The minutes of the regular meeting of Monday, July 14th 1952,,, were approved as read. ORDINANCE NO.. B-1383.,, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the l.yment of the cost of the improvement in Local Improvement District No. 733, and p r oviding for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Burns, seconded by Carpenter, that Ordinance Now B- 1383:, fixing the time of delinquency and providing the form of bonds in L.I.D. No. 733, be passed as read: carries Burns, Carpenter and Huey voting aye on roll call. Moved by Carpenter, seconded by Burns, that we do now adjourn to meet Tuesday, July 22nd 1.952, at 10:00 o'clock A.M.; carried, Burns, Carpenter and Huey voting aye on roll call. This being the time for receiving bids for the construction of an Administration Building at Fire Station, No. 2,, the following bids were received: Leo S. This being the time for receiving bids for the improvement of Nob Hill Boulevard., and. the bid of Perry Hayes, in the-sum of $16,992..49 being the only one received, and it being over the City Engineer's estimate, said bid was rejected -and the City Clerk' instructed to readvertise for bids for Friday, August 8th, 1952 at 11:00 o'clock A-...M.: carried, Burns., Carpenter and Huey voting aye on roll call. ORDINANCE NO. B- 1384,, AN ORDINANCE submitting to the qualified voters of the City of Yakima, Washington, at a special election to be held in said City on September 9, 1952, the pr oposition of creating an indebtedness in the sum of $400,1000.00; creating a Lenox Avenue, overpass fund, for the issuance and sale therefor of general. negotiable, interest - bearing coupon bonds-.of said City in said amount, for the prupose. of improving Lenox Avenue in the City of Yakima, Washington, by extending-,Lenox Avenue across the right -of -way of the Northern Pacific Railway Company and the, right-of-way of the Union Pacific Railroad Company in the City -of Yakima, Washington, by the construction of a two --lane overpass over and across said railway rights-of-way; providing for the terms; and me'.thod of payment of said bonds, and providing for the calling and holding of such election, and declaring an emergency. Moved. by Carpenter, seconded by Burns:, that Ordinance No. B -13 84 providing for the calling of a special election to be held on the 9th day of September 1952, for, the - purpose of voting for a $400,000.00 bond issue to construct the Lenox Avenue Overpass, be passed as read: carried, Burns, Carpenter and Huey voting aye on roll call. RESOLUTION N0, C -1026, A resolution providing for the form of ballot to =be used at the special election to be held in the City of Yakima, Washington, ' on Tuesday, September 9, 1952. WHEREAS, by Ordinance No. B- 1384., of the City of Yakima, Washington, it is. provided that a, special election shall be held in said City on Tuesday, September 9, 1952., for the _purpose of submitting to they qualified voters- of said City for- ratification, the proposition of said City for creating an indebtedness in the sum of $400,000.00, and issuing negotiable general obligation bonds: of said City in the aggregate sum of $4.000,,000,00, for the T upose of providing funds for the improvement of Lenox Avenue in the City of Yakima, Washington, by extending Lenox Avenue across the right -of -way of the NorthernPacific Railway Company, and' the right -of -way of the Union. Pacific Railroad Company in the City of Yakima, Washington, by the construction of a. two -lane overpass over said railway rights -of -way; and WHEREAS, it is necessary to provide, for the form of the ballot-. to be used at said. ele ctionz Now;,. therefore,, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: Section 1. Tha -t the ballot to be used at the said special election on September 9,, 1952., shall be in' substantially the following form; . INSTUC,TIONS TO VOTERS. Every voter at the election desiring to vote in favor of the following proposition shall'make a cross in the ',..square opposite the words "fonds- -Yes" so that said ballot shall' express his vote on said question, and every elector desiring to vote against said proposition shall make a cross in the square opposite the words "Bonds - -No" so that said ballot shall express his vote on said questi PROPOSITION "Shall: the City of Yakima create an indebtedness in the sum of $400,000.00p and issue general. obligation negotiable bonds of the City of Yakima, Wqshington, in the aggregate sum of 400,000.00, bearing interest at agate not to exceed .four (4) percent: per annum, payable semi- annually ;: said 'ponds shall mature in from two (2) to twenty (20) years from date of issue, and the principal and interest thereof shall be payable out of the annual tax levies to be made without limitation as to rate or amount, for the purpose of providing funds for the improvement of Lenox Avenue in the City of Yakima, Washington, by extending Lenox Avenue across the right -of -way of the Northern Pacific Railway Company, and the right -of -way of they Union Pacific Railroad Company in the City of Yakima, Washington, by the construction of a two -lane overpass over said railway rights -of -way, all of which is more fully set forth in Ordinm ce No. B -1384, of said City., BONDS- -YES C% BONDS - -NO BE IT FURTHER RESOLVED, that the City Clerk certify to the County Auditor, Yakima County, Washington, not less than 45 days before September 9, 1952.1 the above proposition in the form of a ballot title.
