The. minutes of the regular meeting of Monday, September 13, 1948, were approved as read Moved by Buck, seconded by Bishop that upon the written application of Gilbert H. Moen, contractor for the construction of the addition to Fire Station No. 1, for the accept- ance of the work with the exception of $750.00 for Electric Controls for overhead doors which will be installed as soon as received; It was ordered that said work be accepted with the understanding that $750.00 would be held in reserve until the electri doors have been installed: carried Buck, Bishop and Clark voting aye on roll call. Moved by Buck, seconded by Bishop that the City Engineer having on August 2, 1948, filed his report of the completion of the Swm7mitview Avenue resurfacing in L.I.D. No. 633, and there not being found any record of formal acceptance of said work; It is ordered that said improvement be accepted as of August 2, 1948: carried Buck, Bishop and Clark voting aye on roll call. Moved by Clark, seconded by Buck that this being the time for receiving-bids for the construction of curbs and gutters on Englewood Avenue, L.I.D. No. 646, the following bids were received; J.M. DeBlasio $12,902.55; Riggle and :Creighton $22,520.30. The bid of J.M. DeBlasio in the sum of $12,902.55 being the lowest and best bid, contract was awarded to him and the Mayor and City ;Clerk authorized to enter into a contract on behalf of the City of Yakima :upon filing of the proper bond therefor: carried Buck, Bishop .and 'Clark voting aye on roll call. ORDINANCE NO. B -920, defining the offense of shop lifting, declaring the same to be a misdemeanor, imposing penalties, upon conviction therefor and declaring an emergency. Moved by Buck, seconded by Bishop that Ordinance No. B -920 defining shop lifting etc., be passed as read: carried Buck, Bishop and :Clark voting aye on roll call. RESOLUTION NO.—C-7979 BE IT RESOLVED BY THE CITY `COMMISSION OF THE CITY OF' YAKIMA, WN: That it is its intention to improve that portion of West North Avenue lying between North First Street-and Sixth Avenue North, which is within the corporate limits of the City of Yakima, by grading and installing a gravel base, re- surfacing with asphaltic concrete and constructing concrete curbs and gutters where required, all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City 'Clerk. The boundary of the district to be assessed for the -above de -' scribed improvement is situate within the .City of Yakima, Yakima {County, Washington, and described as follows: Beginning at the intersection of the center line of West North Avenue and the center line of Sixth Avenue North; thence south along said center line a distance of four hundred thirty feet; thence east along a line parallel with and four hundred feet south of the south line of West North Avenue to the westerly line of North Front Street; thence southeasterly to the northwest corner of Block 2, City of Yakima; thence northeasterly along the northerly line of said Block 2 to the westerly line of North First Street; thence northwesterly and northerly along said westerly line to a point four hundred fifty feet north of the north line of West North Avenue; thence west along a line parallel with and four hundred fifty feet north of the north line of West North Avenue to the corporate limits of the City of Yakima; thence southeasterly along said cor- porate limits to the center line of Vilest North Avenue; thence west to the point of beginning. All persons who may desire to object to said proposed improve- ment, are hereby notified to appear and present such. objections, if any, at a meeting of the City Commission to be held at its office in the (City Hall in the City of Yakima, Yakima ;County, Washington, at the hour of 10 o'clock A.M., on Monday, the 18th day of October, 1948, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring rights of way easements, engineering, surveying, advertising, publication of notices and all other expenses incident thereto, except 25/ thereof to be borne by the City of Yakima, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
