The minutes of the regular meeting of Monday, April 16, 1951, were approved as read. Moved by Huey, seconded by ,Carpenter, that this being the time for the hearing on Resolution No. -968, providing for the construction of curbs and gutters on South 13th Avenue and other streets in the City of Yakima, and there being no objections in writing or otherwise to said improvement, or any part thereof: It is ordered that Ordinance No. B -1242, creating L.I.D. No. 720, be passed as read: carried Burns, Duey and Carpenter voting aye on roll call. ORDINANCE NO. B -1242, providing for the improvement of certain property by grading, ballasting., surfacing and constructing concrete curbs and gutters; establishing a Loral Improvement District, providing for the method of payment therefor, and creating a special fund. Moved by Huey, seconded by Burns, that Ordinance No. B -1243, amending Section 2, of Ordinance No. B -433, -relative to location of service stations,-be.passe7d as read: carried Burns, 'Carpenter and Huey voting aye on roll call. ORDINANCE NO. B -12431 amending Section 2 of Ordinance No. B -433, entitled: "AN ORDINANCE amending Section 6 of Ordinance No. B -293, entitled: "AN ORDINANCE regulating and re- stricting the location of trades and industries; regulating and limiting the use of buildings and premises; and the height -nd size of buildings; providing for yards, courts and other open spaces; establishing districts for said purposes, and providing for a board of adjustment, and repealing Ordinances No. B -22, B -35, 8 -43, B -51, B -71, 3-1261 B -147 and B- 17211, by amending subheading 6 of subdivision (a) thereof, and by adding a new sub- section to said Section 61 to be known as sub- section (e); and declaring an emergency." RESOLUTION NO. 'C -9701 BE IT RESOLVED BY THE, CITY :COMMISSION ON OF TIE, CITY OF YAKI.`,�A, AI SHINGTON: That it is its intention to i.nprove South 4th Street from Adams Avenue to Pacific Avenue; also South Naches Avenue, South 6th Street and South 7th Street, from Pacific Avenue to ffashington Street; by grading, ballasting, surfacing and constructing concrete curbs and gutters and concrete sidewalks, five feet in * width; all of said improvements to be constructed in full accordance with the plans and specifica- tions to be prepared by the City Engineer and filed with the 'City Clerk. . The district to be served by and assessed for the above - described improvement is situate in Yakima County, Viashington, and described as follows, to -wit: Beginning at a point on the north line of Pacific Avenue, 138 feet west of South 4th Street; thence easterly along Pacific Avenue to a point 138 feet east of South 4th Street; thence northerly and parallel with South 4th Street to Adams Avenue; thence westerly along Adams Avenue to a point 138 feet west of South 4th Street; thence southerly and parallel with South 4th Street to the point of beginning; also beginning at a point on the north line of Washington Street, 125 feet west of South Naches Avenue; thence easterly along; Washington Street to a point 130 feet east of South 7th Street; thence northerly and parallel with South 7th Street to Pacific Avenue; thence westerly along Pacific Avenue to a point 125 feet west of South Naches Avenue; thence southerly and -parallel with South Naches Avenue to the point of beginning. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 of clock A.M., on Monday, the 14th day of May, 1951; which time and place are hereby fixed for the hearing of all matters relat- ing to said proposed improvement or objections thereto, and for determining the method of payment for.said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid i.mprovenent. The cost and expense of. said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the 'City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
