JANUARY 13, 1960
The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Larson,
Oliver and Robinson, City Manager Allison and City Attorney Arntson present on roll call
Councilman Coombs absent.
The invocation was given by Councilman Burns.
The minutes of the regular meeting of January 6, 1960 -were approved as read.
This being the time for the hearing on the assessment roll for L.I.D. No. 876, being
the Swan Tracts and North 37th Avenue Surfacing District and there being no protests in
writing or otherwise, it was MOVED by Burns, seconded by Robinson that Ordinance No.
74 confirming said assessment roll be passed as read: carried, Barber, Bostic, Larson,
oliver..and Robinson v ®tang aye on roll call. Coombs absent.
ORDINANCE NO. 74, AN ORDINANCE confirming the assessment roll covering Local Improvemen
District No. 876 as created and established by Ordinance No. 23 of the Ordinances of the
City of Yakima.
A petition, being petition No. 27, havi_rg been duly filed by John Scheckler and others,
requesting the rezoning of certain property located on North 5th Avenue between "A"
Street and "C" Street from R -3 Multiple Family Dwellings to B -3 General Business zone,
it was MOVED by Oliver, seconded.by Larson that said petition be referred to the
Planning Commission for recommendation:: carried, Barber, Bostic, Burns, Larson, Oliver
and Robinson voting aye by voice vote. Coombs absent.
A petition, being petition No. 28, requesting the irmtallation of traffic control signal
at 6th Avenue and West Yakima Avenue, it was MOVED by Larson, seconded by Barber that
said petition be referred to the City Manager for recommendation: carried, Barber,
Bostic, Burns, Larson, Oliver and Robinson voting aye by voice vote. Coombs absent.
Moved by Robinson, seconded by Oliver that Ordinance No. 75 transferring the sum of
$42.00 in the 1959 Cemetery Budget for machinery and equipment, be passed as read:

ORDINANCE NO. 75, AN_ ORDINANCE transferring the sum of $42.00 from the Maintenance
and operation classification to, the Capital or Betterment Accounts classification, all
within the 1959 appropriation for 50 - Cemetery, and declaring an emergency.
Moved by Barber, seconded by Larson that Resolution No. D -84 transferring $20.00 within
the Irrigation 1,959 Budget _for Industrial Insurance and Medical Aid, be passed as read:

RESOLUTION NO. D -84, A RESOLUTION transferring funds within the Maintenance and
Operations classification of the 1959 appropriation for 35 - Irrigation.
.WHEREAS, a surplus exists in Account 7 -11 Salary Fringe - Statewide
Pension, of .the Maintenance and Operations classification of the 1959 appropriation for
35 - Irrigation, and
WHEREAS, it is necessary that funds be transferred to Account 7 -13
Salary Fringe - Industrial Insurance & Medical Aid, and
WHEREAS, such additional amount could not have been reasonably
foreseen at the time of the adoption of the 1959 Budget, and the City Council. finds_
that it is in the best interests of the people of the City of Yakima to make a transfer
between said funds in the sum of $20.00.and the action contemplated herein is authorized
by R.C.W. 35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the sum of $20.00 is hereby transferred from Account 7 -11
Salary Fringe - Statewide Pension to Account 7 -13 Salary Fringe - Industrial Insurance
and Medical Aid, all within the Maintenance and Operations classification of the 1959
appropriation for 35 - Irrigation, and the Director of Finance of the City of Yakima is
authorized and directed to make the aforesaid transfer.

RESOLUTION NO. D -85, A RESOLUTION authorizing the transfer of funds within the 1959

Street and 55 - Water - Sewer.
WHEREAS, a surplus exists in some accounts of the Maintenance and
Operation classification of the General Government and City Hall, Police, Airport,
Municipal Garbage, Street- and Water - Sewer, and
WHEREAS, it is necessary that funds be transferred to certain
other accounts of the Maintenance and Operation Classification of the departments of
General Government and City Hall, Police, Airport, Municipal Garbage, Street and Water -
Sewer, and
WHEREAS, such additional amounts could not have been reasonably
foreseen at the time of the adoption of the 1959 Budget, and

RESOLUTION NO. D -86, A RESOLUTION transferring equipment between the Engineering
Department and the Water Department.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: .
Section 1. The 1955 Ford 2 Door Passenger Sedan, Serial No,
A5PG152674, Title No. 552164228, License City D -39381 is hereby transferred from the
Water Department to the Engineering Department and the 1957 Plymouth 4 Door Passenger
Sedan, Serial No, 26607401, Title No. 570735311, License City D -3971, is hereby trans-
ferred from the Engineering Department to the Water Department.
Sectiion 2. The equipment records of the Water Department and the
Engineering Department shall be corrected accordingly.

