The minutes-.'of' the regular meeting of Monday, January 5th 1953, were approved as read. Moved by-Huey.,,--seconded by Burns, that the City Engineer having- reported •the •completion of the South 35th Avenue Domestic Water System in L.I.D." No. 7.27 °, by the Contractor, said work -is" hereby" accepted and the City Engineer authorized to prepare an assessment roll for said district, and the City Clerk instructed to give notice of hearing on said roll for Monday, February 2, 1953, at 110 :00 o'clock A.M,° carried Burns, Carpenter and Huey voting aye on roll call. RESOLUTION NO. C -1037, WHEREAS, a. petition has been filed with the City Clerk of the City of Yakima for the submission to the ele ctorsof the City of Yakima of an Ordinance to be entitled as follows: "AN ORDINANCE relating to the collection and disposal.o- garbage and refuse in the City of Yakima, amending Section 6 of Ordinance No. B -239 as amended by Ordinance No. B -1330, by repealing the provisions thereof imposing a garbage and refuse' collection service fee and providing for the - effective date hereof. "' and said petition has been duly examined by the City Clerk, who has -certified to the City Commission that such petition -is signed by more than the required number of registe ed and qualified electors of the City, as provided by Article No. 4 of the City Charter. NOW, THEREFORE, 'BE IT RESOLVED by the City Commission of the City 'of Yakima: Section 1. That the proposed ordinance as above set out be submitted to a vote of the qualified electors of the city at the municipal W imary .election to be held in said City on Tuesday, February 10, 1953.. Section 2. That the ballot to be used at the said municipal primary election on February 10, 1953, for the submission of said Ordinance, shall be in substantially the following form:-, BALLOT, MUNICIPAL PRIMARY ELECTION held in the City of Yakima, Washington, February 10, 1953, INSTRUCTIONS TO VOTERS: Every voter at the election desiring to vote in favor of the following proposition shall make a cross in the square opposit the words "Ordinance YES ", so that said ballot shall express his vote -on said question, and every elector desiring to vote against said proposition shall make a cros -s -in the square opposite the words "Ordinance NO", so that said ballot shall express his vote on said question. PROPOSITION "'AN ORDINANCE relating to the collection and disposal of garbage and refuse in the City of Yakima, amending Section 6 of Ordinance No. B -239 as amended by Ordinance No. B -1330, by repealing the provisions thereof imposing a garbage and -refuse collection service fee and providing for the effective date hereof." BE IT ORDAINED BY T11E CITY OF YAKIMA: Section 1. That subparagraph C (1) of Section 6 of Ordinance No. B -239 passed and approved by the City Commission on the 13th day of September, 1937, as amended by Ordinance No..'B -1330, passed and approved by the City Commission on the 3rd day of December, 1951, be and the same is hereby amended to read as follows: :tic "(1). Refuse and garbage in residential classifications shall hereafter be collected in reasonable quantities by the City of,Yakima without any specific charge therefor. iReasonable quantitiest as herein used shall be construed to "be the weekly accumulation of garbage and refuse from residential unita and yards. but shall not include rubbish nor debris except in minor quantities:," resulting from construction, alteration, demolition or remodeling or landscapii of any property." Section 2. That subparagraphs numbered (2:);,, (ay' and (4); of paragraph designate "C" of Section '6 of Ordinance No. B -239 passed and approved as above set forth and as amended by 'Ordinance No. B -1330 passed and approved by the City Commission on the 3rd day of December, 19,51, be and the same are hereby repealed. Section 3. ' This ordinance shall take effect immediately upon its being approv by a. vote of the people at a. duly qualified election. "' Ordinance - Yes.
