Commissioner Schutt absent. The minutes of the regular meeting of March 11, 1959 and the special adjourned meeting thereof were approved as read. The following letter tendering the regisnatio n of Kenneth C. Schutt, Commissioner of Finance and Accounting was read by the City Clerk: March 19 , 1959 Yakima City Commission. Joe K. Public Works Yakima, Washington Gentlemen: I hereby tender my resignation as Commissioner of Finance and Accounting of the City of Yakima, to take effect upon the date of formal acceptance by the Com- mission. It is my hope that it will be accepted as soon as the convenience of carrying on the business of the Commission will permit. Knowing that there are some matters that require the attention of the entire membership of the Commission, I shall continue to perform the essential functions of my office until there has been formal acceptance of this resignation.. It has been a pleasure to work with both of you for the City of Yakima. The nice people of Yakima will always have a warm spot in my heart. Thank you and may God bless you all. ALDER.SON, MAYOR A request from the Chamber of Commerce to Commissioner Mathews, requesting permission to use Yakima Avenue for the purpose of a merchandising mall on April 6th, 1959, having been referred to the Traffic Board for recommendation and the Traffic Board now recom- mending denial of the request and suggesting the use of the medial park strip on Naches Avenue as better suited for such activity and Commissioner Mathews explaining that the City -is responsible for the streets of the city and that the liability involved was to great to authorize such an activity without proper and orderly legislation, it was ordered that the City Attorney prepare the necessary ordinance to allow this activity and it °would be considered at the next regular meeting of t-he City Commission. Mr. Bolger spokesman for merchants present said the merchants; involved in this activity were heavily insured aril that they would be willing to pay for the parking meters that would be out of use for one day and also pay for any exft'ra police needed to supervise the merchandising mall. � Moved by Mathews, seconded by Alderson that Ordinance No. B -2269 correcting the legal description and amending Ordinance No. B -2237 which annexed property between Fruitvale and Willow and 18th Avenue and Wright Avenue, be passed as read: carried, Alderson and Mathews voting aye on roll call. 471 472 MARCH 27, 1959 ORDINANCE NO. B -2269 .AN ORDINANCE amending Ordinance No. B -2237 entitled " An Ordinance providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima." Moved by Mathews, seconded by Alderson that the following `Resolution submitted by the State Highway Department and the map attached thereto, be accepted as read: carried, Alderson and Mathews voting aye on roll call. RESOLUTION LIMITED ACCESS HIGHWAY WHEREAS a proposed plan of access control has been prepared in accordance with the instructions of the Washington State Highway Commission for a portion of Primary State Highway No. 3, E. Yakima Avenue to Union Gap; and WHEREAS a portion or all of the proposed highway improvement lies within the City of Yakima: NOW THEREFORE BE IT RESOLVED, in accordance with the provisions of RCW 47.52.020 et seq., that the City of Yakima, acting through its officers and authorities, does hereby consent to the establishment of limited access on the following describ ed portion of Primary State Highway No. 3 within the corporate limits of the City Yakima: Beginning at East Yakima Avenue in the NW-;!L 4 of the NW— of Section 20, Township 13 North, Range 19 E.W.M.; thence southeasterly to an intersection with the East -West centerline of Section 5, Township 12 North, Range 19 E.W.M., excluding any portion .outside of-the corporate limits of the City of Yakima. in accordance withthe plan entitled "Primary State Highway No. 3, E. MOVED by Mathews, seconded by Alderson that the City Attorney be and is hereby instructed to prepare the necessary ordinance to amend Ordinance No. B -677, the original ordinance granting franchise to J. C -16691 A RESOLt ?TION authorizing the transfer of funds within the 1959 appropriation for Maintenance and Operation for the following departments: Administra- tive, Legal, City Hall, Finance, :Fire, Other Public Safety, Airport, Irrigation, Garbage, Street and Cemetery. Sanford covering approximately 64 acres adjoining; the Sewage Disposal Plant, having expired December 31, 1958, and the City Purchasing Agent now recommending that two leases be drawn, one to Mr. Sanford covering approximately 20 acres in the southern portion of the same area at the same rental of $25.00 per month and 'one to Mr. Dale Butler who had offered to lease the northern portion of the acreage at ;100.00 per year, it was MOVED by Mathews, seconded by Alderson that the City Attorney be and is hereby instructed to draw the two leases in accordance with the Purchasing Agents recom- mendations, for the balance of the year and with no option: carried, Alderson and Mathews voting aye on roll call. ORDINANCE NO.. B -2270, AN ORDINANCE adopting as part o'f the Comprehensive Plan the attached "Planning for Parks" requirement study of park and recreational facilities for the Ci. ty of Yakima. ORDINANCE NO. B -2271, AN ORDINANCE adding Section 282, 408, 508, 606, 800 and 1618, and amending Section 900 and 160& of Ordinance No. B -2095 establishing zones in the City of Yakima; regulating and limiting the use of buildings and land; establishing use, height area and off - street parking regulations; providing for yards, courts and other open spaces, providing for the adoption of maps showing, the boundaries of said zones; pro- viding for a ''oard of Adjustment; providing for the administration and enforcement of this Ordinance, and fixing penalties for the violation of its provisions; repealing Ordinances numbered B -22, B -35, B -43, B -51, B -71, B -126, B -147, B -172, R -293 and Ordinance No. B -2241, and all amendments thereto, and all other Ordinances and parts of Ordinances in conflict herewith; and declaring an emergency. ORDINANCE NO-B-2272, AN ORDINANCE amending.