Moved by Larson, seconded by Robinson that Resolution No. D -87 authorizing the Mayor
and City Clerk to execute a Supplemental Agreement with the Washirg ton State Highway
Commission, said agreement authorizing the substitution of 36" concrete pipe in the plac
of 34" wood stave pipe as called for in the original agreement authorized and signed
October 79 1959 for the relocation of existing water and irrigation pipe lines owned by
the City on P.S.H. No. 5 Junction Chinook and White Pass Branches and Jacobson to Fruit -
vale Blvd., and recinding Resolution No. D -83 as passed January 6, 1960, be passed as
read: carried, Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye on roll
call. Coombs absent.
RESOLUTION NO. D -87, A RESOLUTION authorizing the Mayor and City Clerk to execute a
Supplemental Agreement with the Washington State Highway Commission and rescinding
Resolution No. D -83.
WHEREAS, pursuant to authority of a resolution adopted by the
City Council of the City of Yakima, the City of Yakima entered into an agreement with
the Washington State Highway Commission on October 7, 1959 for the relocation of existin
water and irrigation pipelines owned by the City on P.S:H. No. 5, Junction Chinook and
White Pass Branches, and Jacobson to Fruitvale Blvd., said agreement called for the re-
placing of new 34" wood stave pipe in connection with said relocation, and
WHEREAS, the contractor has offered to furnish and install at no
cost to the City new reinforced 36" concrete pipe in said locations,, and
WHEREAS, the Washington State Highway Commission has agreed to
said substitution which will in fact give the City of Yakima better transmission lines
in these areas provided that the City will waive the guaranty periods as set forth in
said contract, and
WHEREAS, it is in the best interests of the City of Yakima to con-
sent to said substitution and waiver, and
WHEREAS, said consent and waiver must be set forth -in a Supplement-
al Agreement modifying the terms of said agreement of October 7, 1959, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the Mayor and City Clerk are hereby authorized
and directed to enter into a Supplemental Agreement modifying the terms of that certain
agreement dated October 7, 1959 for the relocation of existing water and irrigation
pipe lines owned by the City on P.S.H. No. 5, Junction Chinook and White Pass Branches,
and Jacobson to Fruitvale Blvd, a copy of which Supplemental Agreement is attached here-
to and by this reference made a part hereof.
Section 2. Resolution No. D -83 is hereby repealed and rescinded.

of a consent to easement for an electrical transmission line across property owned by
A. R. Ready and under lease to the City as a sanitary land fill, said action being
necessary due to the construction of the By -pass highway, be passed as read: carried,
Barber-, Bostic, Burns, Larson, Oliver and Robinson voting aye on roll call. Coombs
absent.
RESOLUTION NO. D -88, A RESOLUTION authorizing, the execution of a consent to easement
for an electrical transmission line across property owned by A. R. Ready, and under
lease-to the City as a sanitary land fill.
WHEREAS, on May 29, 1959 the City entered into a lease agreement
for the use by the City of certain real property in Yakima County, hereinafter described
for use as a sanitary larid fill, and
WHEREAS, Pacific Power & Light Company, in compliance with an
order of the Washirgton State Highway Department to remove its electric distribution
and transmission lines from the proposed location of High -kay No. 3 known as Yakima By-
pass, has planned and desires to cross over the site of said sanitary land-fill with
one of said power lines, and has requested said A. R. Ready to execute an easement
granting permission for such crossing, and
WHEREAS, it is in the best interest of the City of Yakima that
such permission be granted, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF' YAKIMA.:
Section 1. That the Mayor and City Clerk are hereby authorized
and directed to execute on the behalf of the City of. Yakima a consent to easement, a
copy of which is hereto attached and by this reference made a part hereof, permitting
A. R. Ready to grant an easement to Pacific Power and Light Company, its successors
and assigns, for an electric transmission and distribution line over the following de-
scribed real property situated in Yakima County, Washington, which is under lease to
the City under a lease agreement executed May 29, 1959, to -wit:
All that portion of Lot 1 of Larsen Home Sites, according
to the plat thereof recorded in volume "I" of Plats, page
5, described as follows:

RESOLUTION NO. D -891 A RESOLUTION designating the Bank of Yakima as one of the deposi-
tories for funds for the City of Yakima.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the Bank of Yakima, located in Yakima, Yakima
County, Washington, is hereby selected and designated as one of the banks of the City
of Yakima, and as a depository for funds of the City of Yakiiila, subject to the conditions
and restrictions hereinafter set forth.
Section 2. Before the City Treasurer of the City of Yakirra shall
be entitled to make deposits in said Bank of Yakima, the said Bank of Yakima shall,
within ten days after the date hereof, file with the City Clerk of the City of Yakima a
surety bond to the City of Yakima, in the maximum-amount of deposits to be designated by
the City Treasurer to be carried in said Bank of Yakima, conditioned for the prompt
payment thereof on checks duly drawn by the said City Treasurer or his duly authorized
Deputy, which surety bond shall-be approved by the Mayor and City Clerk.
Section 3. In lieu of the surety bond specified in Section 2
hereof, the said Bank of Yakima shall deposit with the City Treasurer or with Seattle
Trust and Savings Bank, a State Banking Association, any of the securities enumerated in
R.C.W. 35.38.0401 if there has been no default in the payment of principal or interest
thereon and the aggregate market value of which shall at all times be not lees than
110% of the amount of funds designated by the City Treasurer.
Section 4. At the same time the Bank of Yakima shall file with
the City Clerk a contract with the City of Yakima, wherein the Bank of Yakima agrees to
pay such rate of interest on the average daily balances, where such balance exceeds
1,000., of all municipal funds kept by the City Treasurer in said Bank of Yakim a,
while acting as such depository, as shall be fixed from time to by the Oity Finance
Committee, such payments to be made monthly to the City of Yakima while such deposits
continue in said depository. The contract shall run to the City of Yakima and be in
such form as shall be approved by the City Treasurer, Mayor and City Attorney.
Section 5. In the event repayment of deposits in such bank is
insured by the Federal Deposit Insurance Corporation or by any other corporation, agency
or institute organized pursuant to the laws of the United States, the execution and
filing of a bond with the City Treasurer shall be required only for so much of the desig
nated maximum amount of deposits, as such designated maximum amount exceeds the amount
of said insurance, and if the Bank of Yakima elects to deposit securities-in lieu of .a
bond, it shall be required_to deposit securities only to the amount necessary to secure
the excess of monies on deposit over the amount covered by such insurance.
Section 6. Funds on deposit in said Bank of Yakima by the City
of Yakima may be withdrawn only on checks signed-in the name of the City of Yakima by
the City Treasurer, or in case of his absence or inability to act, by the Deputy City
Treasurer. Endorsements for deposit may be made by rubber stamp and shall bind the City
of Yakima to the same extent as those signed by the City Treasurer.
Section 7. The City Treasurer and Deputy City Treasurer of the
City of Yakima are hereby empowered on behalf of the City of Yakima to execute the bank
signature card binding the City of Yakima to the rules and regulations of said bank
governing checking accounts and to'any changes, modifications or additions thereto.
Section 8. This authority shall continue in full force and effect
until notice in writing of its revocation shall be given to and received by the Bank.
Section 9. A copy of this resolution shall be forthwith delivered
to the Manager in charge of the Bank of Yakima.

The City Planning Commission recommending that the requests for the rezoning of certain
property, as described on petitions No. 22 and 23, as filed by Gottlieb Hein and cthers
and Lyle V. Washburn, respectively, be denied, it was MOVED by Robinson, seconded by

The City Engineer reporting the completion of the Planh and Mead Avenue Domestic
Water and Sewer District, being L.I.D. NO. 872, it was MOVED by Oliver, seconded by
Burns that the City Clerk be and is hereby instructed to give notice of hearing on
said assessment roll for the hour of 3-olclock P.M. on Wednesday the 10th day of
February, 1960, by publication and notice to each property owner as provided by law:

City Manager Allison reporting that he has just learned that the City of Yakim rna

The following bids for the sale of sludge at the Sewage Disposal Plant were received
and considered by a Bid Board comprised of the Purchasing Agent, City Clerk.and City
Engineer on Monday, January 11, 1960:

Manager Allison concurring with the bid board and recommending the bid of J. W. Orkney
in the amount of $1805.00 per year, as the highest-and best bid, it was MOVED -by Burns,
seconded by Larson that the City Attorney be and is hereby instructed to prepare the
necessary resolution and agreement for this transaction: carried, Barber, Bostic,
Burns, Larson, Oliver and Robinson voting aye by voice vote. Coombs absent.
Manager Allison.prepari.ng to conform with Resolution No. D -89 which designates the
Bank of Yakima as one of the depositories for City Funds and recommending that this
bank carry $100,000.00 of City Funds on deposit, it was.MOVED by Barber, seconded by
Burns that -the Council concur with the Manager and $100,000.00 be placed on 'deposit
at the new Bank of Yakima: carried., Barber, Bostic, Burns, Larson, Oliver and Robinson

Manager Allison reported to the Council that Mr. Varney Cornwell will not be taking the
position of Personnel Director and Civil Service Examiner as planned.
There being no further business to come before the Council, it was MOVED by Barber,
seconded by Oliver that we do now adjourn at the hour of 5:20P.M.: carried, Barber,
