Invocation was given by Councilman Barber. Minutes of the regular meeting of November 18, 1959 were approved as read. This be_rg the time for the hearing on the assessment roll covering L.I.D. No. 871, being the South 6th Avenue and Cornell Paving District and there being no protests in writing or otherwise, it was MOVED-`8y Robinson, seconded by Larson that Ordinance No. 43, confirming said assessment roll and every part thereof, be passed.as read: carried Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 43, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 871 as created and established by Ordinance No. B -2303 of the Ordinances of the City of Yakima. This being the time for the hearing or. the assessment roll covering L.I.D. No. 875, being the Corpron Hillside Addition Sewer District and there being no protests in writing or otherwise, it was MOVED by Burns seconded by Barber that Ordinance :No. 44, confirming said assessment roll and every part thereof, be passed as read: carried, Farber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE N0. 44, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 875 as created and established by Ordinance No. 20 of the Ordinances of the City of Yakima. An ordinance appropriating the sum of $2,070.98 in the Current Expense Fund to cover certain emergencies in the 1959 Budget, having been read in its entirety at a regular meeting of the City Council on the 18th day of November, 1959 and ordered laid on the table for one week and now having been read by caption only, it was MOVED by Coombs, seconded by Oliver that Ordinance No. 45 providing in .detail for said appropriation and its expenditure, be passed as read: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting; aye on roll call. ORDINANCE NO. 45, AN ORDINANCE appropriating the sum of $2,070.98 from the unappropriat• ed funds of Current Expense of the City of Yakima to Current Expense City Civil Service Salaries Account 7 -02, $1,070.98; Maintenance and Operation Account 7 -30, Clerical and Office, $150.00 and Account 7 -31, Publications and Printing, :$500.00; and Capital or Betterment Account 6 -61, Furniture and Fixtures, $350.00, of the 1959 Budget, and declaring an emergency. A petition, being petition No. 19, having; been duly filed by A. J. Lenz and John J. Kiernan requesting the rezone of property situated at 1106 and 1108 Brown. Avenue from R -3 Multiple Family Residential to B -2 Local Business and Planning Commission recom- mending that said property be rezoned accordingly, it was MOVED by Barber, seconded by Coombs that Ordinance No. 46 accepting the recommendation of the Planning Commission for the rezone of this property, be passed as read: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 46, AN ORDINANCE accepting' °the recommendation of the Planning; Commission for the rezone of certain property in the vicinity of Browne Avenue and Pierce Avenue. ORDINANCE NO. 47, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 868 as created and established by Ordinance No. B -2249 of the Ordinances of the City of Yakima. Moved by Oliver, seconded by Robinson that Ordinance iJo. 48 transferring $19,994.22 in the 1959 Budget for the Water -Sewer Department, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye or, roll call. ORDINANCE NO. 48, . AN ORDINANCE transferring funds within the 1959 appropriation for the Water -Sewer Department and declaring an emergency. Moved by Robinson, seconded by Barber that Ordinance No. 49 providing for the transfer of $2,230.00 within the 1959 Budget for the Tahoma Cemetery, be passed as read: carried Barber, Bostic, Burns, Coombs, Larson,'Oliver and Robinson voting aye on roll call. ORDINANCE No. 49, providing for the transfer of the sum of $2,230.00 between various accounts within the 1959 appropriation for 50 - Ceme.tery Department and declaring an emergency. The Statewide City Employees Retirement System having; notified the City Clerk that Oren D. Ray will attain the extended retirement age of 66 by February 1, 1960 and 1�9r. Ray requesting an extension of employrm nt in accordance with. the retirement 1a'w", it was MOVED by Burns, seconded by Larson that Resolution No. D -59, providing for the extention of the retirement date of said employee for one year, be passed as read: carried, Barber Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -59, WHEREAS, Oren D. Ray is an employee of the City of Yakima and under the Statewide City Employees Retirement System, and, WHEREAS, the said Oren D. WHEREAS, it is in the best interests of the people of the City of Yakima that lockers be installed and maintained at the Yakima Municipal Airport, and . RESOLUTION NO. D -65, A RESOLUTION re- establishing the annual irrigation maintenance rates and charges and providing for a surcharge in certain areas in the City of Yakima. WHEREAS, it is necessary to re- establish the annual irrigation maintenance rates and charges in the City of Yakima, ,and WHEREAS, because of certain extraordinary maintenance in certain areas it is necessary that a surcharge be added to the rates and charges within such areas, now, therefore, BE IT RESOLVED BY THE CITY C01__gCIL OF THE CITY OF YAKIMA: Section. 1. That from and after January 1, 1960, the annual irrigation maintenance rates and charges to be assessed by the Irrigation Department of the City of Yakima shall be as follows land Area served by Gravity System .00075 per sq) ft of Area served by Lenox Pump System ".00095 " " " " Area served by other pump systems .00105 " it it Section 2. RESOLUTION NO. D -661 A RESOLUTION providing for the transfer of $3,470.00 within the Maintenance and Operation classification of the 1959 appropriation for 03 - General Government and City Hall. WHEREAS, at the time of the adoption of the 1959 Budget, it could not have been contemplated that insufficient money was appropriated for Account 7 -55, Light and Power, Account 7 -57, Telephone and Telegrams and Account 7 -47, Maint.- Equipment, Contracted Services, and WHEREAS, surplusses exist in certain other accounts within the same classification, and WHEREAS, the City Council deems it in the best interests of the people of the City of Yakima to make a transfer in the total sum of $3,470.00 between certain of said accounts and the action contemplated is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following sums are hereby transferred between the accounts hereinafter listed, all within the Maintenance and Operation Classification of the 1959 appropriation for 03 - General Government and City Hall. No. 874, being the South 5th Avenue Curb and Sidewalk District, it was MOVED by Robinson, seconded by Coombs that the Clty Clerk be and is hereby instructed to give notice of hearing on said assessment roll for the 23rd day of December, 1959 by publication and written notice to each.property owner in,said district; carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. Lloyd R. and Velma Mansfield having duly filed a petition, being petition No. 17, re- questing the rezone of property situated at 909.South 33rd Avenue from R -1 Residential to R -3 Multiple Family Residential and the Planning Commission now recommending that the rezone requested be denied, it was MOVED by Larson, seconded by Barber that the Planning Commissions report be received and filed:. carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. It was ordered by the Council that the matter of parking in the downtown area be in- cluded on the agenda for the next regular meeting of the City Council on the 2nd day of December, 1959. Manager Allison discussed the need of a median barrier on West Yakima Avenue due to the fact that a five minute car wash and service station is to be built on the south- east corner of lst Avenue and West Yakima Avenue. No formal action was taken on this matter. Manager Allison reporting ' on the benefits derived by bd.onging to the National Association of City Managers and asking permission to pay the $100.00 membership, it was MOVED by Coombs, seconded by Robinson that the City Manager be allowed membership in this association. (See page 596 for correction) Other matters discussed by the Manager with the Council but no formal action taken., were certain new street and traffic lights, and the use of certain streets with hills for sliding. Councilman Coombs expressed Thanksgiving Greetings on behalf of'the Council to all of the City Employees. There being no further business to come before the Council, it was MOVED by Burns, seconded by Barber that we do-now adjourn at the hour of 5 o,'clock P.M.: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robin n vot'ng ye by :voice vote.
