DECEMBER,9 1959
The City Council met in regular session, Mayor Bostic, Councilman Barber, Burns, Coombs,
Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson present on
roll call.
Invocation was given by Councilman Burns.
Minutes of the regular meeting of December 2, 1959 were approved as corrected.
An ordinance appropriating the sum of $350.00 for the purpose of wiring the City Hall
building for a standby generator for radio equipment in connection with the operation of
Civil Defense Department of the City of Yakima, was read in its entirety at the regular
meeting of the City Council on Wednesday the 2nd day of December, 1959 and laid on the
table for one week and now having been read by caption only, it was MOVED by Barber,
seconded by Larson that Ordinance No. 54 providing for said appropriation be passed as
read: _carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye
on roll call.
ORDINANCE NO. 54, AN ORDINANCE appropriating the sum of $350.00 to Account 6 -12
Building Improvement of the Capital or Betterment Accounts classification of the 1959
appropriation for Civil Defense, 13 - Other Public Safety, and declaring an emergency.
A petition, being petition No., 21, having been duly filed by A. R. Kern and others, re-
questing the vacation of a portion of Richey Road, and this being the timefixed for the
hearing on said petition, and there being no protests in writing or otherwise, it was
MOVED by Robinson, seconded by Oliver that Ordinance No. 55 providing for said vacation,
be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson
voting aye on roll call.
ORDINANCE NO. 55, AN ORDINANCE providing for the vacation of a portion of Richey Road,
more particularly described as follows, to -wit: Beginning 816 feet South and 20 feet
East of the NW corner of NE4 of Section 22, Township 13 N, Range 18, E.W.M.; thence
South 53 °06' East 63.24 feet; thence East 101.0 more or less to the West property line
of Lot 19 of Kern Addition; thence North 35 °.00' west along the west line of said Lot 19,
78.5 feet more or less to the NW corner of said Lot 19; thence South 84 038' West 106.45
feet; thence South 16.87 feet to the point of beginning. Except for an easement for
water main 10 feet in width along the following described center line; Beginning 797
feet South and 20 feet East of the NW corner of NE4 of Section 22, Township 13 North,
Range 18, E.W.M., thence South 53 °06' East 94 feet to the South line of that portion of
vacated Richey Road.
This being the time for the hearing on the assessment roll for L.I.D. No. 870, being
the Kenny Drive & Various, Streets Paving District, and the Summitview Assembly of God
Church having filed written protest, which was read by the (%lerk, stating that said
church is being unduly assessed on street improvements which do not adjoin the church
property or add to the value of said property, and stating further that there is no
access to the church property through the improved streets, and since this protest was
not filed in time to be checked by the City Manager prior to this hearing, it was MOVED.
by Burns, seconded by Barber that this hearing be continued to the 16th day of December,
1959 and that this matter be referred to the City Manager and the City Attorney for
recommendation: carried, Barber, Bostic, Burns,.Coombs, Larson, Oliver and Robinson
voting aye voice vote.

rezone of certain property situated between South 3rd Avenue and South 4th Avenue in
the 1400 block, from R -2 Residential to B -2 Business zone, it was MOVED by Coombs,
seconded by Oliver that said petition be referred to the Planning Commission for
recommendation; carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson
voting aye by voice vote.
A petition, being petition No. 23, having been filed by Lyle V. Washburn and Harriet
Washburn, requesting the rezone of certain property 150 feet south of Nob Hill Blvd.
and West of 17th Avenue, said property situated betweenl7th and 18th Avenue, from R -2
Residential to B -3 Business zone, it was MOVED by Larson, seconded by Coombs that said
petition be referred to the City Planning Commission for recommendation: carried,
Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote.
Moved by Coombs, seconded by-Oliver that Ordinance No. 56 transferring $500.00 within
the 1959 Current Expense Legal Department Budget, be passed as read: carried, Barber,
Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call.
ORDINANCE NO. 56) AN ORDINANCE transferring the sum of $500.00 from the Salaries
classification to the Capital or Betterment accounts classification all within the 1959
appropriation for 02 :- Legal Department, and declaring an emergency.
Moved by Coombs, seconded by Burns.that subsection (b) and (e) of Section 88 of the
Traffic Code or Ordinance No. B -1526, be amended to prohibit parking on palest Chestnut
Street on the south side from 6th Avenue to 7th Avenue and to allow two hour parallel
parking on both side of West Chestnut Street from 5th Avenue to 6th Avenue, be passed
as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting
aye on roll call.'
ORDINANCE NO. 57, AN ORDINANCE amending Subsections (b) and (e) of Section 88 of
Ordinance No. B -1526 entitled: "AN ORDINANCE relating to and regulating traffic, travel
and transportation and their incidents upon the streets and other ways open to the
public; prescribing the powers and duties of officers and others in relation thereto;
defining offenses; providing penalties, and repealing Ordinance No. B -131 and all other
amendments therefore and all other ordinances in so far as they are in conflict there-
with, and declaring an emergency ", as amended.
An ordinance providing for the appropriation of $2,400.00 for the payment of pensions
under the Firemen's Relief and Pension Fund, was read in its entirety by the Clerk and
ordered laid on the table for one week, or to be read and considered at the next regular
meeting of the City Council on the 16th day of December, 1959.

