to the north line of Lot 13 of said Block 17, thence•
easterly and parallel with Uplands Way to the west line of 42nd Avenue North,
thence southerly along said.west line to the southeast corner of Lot 7, Block 20,
The Uplands, thence westerly and parallel with Snowmountain Road to the northeast
corner of Lot 11 of said Block 20�, thence southerly along the east line of said
Lot 11 to the north line of Snowmountain Road, thence westerly along said north-
line to a point 75 feet west of the southeast corner of Lot 14, Block 14, The
Uplands, thence northerly to the southeast corner of Lot 6 of said Block 14,
thence westerly along a line to the southwest corner of Lot 3 of said Block 14,'
and said line extended to a point 180,.8 feet westerly of Avalanche Avenue, thence
northerly and easterly along a:'line parallel with.Avalanche Avenue to the north-
east corner of Lot 12, Block 13, The uplands, thence northerly to the northwest
corner of Lot 2 of said Block 13, thence easterly along the south line of Sunset
Avenue to the point of beginning.
All persons who may desire to object to said proposed improvement are hereby
notified to appear and present such objections, if any,"at a meeting of the City Comm-
ission to be held at its office in the City Hall in the City of Yakima, Yakima County,
Washington, at the hour of 10:.00 o! clock A.M., on Monday, the :6th day of April, 1953;
which time and place are hereby fixed for the. hearing of all matters relating to said
proposed improvement or ob jections; thereto, and for determining the method of payment for
said improvement; and .the City,Clerk is hereby directed to give due notice of said hearing
and of the intention to make the aforesaid improvement.
The cost and expense of said improvement, including the cost of acquiring right
of way easements„ engineering, surveying, advertising, publication of notices, and all
other expenses incident thereto, shall be borne by and assessed against all of the
property legally and properly assessable therefor as provided by law and as above
described; and the City Engineer is hereby directed to submit to the City Commission at
or prior to the date fixed herein for said hearing, all of the data and other information
required by lat to be by him submitted.

of the south line of East "B" Street and other property described in said resolution, by
the construction of pipe sewers, be adopted as read, carried: Burns, Carpenter and Huey
voting aye on roll call.
RESOLUTION NO. C -1049, _PE IT 'RESOLVED BY THE CITY COMMISSION OF THE CITY' OF YAKIMA, WASH.:
That it is its intention to improve the lots and tracts of land included within the
following described district, by constructing pipe sewers with the necessary Wye branches,
drains, manholes., flush tanks and water connections therefor; all of said improvements! to
be constructed in full accordance with the plans and apecificaticns> to be prepared by the
City Engineer and filed with the City Clerk.
The district to be served by and specially benefited by and assessed for the above -
described improvement is situate within the City of Yakima, Yakima County, Washington,
and is bounded as.follow,s:
Beginning at the intersection of the south line of vacated East "B "` Street and
the east line of North 10th Street; thence northerly along said east line a
distance of 463 feet, thence N 700401 E 140 feet;, thence S190201 E 150 feet;
thence southerly along the easterly line of Eastern Addition to the south. line
of vacated "B "' Street; thence S?70040 9W along said south line to the point of
beginning.
All persons who may desire to object to said proposed improvement are hereby
notified to appear and present such objection, if any, at a meeting of the City Commission
