The minutes of the regular meeting of Monday, April 2nd, 1951, were approved as read. Moved by Huey, seconded by Burns, that the hearing on Resolution No. .0 -962 be continued for one week: carried Burns, Carpenter and Huey voting aye on roll call. Moved by Huey, seconded by Burns, that this being the time for receiving bids on the Rose Park curb and gutter district, L.I.D. No. 716, the follovt ng were received: G. G. Teskey, $15,203.25; Joe Brandt, $14,355.09; Perry Hayes, $14,198.70; J. kq. DeBlasio in the sum of $13,646.59. The bid of J. B- 1236, providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing a Local Improvement District; providing for the method of payment therefor, and creating a special fund. Moved by Huey, seconded by Burns, that Ordinance No. B -1237, providing for the rezoning of the North 150 feet of the South 180 feet of the Fast 102 feet of the West 132 feet Of SW S ?N of Section 30, Township 13 forth, Range 19, 'E.W.M.: from "B" residence dis- trict to limited business district be passed as read: carried Burns, Carpenter and Huey boting aye on roll call. ORDINANCE NO.-B-1237., re- zoning the North 150 feet of the South 180 feet of the East 102 feet of the West 132 feet of the Southwest Quarter of the Southwest Quarter of Section 30, Township 13 North, Range 19, E.W.M.: from "B" residence district to limited business district. Moved by Burns, seconded by Carpenter, that-Ordinance No. B -1238, amending the Penal Code, be passed as-read: carried Burns, Carpenter and Huey voting aye on roll call. AN ORDINANCE, amending sub- section 7 of Section 1, by adding thereto a new sub - division, to be numbered "Sub- section 7 (a)" of said Section 1; and amending said Section 1, by adding two new sub - sections thereto, to be numbered sub - sections 62 and 63; and amending Section 2, by adding a new sub - section to said Section 2, to be numbered "sub- section 17" all in Ordinance No. A -236 of the --City of Yakima, entitled: "AN ORDINANCE for the preser- vation of the public peace, safety, morality and good order in the ,City of Yakima; defin- ing who are disorderly persons and vagrants; providing penalties for the violation there- of; repealing ordinances numbered 9, 11, 13, "18, 25, 49, 86, 163, 172, 182, 193, 213, 214, 215, 216, 319, 223, 227, 241, 271, 286, 295,-433, 498, 521, 618, 634, 652, 720, 730, 841, 857,A- 19,A- 29,A- 31,A -52, A- 73,A -97 and A -134 and all other ordinances and parts of ordinances in conflict here - with, and declaring an emergency. C -969, BE IT RESOLVED BY THE CITY COMMISSION OF.THE CITY OF YAKI_MA, WASH- INGTON: That it is its intention to improve Fifth Avenue South from Lenox Avenue to Viola Avenue; also Logan Avenue from Seventh Avenue South to Tenth Avenue South; by grading, ballasting, surfacing and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and speci- fications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and assessed for the above - described improvement is situate in Yakima County, ITIashington, and described as follows, to -wit: Beginning at the intersection of Lenox Avenue and 5th Avenue South; thence Westerly along Lenox Avenue to a point midway between 5th Avenue South and 6th Avenue South; thence southerly and parallel with 5th Avenue South to 4 ola Avenue; thence easterly along Viola Avenue to a point midway between 5th Avenue South and 4th Avenue South; thence northerly and parallel with 5th Avenue South to Lenox Avenue; thence westerly along Lenox Avenue to the point of beginning; also, beginning at the intersection of Logan Avenue and 10th. Avenue South; thence southerly along 10th Avenue South to a point midway between Logan Avenue and -Mead Avenue; thence easterly and parallel with Logan Avenue to 7th Avenue South; thence northerly along 7th Avenue South to a point midway between Logan Avenue and Viola Avenue; thence westerly and parallel with Logan Avenue to 10th Avenue South; thence'southerly along 10th Avenue South to the point of beginning. All persons _ wo may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, V +lash ington, at the hour of 10 o 1 clock A.M., on Monday, the 30th day of April, 1951; which time and place are hereby fixed for the hearing of all matters re- lating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Glerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering,'surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all .of'the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