the 1959 Current Expense Budget to pay for the subscription--: toi- Management Information

RESOLUTION NO. D -6$1 A RESOLUTION transferring the sum of $99.00 within the Maintenance
and Operation classification of the 1959 appropriation for 01 - Administrative.
WHEREAS, it is deemed in the best interests of the people of the
City of Yakima to subscribe to the Management Information Service, and
WHEREAS, there is insufficient funds in Account 7 -53, SubscriptionE
and there is a surplus of funds in Account 7 -66, Insurance Bonds (Surety), both of said
accounts being within the Maintenance and Operation classification of the 1959 appropria-
tion for. 01 - Administrative, and
WHEREAS, the action contemplated herein is authorized by R.C.W.
35. 33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the sum of $99.00 is hereby transferred from Account 7 -66,
Insurance Bonds (Surety) to Account 7 -53, Subscriptions, all within the Maintenance
and Operation classification of the 1959 appropriation for-01 - Administrative and the
Director of Finance is hereby authorized and directed to make the aforesaid transfer.

RESOLUTION NO. D -69, A RESOLUTION transferring funds within the Maintenance and Opera -
tions-;classification of the 1959 appropriation for 30 - Airport.
WHEREAS, there are insufficient funds in Account 7 -41,. Maint.-
Automotive - Motor Fuel, Lubricants, Storage, etc., and there is a surplus of funds in
Account 7 -54, Heat and Fuel, and
eIHEREAS, the need for pumping water to newly seeded area at the
Airport necessitated a greater consumption of motor .fuel than could have been reason-
ably foreseen at the time of the adoption of the 1959 appropriation for Airport, and
WHEREAS, the City Council of the City of Yakima finds that it is
in the best interests of the people of the City of Yakima to make a transfer between
said funds in the sum of $170.00 and the action contemplated herein is authorized by
R.C.W.35.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the sum of $170.00 is hereby transferred from Account 7 -54
Heat and Fuel to Account 7 -41, Maint.- Automotive Motor Fuel, Lubricants, Storage, etc.,
all within the Maintenance and Operations classification of the 1959 appropriation for
30 - Airport, and the Director of Finance of the City of Yakima is authorized and direct-
ed to make the aforesaid transfer.

RESOLUTION NO. D -70, A RESOLUTION providing for the transfer of funds within the
Maintenance and Operation classification of the 1959 appropriation for the Legal Depart-
ment.
WHEREAS, it is necessary in the operation of the Legal Department
to purchase more books, and
WHEREAS, there are not sufficient funds in the 1959 Budget therefor
and
WHEREAS, the City Council deems it in the best interests of the
City of Yakima to make the transfer herein, and the action contemplated is authorized by
R.C.Vd. 35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the sum of $200.00 is hereby transferred from Account 7 -21
Professional, Legal and Accounting account to Account 7 -31, Publications and Printing
Account, all within the Maintenance and Operation classification of the Legal Department
appropriation in the 1959 Budget and the Director of Finance is hereby authorized and
directed to make the aforementioned transfer herein provided.

D -65 which re- establishes the annual irrigation Maintenance
rates for the year 1960, said resolution being necessary since certain Local Improvement
Districts were inadvertently omitted from Resolution No. D -65, be passed as read:
carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll
call.
RESOLUTION NO. D -719 A RESOLUTION amending Resolution No. D -65 entitled "A RESOLUTION
re- establishing the annual irrigation maintenance rates and charges and providing for a
surcharge in certain areas in the City of Yakima.
WHEREAS, two Irrigation Local Improvement Districts were omitted
from Section 2 of Resolution No. D -65, adopted by -the City Council on November.25, 1959,
and
WHEREAS, said Resolution should be amended to include said two
Irrigation Local Improvement Districts,,now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That Section 2 of Resolution No. D -65 is hereby amended to read
as follows:
Section 2. That beginning January 1, 1960, and for a three year
period thereafter, because of extraordinary maintenance necessary for proper functioning
there shall be added to the_said annual irrigation maintenance rates and charges in the
following listed Irrigation Local Improvement Districts, to -wit:
