The minutesof the regular meeting of Monday, January 22, 1951, were approved as read. Moved by Huey, seconded by Burns, that the City Engineer, having reported the completion of the irrigation district in L.I.D. No. 664, said work is hereby accepted and the City Engineer authorized to prepare an assessment roll for said district and the-city-Clerk instructed to give notice of hearing for Monday the 5th day of March 1951, at.10 o'clock A.M.: carried Burns, Carpenter and Huey voting aye on roll call. Moved by Huey, seconded by Burns, that pursuant to the passage of Ordinance No. B -1140, passed and app_ roved by the City Commission on May 8, 1950, which. said Ordinance estab- lished L.I.D. No.,6951 and by Ordinance No. B -1189, authorizing the acquisition by pur- chase or condemnation of the West 25 feet of the West 150-feet of the South 114 feet of the North 134 feet of the E2 of .the NE1 of the NEB of the SEI of Section 25- 13 -18, E.W.M. for the purpose of constructing and maintaining a public street from H. B. Fair- banks and wife in the sum of '$750.b0; It is ordered that a warrant in the sum of $750.00 be issued on L.I.D. No. 695 for the purchase of said described property: carried,Burns, Carpenter and Huey voting aye on roll call. RESOLUTION NO. Z -951, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMAA. ... WASH: That it is its intention to improve the lots and tracts of land included within the follovi ng described district, by constructing pipe sewers with the necessary wye branch- es , drains, manholes, flush tanks and water connections therefor; all of said improve- ments to be constructed in full accordance with the plans and specifications to be pre- pared by the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assessed for the above- described improvement is situate within the City of Yakima, Yakima County, Washington, and is bounded as follows: Lots 1 to 85 inclusive, of Block 46, City of Yakima, formerly North Yakima. All persons who may desire to object to said proposed-improve- ment are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A.M., on Monday, the 19th day of February, 1951; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost andexpense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall, be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City,Engineer is hereby directed to submit to.the City Commiss- ion at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. Moved by Burns, seconded by Huey, that Ordinance" No. B -1215, providing for the grant- ing of a non- exclusive franchise to Carl A. Hahn and Walter S. Philipp,: doing business under the name of Intervalley Motor Coach Co., to operate motor vehicles on certain streets of the city and to receive and discharge passengers at certain points, be read and laid on the table until Thursday, February 1, 1951: carried Burns,' Carpenter and Huey voting aye on roll call. Moved by Burns, seconded by Huey, that Ordinance No. B -1216, amending Ordinance No. B -810 relating to signs, bill posting, etc., be passed as read: carried Burns, Carpen- ter and Huey voting aye on roll call. ORDINANCE NO. B -1216, amending Sections 7,8,15(a) and 20, of Ordinance No. B -810, entitled: "AN ORDINANCE relating to and regulating the erections and maintenance of advertising signs, billboards and banners in the City of Yakima; regulating advertising on the streets of the City; requiring a license for bill posting, a bond and license for sign erectors, a permit for the erection of signs and billboards and the inspection of such signs and billboards; providing for license permit and inspection fees; fixing penalties for the violation thereof and repealing Ordinance No. A -138, passed and approved 'by the City Commission i�ovember 14, 1913, and any and all ordinances amenda- tory thereof." Moved by'Burns, seconded by Huey, that Resoluction No. C -953 be adopted as. read: carried Burns, Carpenter and Huey Voting aye on roll call. RESOLUTION NO. C -953, submitting Ordinance No. B -1215 of the City of Yakima to the electors of said City for approval at a special election to be. held in conjunction with the School Election to be held on the 13th day of March, 1951; and specifying the form of ballot to be submitted to the voters at said election. WHEREAS, the City Commission of the City of Yakima has ..duly passed Ordinance No. B -1215 of the City of Yakima, entitled: "AN ORDINANCE granting a non- exclusive franchise to CARL A. HAHN and WALTER S. PHILIPP, a -co- partnership doing business under the name of INTERVALLEY MOTOR COACH COMPANY, to operate motor vehicles commonly known as "motor coaches" on certain public streets in the City of Yakima; and to receive and discharge passengers at certain points on said public streets." WHEREAS, Section 10 of said Ordinance provides that it shall be- come effective upon its being approved by a majority of the electors of the City of Yakima voting thereon at a special election to be held in conjunction with the School Election to be held on March 13 "1 1951; NOW, THEREFORE, BE IT RESOLVED, that said Ordinance No. B -12151 be submitted to the electors of the City of Yakima for their approval at a special election to be held in conjunction with the School Election to be held in said City on the 13th day.of March, 1951, and that the ballot title or proposition to be submitted to the voters at .suc't-i election shall be in the form of the following question: "Shall Ordinance No. B -1215, granting a non - exclusive five -year franchise to Carl A. Hahn and Walter S. INSTRUCTIONS TO VOTERS Every voter desiring to vote in favor of the following proposition shall mark an X in the square between the word "Yes" and the words "for the Ordinance "; and every voter desiring to vote against said proposition shall mark and X in the square between the word "No" and the words !'against the Ordinance.!' PROPOS'I'TI.ON Shall Ordinance No. B -1215, granting a non- exclusive five -year franchise to Carl A. Hahn and Walter S. Philipp, co- partners doing business under the name of Intervalley Motor Coach Company, to operate motor coaches on the City streets, and to receive and discharge passen- gers at.certain points on said streets; and providing for compensation for the use 'of City streets; giving the City the right to acquire the motor coaches by agreement or condemnation, at the City's option; and for the termina- tion' or cancellation of said franchise upon terms and con- ditions specified in the Ordinance, be approved? Yes / —� for the Ordinance No against the Ordinance BE IT FURTHER RESOLVED,.thet the-City .Commission hereby declares that an emergency exists, requiring that said Ordinance No. B -1215 be submitted to and ,,,,voted upon by the electors of the City of Yakima, at a special election to be held in conjunction with the School Election on March 13, 1951. BE IT FURTHER RESOLVED, that the County Auditor of Yakima County, Wash- ington, as supervisor of elections, is hereby requested to cause a special election to be held in conjunction with the School Election on March 13, 1951, for the purpose of submitting the proposition hereinabove set out., to the qualified electors of the City of Yakima, and to give legal notice thereof. That the precincts, polling places and election officials for the School Election, shall be the s ame as the precincts polling places, and elections officials within the City of Yakima, for the special election of the City of Yakima to be held on the same day; and that the polls on that day shall be open from 8 :00 o1clock A.M. to 8 :00 otclock P.M. That the County Auditor, as supervisor of elections, and the officials of the City of Yakima, are requested and directed to do all things necessary in con- nection with such election; that a copy of said notice of election shall be published at each polling place in the City of Yakima, at least 15 days prior to the election; and that the first publication of said notice shall be had at least 15 days prior to the date of s aid election. BE IT FURTHER RESOLVED that the City Clerk of the City of Yakima be, and she is hereby directed to certify a copy of this Resolution to the County Election Board, forthwith.
