ADJOURNED MEETING / EXECUTIVE SESSION
OF THE CITY COUNCIL
DECEMBER 8, 2000 - 10:30 A.M.

1. ROLL CALL
Present:
Council: Mayor Mary Place, Council Members Larry Mattson, John
Puccinelli, and Bernard Sims
Staff: Dick Zais, City Manager; Ray Paolella, City Attorney; Chris
Waarvick, Director of Public Works; and Doug Mayo, Wastewater
Manager
2. EXECUTIVE SESSION
The Council moved into Executive Session for approximately 12 hours to discuss
pending litigation with the City's legal counsel at Preston Gates & Ellis and with
representatives from Del Monte and their legal counsel to discuss the wastewater
odor litigation and settlement of matters in dispute between the parties.
A tentative settlement was reached between Del Monte and the City of Yakima
pertaining to cost sharing and technical improvements at the plant, and the
blended defense of the ongoing litigation, subject to final ratification of the City
Council in open session.
3. ADJOURNMENT
The meeting adjourned at 11:00 p.m.
