The minutes of the regular meeting of Monday, September 10, 1951, were >approved as read. Moved by Huey, seconded by Carpenter, that the claim of Mary Wakely in the sum of {300.00 for damages, alleged to have been sustained by reason of a water main breaking and flooding'garden and grounds, is hereby rejected :. carried Burns, Carpenter and -Huey voting aye on roll call. Loved by Burns, seconded by Huey, that the claim of Johnson Safety & Supply Co. for a siren v+hich was delivered to-the Fire Department for trial, is hereby rejected for the reason that said siren was not satisfactory and was returned to said company: carried Burns, Carpenter and Huey voting aye on roll call. Moved by Carpenter, seconded by Huey, that the City 'Clerk is hereby instructed to give notice of hearing on the Preliminary Budget heretofore adopted for Monday, October 1., 1951, at 10 o'clock A.M.: carried Burns, Carpenter and Huey voting aye on roll call. Moved by Huey, seconded by Carpenter, that the City Engineer having reported the com- pletion of the Jefferson Avenue Irrigation System by the.Contractor in L.I.D. No. 712; said improvement is hereby accepted and the 'City Engineer instructed to prepare--an- assessment ro"l"l for said district and the City Clerk authorized - to give notice of hearing on said roll for Monday, October 8th, 1951, at 10 o'clock A.M.: carried Burns, Carpenter and Huey voting aye on roll cal'l'. RESOLUTION N0, C -990, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, iNASHINGTON:. That it is its intention to improve Mulder Drive, Fifth Avenue South, Sixth Avenue South, °Cornell Avenue, and Eighth Avenue South, from Stewart Street to Lenox Avenue; and a portion of Stewart Street; by grading, ballasting, surfacing and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance-with the plans and specifications to be prepared by the City Engin- eer and filed with the City Clerk. The district to be served by and assessed for the above-described improvement is situate in Yakima County, Washington, and described as- follows, towit: Beginning at. the intersection of 5th Avenue South and Lenox Avenue; thence westerly along Lenox Avenue to the southwest corner of Blackburn's Half -Acre Tracts; thence northerly along the west line of said Tracts to the southeast corner of Ninth Avenue Addition; thence westerly along the south line of said addition to 9th Avenue South; thence northerly along 9th Avenue South 204 feet; thence easterly and parallel with Mulder Drive to the west line of Blackburn's Half -Acre Tracts; thence northerly along said line to Stewart Street; thence easterly along Stewart Street to a point 135 feet east'of 5th Avenue South; thence southerly and parallel with. 5th Avenue South to Lenox Avenue; thence westerly along Lenox Avenue to the point of beginning. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A.M.; on Monday, the 8th day of October, 1951; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. B -1292, fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 693, and providing for the issuance of bonds with coupons attached for the payment of the unpaid protion thereof. Moved by Carpenter, seconded by Burns, that Ordinance No. B -1293 fixing the time of delinquency and prescribing thei.:form of bond in L.I.D. B- 1293, fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 694, and providing for.the issuance of bonds with coupons attached for the payment of the unpaid proti on thereof. Moved by Carpenter, seconded by Burns, that Ordinance No.'B -1294, fixing the time of, delinquency.and prescribing the'form of bond in L.I.D.•No. 695, be passed as read carried Burns, Carpenter and Huey voting aye on roll call. ORDINANCE NO. B -1294, fixing the time of delinquency of, installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 695, and providing for the issueance of bonds with coupons attached for the payment of the unpaid portion thereof. t Moved by Carpenter, seconded by Burns, that Ordinance No.-B-1295, fixing °the time of delinquency and prescribing the form of bonds in L.I.D.-N6. 700, be passed as read: carried Burns, Carpenter and Huey voting aye on roll call. ORDINANCE NO.. B-1295, fixing the time of delinquency of installments of assessments levied for the payment of the cost of the_improvement in Local Improvement District No. 700, and providing for the issuance of bonds with coupons-attached for the payment of the unpaid protion thereof. Moved by Huey, seconded-by Burns, that this being the time for the hearing on Resolution No. C -989, providing for a domestic water system on 34th Avenue South'et al and there being insufficient protest from property owners in said district; it is ordered that Ordinance No.-B -1296, creating Local Improvement No. 727 be passed as read: carried Burns, Carpenter and Huey voting aye on roll call. ORDINANCE'NO. B -1296, providing for the improvement of property in the City of Yakima, Washington, by the construction of a domestic water system; establishing a local improvement district, providing for the method of payment therefor, and creating. a special fund. Moved by.Huey, seconded by Burns, that this being the, time for the postponed hearing on Resolution No:-C -987, providing for the construction of curbs and - gutters on 33rd Avenue North, and it appearing from the former hearing, that the assessed valuation of the property affected by said improvement, exceeded the estimated benefits thereof; and that a,petition signed by more than 75% of the property owners in said area, has been presented asking that said improvement be constructed according to the original plans prepared by the City Engineer; It is ordered that the original resolution of intention, passed by the City Commission of the City of Yakima, on the 20th day of August 1951, be cancelled and abandoned, and that the City proceed with the construction of the improvement under,the above named petition, and that Ordinance No. B -1297, creating a Local Improvement District be passed as read: carried Burns, Carpenter and Huey voting aye on roll call. ORDINANCE N0. B -1297, providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing a Local Improvement District; providing for the method of payment therefor, and creating a special fund.
