The .City Council met in regular session, Mayor Bostic, Councilman Barber, Burns, Coombs
Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson present on
roll call.
The invocation was given by Councilman Larson.
The minute.s.of, the regular meeting of December 30, 1959 were approved as read.
This being the time for the continuation of the hearing on the assessment roll for
the South 5th Avenue Curb, Gutter and Sidewalk District, or L.I.D. No. 874, said con-
tinuation being necessary because of oral and written protest filed by Attorney Carl
Loy for C. S. Aiken, a property owner in said district and the City Council asking for
an opinion from.the City Attorney as to the legal status of the City of Yakima in con-
nection with said protest, the City Attorney cited specific court cases to prove tlt
the particular use of property does not effect the benefits and ruled that said property
is benefited by this improvement .regardless of use and therefore should be included
inothis district for payment. Attorney Loy,beirg present again protested the assessment
on behalf of his client, stating that the sidewalk was not needed as-there was a hard
surface on this area at the time the improvement was planned and that the grade on the
sidewalk was too high making it impossible for the water to drain away from the building
on the property. All persons having been heard on this matter, it was. MOVED by
Robinson, seconded by Coombs that Ordinance No. 68 confirming the Assessment Roll for
L.I.D. No. 874 and every part thereof, be passed as read: carried, Barber,_ Bostic,
Burns, Coombs,-Larson, Oliver and Robinson voting aye on roll call.
ORDINANCE NO. 68, AN ORDINANCE confirming the assessment roll covering Local Improvemen
District No. 874 as created and established by Ordinance No. 15 of the Ordinances of
the City of Yakima. , „ .
Councilman Robinson having introduced for study and consideration, two ordinances,
setting forth fringe benefits for all City Employees at a regular meeting _of the City
Council on December 30, 1959, City Manager Allison explained changes in said ordinances
as asked for by employees. After due consideration, it was MOVED by Larson, seconded
by Barber that Ordinarre No. 69 relating to vacations, sick leave, civil leave, militar
leave, and establishing rules and regulations on time off, establishing holidays and
the basic work week for all employees of the City of Yakima except Firemen, be passed
as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting
aye on roll call.
ORDINANCE NO. 69, AN ORDINANCE relating to vacatio ns,_sick leave, civil leave,
military leave, establishing rules and regulations on time off, establishing holidays
and the basic work week for all employees of the City of Yakima except Firemen, and
repealing all resolutions, ordinances or parts of ordinances in conflict herewith.
Moved by Robinson, seconded by Larson that Ordinance No. 70'amending Ordinance No. B -933
relating to the organization, management and operation of the Fire Department, pre-
scribing hours of labor and fixing the allowance for vacations, be passed as read:
carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll
call.,
ORDINANCE NO. 709 AN ORD11TANCE amending Section 4 of Ordinance No. B -933 entitled
"AN ORDINANCE relating to the organization, management .and operation of the Fire
Department of the City of Yakima, Washington, prescribing hours of labor and fixing
allowance for vacations."
Expressions of thanks and appreciation were made by delegates from employee groups
to the members of the City Council for the consideration and passage of Ordinances
69 and 70.
Moved by Barber, seconded by Oliver that Resolution No. D -82 providing for the transfer
of $35.00 within the' Airport-1959 Budget, said amount being necessary for pensions and
state taxes, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver
and Robinson voting aye on roll call.
RESOLUTION NO. D -82, A RESOLUTION transferring funds within the Maintenance and
Operations classification of the 1959 appropriation for 30 - Airport.
WHEREAS, a surplus exists in Account 7 -54, Heat and Fuel, of the
Maintenance and Operations classification of the 1959 appropriation for 30 - Airport,
and
WHEREAS, at the time of the adoption of the 1959 Budget it could
not have been reasonably foreseen that contributions for Account 7 -11, Salary Fringe -
Statewide Pension, and Account 7 -60, Taxes - State would be raised, and
WHEREAS, the City Council of the City of Yakima finds that it is
in the best interests of the people of the City of Yakima to make a transfer between
said funds in the sum of $35.00 and the action contemplated herein is authorized by
R.C.W. 35.33.120, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the sums itemized below are hereby transferred.wi.thin the
Maintenance and Operations classification of the 1959 appropriation for 30_ Airport
From: Account 7 -54, Heat and Fuel $35.00
To: Account 7 -11, Salary Fringe -
Statewide Pension $25.00

voting aye on roll call.
ORDINANCE NO. 720 AN ORDINANCE fixing the time of delinquency of installments of

- Moved by Burns, seconded by Larson that Resolution No. D -83 amending the contract dated
October 7, 1959 with the Washington State Highway Commission for the relocation of
existing water and irrigation pipelines owned by -the City on PSH No. 5 Junction .
Chinook and White Pass Branches and Jacobson to Fruitvale Blvd., said amendment allowing
the Contractor to substitute reinforced 36" concrete pipe,for new 34" wood stave pipe
as specifiee in said agreement, be passed as read: carried, Barber, Bostic, Burns,
Coombs, Larson, Oliver and Robinson voting aye on roll call.
RESOLUTION NO. D -83, A RESOLUTION amending the contract dated October 7, 1959 with
the Washington State Highway Commission.
WHEREAS, pursuant to authority of -a resolution adopted by the
City Council of the City of Yakima, the City of Yakima entered into an agreement with
the Washington State Highway Commission on October 7, 1959 for the relocation of ex-
isting water and irrigation-pipelines owned by the City on PSH No. 5, •Junc•tion Chinook
and White Pass Branches, and Jacobson to Fruitvale Blvd., said agreement called f orthe
replacing o.f new 34" wood stave pipe in connection with said relocation, and
WHEREAS, the contractor has offered to furnish and install at
no cost to the City new reinforced 36" concrete pipe in said locations, and
WHEREAS, the Washington State Highway Commission has agreed to
said substitution which will in fact give the City of Yakima better transmission lines
in these areas provided that the City will waive the guaranty periods as -set forth in
the contract and will agree-to deleting all of Paragraphs IV and VII of said agreement,
and
WHEREAS, it is in the beat interests of the City of Yakima to
consent to said substitution and waiver, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the contractor performing the work under contract
to the State of Washington, Washington Highway Commission for the improvement entitled
P.S.H. No, 5, Junction Chinook and White Pass Branches, and Jacobson to Fruitvale
Blvd., may substitute reinforced 36" concrete pipe for the new 34" wood stave pipe
specified in that certain agreement between the City of Yakima and said Washington
State Highway Commission, it being understood that such substitution will -be at no-
cost to the City of Yakima.
Section 2. That Paragraphs IV and VII of said agreement may be
deleted therefrom and the City of Yakima waives all rights that might thereby inure to
it.
