The City Council met in regular session, Mayor Bostic., Councilmen Barber, Burns, Larson,
Oliver, Robinson and City Manager Allison present on roll call. Councilman Coombs
and City Attorney Arntson absent.
Invocation was given by Councilman Oliver.
Minutes of the regular meeting of October 28, 1959, were approved as read.
The City Planning Commission notifying the City Council by letter and reaffirming their
recommendations that the property in the vicinity of 36th and Tieton Drive be rezoned,
the City Council requested an opinion and interpretation from City Attorney Arntson on
Section 306 of Ordinance 2095 and that the matter should come before the Council
November 4, 1959. The City Attorney now reporting by letter that he has carefullye-
reviewed both the factual situation and the law in this and other jurisdictions and in
his opinion Dr. Meyers does not have a visted right to proceed with the construction of
a shopping center on the purported site and the above mentioned section of Ordinance
No. B -2095 is a valid exercise of the Police power of the City of Yakima. Moved by
Robinson, seconded by Larson that the letter of recommendation from the Planning
Commission on the subject be filed: carried, Barber, Burns, Larson, Oliver, Robinson
voting aye by voice vote. Bostic voting nay. Coombs absent.
A petition requesting diagonal parking on the Cities streets and objecting to one-
way streets was filed by Stephen P. Burke, said petition carrying signatures of about
eighty seven taxpayers and drivers. Manager Allison advised the Council that.a survey
was underway and would be completed in the near future and as soon as the survey is
complete a report will be made to the Council.
Moved by Burns, seconded by Barber that Ordinance No. 38, amending Section 700 and'l,
adding paragraphs 29, 30 and 31 to Section $00 be passed as read: carried, Barber,
Bostic, Burns, Larson, Oliver, Robinson voting aye on ro-1-1 -c-all- -Coombs absent.
ORDINANCE No. 38, AN ORDINANCE amending Section 700 and adding paragraphs 29, 30 and
31 to Section $00 of Ordinance No. B -2095, the same being an ordinance establishing
zones in the City of Yakima; regulating and limiting the use of buildings and.land;
establishing use, height, area and off - street parking regulations; providing for yards,
courts and other open spaces, providing for the adoption of maps showing the boundaries
of said zones; providing for a Board of Adjustment; providing for the administration
and e norcement of this ordinance, and fixing penalties for the violation of its
provisions.
Moved by Barber, seconded by Burns that Ordinance No. 39 accepting the recommendations
of the Planning Commission to rezone Lot 21 - Harland Addition - from R -2 family resid-
ential to R -3 multiple family residential, be passed as read: carried, Barber, Bostic,
Burns, Larson, Oliver, Robinson voting aye on roll call. Coombs absent.
ORDINANCE No. 39,- AN ORDINANCE accepting the recommendation of the Planning Commission
for the rezone of Certain property in the vicinity of Sunset Avenue and Crescent Drive.
The City Engineer and City Manager now recommending the payment of monthly estimates on
work performed on city projects for the month of October as follows:

Mr.. Gayle. Wineriter, representative of the City Employees' Union, asked that at
least ten (10) holidays be recognized by the Council stating that all the larger
cities were observing these holidays. Mayor Bostic suggested that all employees other
than fire and police have eight holidays each year, but that the firemen and policemen
be given some consideration in the future concerning holidays. Councilman Robinson
stated he favored eight holidays per year for city employees. After some discussion
considering various businesses and industry, it was moved by Burns, seconded by Robinson
that an ordinance be drawn setting out New Years, Washington's Birthday,'Memorial Day,
July 4th, Labor Day, Veterans Day, Thanksgiving and Christmas as legal holidays:
carried, Barber, Bostic, Burns, Larson, Oliver, Robinson voting aye by voice vote_.
Coombs absent.
Moved by Larson, seconded by Robinson; that City Manager Allison attend the Finance
Meeting for first class cities at Spokane, November 12, 1959, and he be allowed to
designate other department heads that he feels should attend, with expenses paid:
carried, Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye by voice Vote.
Coombs absent.
Mrs. Mamie Myers, of 9 South Naches Avenue, talked to the Council about obscene
literature found on school grounds. Councilman Oliver complimented Mrs. Myers for
having the backbone to bring the matter before the Council and remarked that something
should be done to stop the printing of this type of literature. Manager Allison said
he would have the plain clothes detectives try to pick up more information on the
matter.
Bids having been received and considered by the bid board comprised of the City Clerk,
Purchasing Agent and Al Richards at 10 A.M. October 26, 1959, for the purchase or
rental of a grader for the Street Department, the following bids were considered:

The Trade -ins offered on the Huber Maintainer are as follows:
Toole Corp. $3500.00 and $3000.00 on their alternate

and the City Manager now recommending that the lowest and best bid is that of the
Toole Corporation, it was moved by Burns, seconded by Oliver that the bid for the
grader be awarded to Toole Corporation of Seattle: carried, Barber, Bostic, Burns,
Larson, Oliver, Robinson voting aye by voice vote. Coombs absent.
Mayor Bostic reminded the Council -of riding in the Veteran's Parade on November 11th,
the parade starting on Naches Avenue at 10 A.M. Councilmen Barber, Burns and Larson
indicated they would be there. All - members of the Council were asked to turn out.
City Manager Allison requesting permission to sell on bids or auction surplus equipment,
a list of such equipment was furnished -each member of the Council. Moved by Burns,
seconded by Larson that the City Manager be allowed to go ahead and dispose of said
surplus property by any legal means: carried, Barber, Bostic, Burns, Larson, Oliver.
and Robinson voting aye by voice vote. Coombs absent.
Moved by Robinson, seconded by Oliver that the City Manager be authorized to hire
appraiser to establish the value of city property acquired by foreclosure sale:carried,
Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye on roll call. Coombs
absent.
There being no further business to come before the Council, Mayor Bostic declared the
meeting adjourned at the hour of 5:10 P.M.
