The City Council met in regular session, Assistant Mayor'Robinso_n presiding, Councilmen
Barber, Burns, Coombs, Larson and Oliver, City Manager and. City Attorney present on
roll call. Mayor Bostic absent.
The Invocation was given by Councilman Coombs.
The minutes of the regular meeting of October; 21, 1959 were approved as read.
The City Manager having submitted a written report on a sidewalk policy for the City of
Yakima at the regular meeting of the City Council on Ocotber 21, 1959, and the Council
ordered this matter to be discussed on this date, those persons present who are interest
ed in this matter were heard. Manager Allison explained that he is trying to arrive at
something standard in the way of sidewalk development for the city, explaining that they
should be in areas leading to schools and shoping centers in order that school children,
housewives and elderly people can be served to the best advantage. He reported further
that the engineering staff is working on the plan and the estimated cost of sidewalks
in the neighborhood of the Hoover School which is ih a flat area and they will work out
the same information in an area having- 'more irregular terrain and when completed this
information will be presented to the Council. Manager Allison also stated that his
printed reportc:is available to the public. After discussion, it was MOVED by Coombs,
seconded by Barber that the City Manager proceed with his work on the sidewalk problem,
implementing said plans with estii�;;ated costs and other findings: carried, Barber, B?urns
Coombs, Larson, Oliver and Robinson vot:i,na ye by voice vote. Bostic absent.
An application for reclassification of use of certain property situated at the corner
of Sunset Avenue and Crescent Drive, having beer. duly filed by Simon Harkema and re-
ferred to the Planning `'ommission for study and recommendation and the Planning
Commission now recommend;ng the rezoning of Lot 21, Harland Addition from R -2 two famil
residential to R -3 Multiple Family Residential zone, it was MOVED by'Coombs, seconded
by Oliver that the City Council hold their hearing and ,consider the ordinance for
passage on the 4th day of November, 1959 at their regular meeting: carried, Barber,
Burns', Coombs, Larson, Oliver and Robinson voting, aye by boice bote. Bostic absent.
Moved by Oliver, seconded by Burns that Ordinance No. 37 providing for the transfer of
$5,900.00 within the 1959 budget for Current expense be passed as read: carried,
Farber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call'. Bostic
absent.
ORDINANCE NO. 37, AN ORDINANCE providing for the transfer of $5,900.00 within the
1959 appropriations for 03- General Government and City Hall and 04 - Finance Department
and declaring an emergency.
The City Planning Commission making certain recommendations in a letter to the Council,
read by the Clerk of the Council, on Resolution No. D -36 and D -41 being two individual
rezone problems, it was MOVED by Coombs, seconded by Larson that these items be con-
sidered by the Council individually: carried, Barber, Burns, Coombs, Larson, Oliver
and Robinson voting aye by voice vote. Bostic absent.
At a regular meeting of the City Council on September 16, 1959, a resolution being
Resolution No. D -36, modifyin the recommendation of the Planning Commission for the
amendment of Section 700 and 900 "to include establishments dispensing pharmaceutical
and optical prescriptions only ", was passed by the City-Council. The Planning Commission
now advising; the Council that-. they have voted to accept this modification,-it was
MOVED by Larson, seconded by .Burns that the City Attorney be and is hereby instructed
to prepare the ordinance covering the amendment as recommended by the Planning Commissio
and include this modification: carried, Barber, Burns, Coombs, Larson, Oliver and
Robinson voting aye by voice vote. Bostic absent.
At a regular meeting of the City. Council on September 30, 1959 a resolution, being
Resolution No. D -41, denying the recommendation of the Planning Commission for the re-
zone of certain property in the vicinity of South 36th Avenue and Tiet n.bDrive and re-
questing further report of the Planning Commission within 40 calsei�ar Ky� Re until
Planning Commission, in compliance with said resolution, now reports that they have
voted to re- affirm their recommendation that this property be rezoned. Dr. Meyers,
owner of part of the property included in this recommendation and Attorney Kenneth
Hawkins, representing Dr. Meyers were present. Dr. Meyers appealed to the City Council
to reconsider their decision stating that he felt that they had not seen all of the
files and reports in favor of this rezoning, that he planed to go forward with his plan
and would like to have the Council in favor of the project being planned for his property
He also stated that he had taken this matter up,with the law firm of Weter, Roberts,
and Shefelman, Northern Life Towe.r, Seattle, Washington and read a letter received from
this firm, in which they questioned the legality of certain points in Ordinance No.
B -2095 or the zoning code of the "ity of Yakima. All persons having been heard, it was
MOVED by Barber, seconded by Larson that further action be postponed until the regular
meeting of the City Council on November 4, 1959 and the City Attorney be and is hereby
instructed to investigate the legality of the zoning code in the matters questioned by
the Seattle firm:and report to the amity Council on this date: carried, Barber, Burns
Coombs, Larson, Oliver and Robinson voting aye by voice vote. Bostic absent.
The City Engineer h.avinr; filed the assessment roll with the City Clerk and reporting
the.completion of L.I.D. No. 868, being the Mary Lin Sanitary Sewer District, it was
MOVED by Coombs,.,.seconded by Larson that said report be accepted and the City Clerk be
and is hereby intrusted to give notice by publication and to the property owners of
the hearing on said assessment roll for the 25th day of November, 1959 at the hour of
3 :00 P.M.: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by
voice vote. Bostic absent.
The Airport Manager submitting a completed Request for Aid - .Federal Aid Airport
Program, to�e`ther with a letter to Mr. Charles W. Drew, District Airport Engineer,
Federal Aviation Agency, Seattle, Washington, which was read by the Clerk of the Council
said letter and request seeking federal funds for the improvement of the Apron and Ramp,
Apron and Ramp Lighting and Standby, - e-wer Unit for Field Lighting for the Yal�ima
Municipal Airport, it was MOVED by Barber, seconded by Oliver that the City Manager be
and is hereby authorized to execute this request for aid: carried, Barber, Burns,
Coombs, Larson, Oliver and Robinson voting; aye by voice vote. Bostic absent.

seconded by Larson that the City Council concur with said recommendation and the City
Manager be and is hereby authorized to execute the contracts for this construction upon
the filing of the necessary bond by the contractors: carried., Barber, Burns, Coombs,
Larson, Oliver and Robinson voting aye by voice vote. Bostic absent.
The matter of controlling dogs in the City of Yakima, having been brought to the atten-
tion of the `'ity Council, it '-was suggested that this matter be referred to the City
Manager for a report and recommendation.
Other matters discussed by the Council, but no formal action taken,were area beautifica-
tion, November 11, Veterans Day as a holliday, large vans, trucks and trailers travel -
ing on streets where they .should not be permitted__.
There being no further business to come before the Council, it was MOVED by Barber,
seconded by Larson that this meeting be adjourned: carried, Barber, &,rns, Coombs,
Larson, Oliver and Robinson voting aye by voice vote. Bostic absent. This meeting
adjourned at the hour of 5:a0 P.M.
