Invocation was given by Councilman Barber. The minutes of the regular meeting of January 27, 1960, were approved as read. This being the time fixed by the Council for the hearing on an appeal from the decision of the Planning Commission as filed by Lyle V. Washburn and Harriett Washburn, and there being considerable protest in writing and otherwise to the request of rezoning of pro- perty situated 150 feet south of Nob Hill Blvd., and west of 17th Avenue for the purpose of constructing a bowling alley(as requested by Petition No. 23, filed 12/4/59), the - Council heard all persons present both for and against said rezone matter. Mr. E. Fred Velikanje, attorney and Mr. Gus Damaskos, Vice President h8 Lincoln Lanes defended the the appeal as filed by Mr. Washburn. All persons having• /hheard both for and against said rezone matter, it was MOVED by Burns, seconded by Oliver that the City Attorney prepare a resolution denying the appeal and affirming the recommendation of the Planning Commission for the rezone of this property, to be voted on by the Council at this meetinE carried, Bostic, Burns, Coombs, Larson, and Oliver voting aye by voice vote. Barber voting nay. Robinson not voting. This being the time fixed by the Council for the hearing on an appeal from the decision of the Planning Commission as filed by Gottlieb Hein and Reinhold Eichler and there being protests in writing and otherwise, to the request to rezone certain property in the 1400 Block on Broadway for the purpose of expanding business and parking facilities (as requested by Petition No. 22, filed 11/20/59), the Council heard all person present, both for and against aaid rezone matter. Mr. E. Fred Velikanje, attorney, presented the appealfbr Mr. Hein and Mr. Eichler. All persons having been heard both for and against said rezone matter,*it was MOVED by Mr. Barber, seconded by Mr. Robinson that the City Attorney prepare a resolution granting the appeal of Gottlieb Hein andReinhold Eichler, denying the recommendation of the Planning Commission and requesting a further report from the Planning Commission within 40 calendar days, said resolution to be voted on by the Council at this meeting: carried, Barber, Bostic, Coombs, Larson and Robinson voting aye by voice vote. Burns voting nay. Moved by Larson, seconded by Oliver that Resolution No. D -93 authorizing the execution of a farm lease between the City of Yakima and Robert F. Tormaschy for the lease of orchard property located at Tahoma Cemetery, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. . RESOLUTION NO. D -939 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk are hereby ,authorized and directed to execute a written farm lease between said City as Lessor, and Robert F. Tormaschy, as Lessee, on that certain real property situate in Yakima County, Washington; described as follows, to -wit: The South half of the South half of the Northeast quarter of the Northeast quarter of Section 35, Township 13 North, Range 18, E.W.M., Except the Easterly 5 acres thereof; for a period of two years, commencing January 1, 1960, and terminating December 31, 1961, upon the terms and conditions in said lease, 'a copy attached hereto. Miller for the leasing of certain orchard property located at the high -level reservoir on Englewood Heights, be passed as read: carried, Barber, Bostic, Barns, Coombs, Larson,, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D"940 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk are hereby authorized and directed to execute a written farm lease between said City as Lessor, and Loren H. Miller, as Lessee, on that certain real property situate in Yakima County, Washington, described as follows, to -wit: That portion of Tract 23, State Addition to the City of North Yakima, No. 2, according to the plat thereof recorded in Volume '1F" of . BOSTIC Mayor Bids having been received and considered-by a bid board for the purchase of - sludge from the sewage treatment plant on January 11, 1960, and the City Council having awarded said bid to J. W. Orkney whose bid of $1,805.00 per year was the highest and best bJLd, on January 13, 19600 it was MOVED by Barber, seconded by Burns that Resolution No„ 95 authorizing the execution of a contract with Mr. Orkney for the removal of sludge from the sewage treatment plant, be passed as read: carried, Barber, Bostic, Burns;, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. 95, WHEREAS, heretofore, the City of Yakima has awarded -a contract for the removal.of sludge from the sewage treatment plant owned and operated by the City to J. W. Orkney for a period of three years commencing January 1, 1960, and' WHEREAS, it is deemed in the best interests of the City of Yakima to enter into a contract in accordance with the terms of said bid proposal, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk of the City of Yakima are hereby authorized and directed to enter into a contract with J. W. Orkney for the re- moval of sludge from the sewage treatment plant, 'and the payment therefor by the said J. W. The City Engineer having filed the assessment roll with the City Clerk and reporting the completion of L.I.D. No. 879, being the Kern Addition Curb, Gutter and Paving District, it was MOVED by Larson, seconded by Barber that the City