The minutes of the regular meeting of Monday, the 9th day of August 1948, were approved as read. Moved by Buck, seconded by Clark that the City Engineer be authorized to proceed with the improvement -of resurfacing North Avenue from No. lst St to North 6th A -venue in conjunction with the County if possible which. is the owner of the North half of the street, and if the County is not willing to.improve said North half of the street, to proceed with the City's portion thereof according to the report of the City Engineer: carried Buck, Bishop and Clark voting aye on roll call. Moved by 'Clark, seconded by Buck that the City Engineer having reported the completion of the improvement; of the West Side Storm Sewer, said work is hereby accepted carried Buck, Bishop and Clark voting aye on roll call. Moved by Buck, seconded by Clark that in response to a number of citizens representing the Radio Theatres, Tieton Grange and others regarding Day Light Saving Time: It is ordered that the Resolution heretofore adopted discontinuing said time on the 1151st day of August, stand as indicated therein:- carried Buck and Clark voting aye on roll call. Bishop voting no. Moved by Clark, seconded by Bishop that this being the time for the hearing on the petition of the property owners for a portion of the Northwest Quarter of the 1`lorthwest quarter of Sec. 213 -13 -18 E.W.M'. and there being no objections in writing or otherwise to said annexation; It is ordered that-the ordinance annexing said territory to the City of Yakima, effective as of November 15th, 1948, be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE N0. B -905, providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the present boundaries of said city. RESOLUTION NO. C -795, BE IT RESOLVED Bf THE CITY COMMISSION OF THE CITY OF YAK:IMA, INN: That it is its intention to improve Pacific Avenue from the west line of, pavement on South Third Street to the east line of pavement on South First Street, by grading and surfacing the same and by constructing concrete curbs and gutter on each side of said Pacific Avenue-to connect with existing curbs and gutters, all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The boundary of the district to be assessed for the above de- scribed improvement is situate within the City of Yakima, Yakima County, Washington, and described as follows: Beginning at the intersection of the northerly line of Pacific Avenue and the westerly line of South Third Street; thence northerly along said westerly line of South Third Street 200.11 feet; thence in a. northwesterly direction to a point on the westerly line of South Second Street, 15 feet south of the northeast corner of Lot #5, Block 38, of Southern Addition; thence in a north - westerly direction to the easterly line of South First Street 35 feet northerly from the southwest corner of Lot 13, Block 38; thence southerly along the easterly line of South First Street to a point 350.0 feet southerly from the intersection of the southerly line of Pacific Avenue and the easterly line of South First Street; thence in a south - easterly direction to the westerly line of South Second Street, 367.4 feet south of the intersection of the southerly line of Pacific Avenue and the westerly line of South Second Street; thence in a north - easterly direction across South Second Street to a point on the easterly line of said Second Street, 181.74 feet south of the l intersection of the southerly line of Pacific Avenue and the easterly line of South Second Street; thence in a southeasterly direction to the westerly line of South Third Street, 164.82 feet south of the intersec- tion of the southerly line of Pacific Avenue and the westerly line of said South Third Street; thence northerly along the westerly line of South Third Street to place of beginning. All persons who may desire to object to said proposed improve- ment, are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 :00 o'clock A.M., on Monday, the 13th day of September, 1948, which time and place are hereby fixed for the hearing of all matter,, relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City :Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring rights of way easements, engineering, surveying, advertising, publication' of notices and all other expenses incident thereto except 30% thereof to be borne by the City of Yakima, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and. the: City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