Clerk be and is here- by instructed to give notice,by publication and to each property owner, for a hearing on said assessment roll for the hour of 3 o'clock P.M. on Wednesday the 24th da;y of February, 1960: carried, Barber, Bostic, Burns, Coombs, Larson Oliver and Robinson voting aye by voice vote. In accordance with the hearing and action taken earlier in this meeting, it was MOVED by Burns, seconded by Larson that Resolution No. D -96, affirming the recommendation of the Planning Commission and denying a petition for the rezone of certain.property on South 17th Avenue, south of Nob Hill Blvd., and denying an appeal from said decision, be passed as read: carried, Burns, Coombs, Larson, Oliver voting aye on roll call. Barber and Bostic voting nay. Robinson not voting. RESOLUTION NO. D -961 A RESOLUTION affirming the recommendation of the Planning Commissi denying•a petition for the rezone of certain property on South 17th Avenue, south of Nob Hill Blvd, and denying an appeal. WHEREAS, on January 6, 1960 at a regularly scheduled meeting of the Planning Commission of the City of Yakima, the application of Mr. and Mrs. Lyle V. Washburn for the rezoning of certain property located 150 feet south of Nob Hill Blvd. and west of south 17th Avenue, the sam -being Washburnts Plat, from R -2 to B -3 for the purpose of constructing a bowling alley thereon, was denied, and - WHEREAS, subsequently, the said Mr. & Mrs. Lyle V. Washburn appealei from said recommendation and decision of the Plann -ing Commission to the City Council, and WHEREAS, on February 3, 1960, a hearing was had before the City Council, having duly considered said appeal, and being of the opinion that the action taken by the Planning Commission should be affirmed and the appeal of Mr. & Mrs. Lyle V. That the recommendation of the Planning Commission of the City of Yakima that the application of Mr. & Mrs. Lyle V. Washburn for the rezoning of certain property situated 150 feet south of Nob Hill Blvd and west of 17th- Avenue known as Washburn's Plat from -R -2 to B -3 be denied is hereby affirmed in all respects and that the appeal of Mr. & Mrs. Lyle V. RESOLUTION NO. 97, A RESOLUTION grantirg the appeal of Gottlieb Hein and Reinhold Eichler, denying the recommendation of the Planning Commission against the rezoning of property at Mead Avenue between South 3rd and South 4th Avenues, rezoning said property from R -2 to B -2 and requesting a further report of the Planning Commission within 40 calendar days. WHEREAS, on January 6, 1960 at a regularly scheduled meeting of the Planning Commission of the City of Yakima, said Planning Commission by a divided vote recommended the denial of the application of Gottlieb Hein and Reinhold Eichler for the rezoning of certain property situated on Mead Avenue between South 3rd and South 4th Avenues from R -2 to B -2, and. WHEREAS, subsequent thereto and within the time specified in city ordinance, the said Gottlieb Hein and Rei -nhold Eichler duly filed and appeal from said recommendation of the Planning Commission with the City Council,. and WHEREAS, a hearing was held on said appeal on February 32 1960 at a regular meeting of said City Council, and WHEREAS, after due and careful consideration of. all the factors involved in said application, the Gity Council finds that the rezoning of said property in accordance with the application therefor from R -2 to B -2 is in accord with good planning and the comprehensive plan of the City of Yakima, and that the needs of the city and community require such change and that the highest and best use for said property is for Local Business purposes, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the recommendation of the Planning Commission of the City of Yakima denying the application of Gottlieb Hein and Reinhold Eichler to re- zone the following described real property situated on Mead - Avenue between South 3rd and South 4th Avenues and more particularly described as'follows, to -wit: Lot 6, the W2 of Lot 7 and the W2 of Lot 8, Ledwich Addition from R -2, Two Family Residential to B -2, Local Business is hereby denied. Section 2. The Planning Commission of the City of Yakiaia is here- by requested to make further report to the City Council with respect to said application of Gottlieb Hein and Reinhold Eichler for the rezone of said property as hereinbefore set forth, and the City Clerk is'directed to deliver a copy of this resolution to the Planning Commission forthwith. Section 3. In the event that the said Planning Commission fails to act within 40 days after the receipt of a copy of this resolution, the City Council will by ordinance, rezone the property described in Section 1 hereof from R -2, Two Family Residential to B -2, Local Business. Other matters discussed but no formal action taken were the TV Ordinance, Sidewalk problem in the Me Clure School area, reappropriatio n of money to complete the construc- tion of Water Wells, and.the matter of obtaining the services of Frame and Whiting, accountants, to help the Finance Director's Department; There being no further business to come before the Council, it was MOVED by Oliver, seconded by Coombs that this meeting be adjourned at the hour of 6 o'clock P.M: carried Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote.
