OCTOBER 21i, 1959
The City Council,met in regular session., Mayor-Bostic, Councilmen Barber, Burns, Coombs,
Larson, Oliver and Robinson and City Manager Allison present on roll call. City
Attorney Arntson absent.
Invocation was given by Councilman Larson.
The minutes of the regular meeting of October 14, 1959, were approved as read.
This being the time for the hearing on Resolution No. D -38, being a resolution of in-
tention to improve certain property by the construction and installation of water mains
for the purpose of supplying water for domestic use and fire protection and there being
no protests in writing or otherwise, it was MOVED by Robinson, seconded by Oliver that
Ordinance No. 36 providing for said improvement and creating L.I.D: No. 882, be passed
as read: carried, Barber, Bostice, Burns, Coombs, Larson, Oliver and Robinson voting
aye on.roll call.
ORDINANCE NO. 36, AN ORDINANCE providing•for the improvement of certain property by
constructing the necessary mains, fire hydrants, valves and other appurtenances for the
purpose of supplying water for domestic use and fire protection;`establishing a Local
Improvement District, providing for the method of payment thereof, and creating a specia
fund.
Moved by Burns, seconded by Larson` that Resolution No. D -.52, authorizing the Mayor and
City Clerk to enter into an agreement with the Yakima Valley Canal Company in connection
with the paving of a street in the vicinity of Crescent Drive and Richey Road as pro-
vided for in L.. I.D. 879, be passed as read:' carried, Barber, Bostic, Burns, Coombs,
Larson, Oliver, and Robinson voting aye on roll call.
RESOLUTION NO. D;52, A RESOLUTION 'authorizing the Mayor and City Clerk to enter into
an agreement for the paving of a street on the right of way of Yakima Valley Canal
Company.
WHEREAS, the City of Yakima is in the process of paving a street
in the vicinity of Crescent Drive and Richey Road in the City of Yakima, and in con-
nection with said construction it is necessary to cross the right of way of the Yakima
Valley Canal Company, and-in particular to cross over the 54" pipe line canal section
in said street intersection, and
WHEREAS, it is necessary that an agreement be entered,into with
said Canal Company for such const 'ruction, row, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the Mayor and City Clerk of the City of Yakima are hereby
authorized and directed to enter into an agreement with the Yakima Valley Canal Company
for the paving of the street across the 544/- pipe lime canal section of said Canal
Company, and the right of way thereof' in the street intersection of Crescent Drive and
Richey Road, a copy of which agreement is hereto attaches.

Moved by Barber, seconded by Larson that Resolution No. D -53, providing for.the transfer
of $300.00 within the 1959 Budget for the Irrigation Department, be passed -as read:
carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll
call.
RESOLUTION NO. D -531 A RESOLUTION providing for the transfer of $300.00 within the
1959 appropriation for the Irrigation Department.
WHEREAS, it is necessary to hire and rent more equipment for the
Irrigation Department, and it could not have been contemplated at the time of the
adoption of the 1959 Budget, and
WHEREAS,,a surplus exists in account 7 -33, Supplies - Field and
Non Office of the Maintenance and Operation classification of the 1959 appropriation
for the'Irrigation Department, and
WHEREAS, the City Council deems it in the best interest of the
people of the-City of Yakima to make a transfer in the sum of $300.00 from said Account
7 -33 to Account 7 -58, Equipment Rental, within the same classification, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the sum of $300.00 is hereby transferred from
Account 7 -33, Supplies - Field and No Office, to account'7 -58, Equipment Rental, all
within the Maintenance and Operation classification of the 1959 appropriation from 35-
Irrigation Department.
Section 2. The Director of Finance of the City of Yakima is
hereby authorized and directed to make the aforesaid transfer.

MOVED by Coombs, seconded by Burns, that Resolution No. D -54, authorizing the Mayor
and the City Clerk to execute an agreement with the Chateau Enterprises, Inc., for the
operation and rental of the restaurant and cocktail lounge at the Yakima Municipal
Airport, be ±passed as'read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and
Robinson voting aye on roll call.

RESOLUTION NO. D -54, BE IT RESOLVED BY THE CITY COUNCIL.,OF THE CITY OF YAKIMAY
That the Mayor and City Clerk are hereby-authorized on behalf
of the City of Yakima to execute an agreement with Chateau Enterprises, Inc. for the
operation of the restaurant and cocktail lounge at the Yakima Municipal Airport, subjec
to the terms and considtions as more fully set forth insaid agreement, a copy of which
is hereto attached and by this reference made a part hereof.

The City Engineer reporting the completion of L.I.D. No. 871, be the South 6th Avenu
and Cornell Avenue Paving District and having filed the assessment roll for said distri
with the Lity Clerk, it was MOVED by Oliver, seconded by Robinson that the date for
the hearing on said assessment roll be at the hour of 3 o'clock P.M. on Wednesday.the
18th. day of November, 1959 and the City Clerk be and is hereby instructed to give notic
of said hearing by publication and to each property owner as required by law: carried,

The City Treasurer having filed with the City Clerk, a Local, Irlprovement Assessment
deed to certain real property now belonging to the City of Yakima as a result of pro -
ceedings to foreclose local improvement leins upon said property, judgment enteree in
the superior court in Cause No. 40910 on the 18th day of January, 1957, it was MOVED
by Robinson., seconded by Larson that the City Clerk be and is hereby instructed to file
said deed with the County Auditor: carried, Barber, Bostic, Burns, Coombs, Larson
Oliver and Robinson voting aye by voice vote.
Mr. Henry Webster of 816 North 16th Avenue registered: a verbal protest to paying sewer
charges on property not hooked up to the sewer. Mr. Webster challenged the right of
the City to charge for services not rendered. This matter was referred to the City
Attorney for analizin.g.
Mr. John S. Post, a member of the Disabled American Veterans extended an invitation to
the City Council to ride in the parade being* planned for Veterans Day, November 11, 195
The Council asked Mr. Post to work through Manager Allison on this matter.
Mayor Bostic having been advised of a meeting of the Inland Water Ways Association to be
held in Lewiston Idaho on November 2, 1959 and having been requested to attend said
meeting as the official delegate for the City of Yakima, and-the Mayor stating that he
will be unable to attend, it was MOVED by Burns, seconded by Robinson that Councilman
Barber be appointed as the official delegate to attend this meeting and that his
expenses he paid: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson,
voting aye by voice vote.
A written report and recommendation on the sidewalk situation and future policy for the
City of Yakima having been submitted by the City Manager to the Council and the Council
wishing to study this report further, it was MOVED oy Robinson, seconded by Coombs tmt
this matter be placed on the agenda for the regular meeting of October 28, 1959: "carrie
Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye-by voice vote.
There being no further business to come before the Council, it was MOVED by Burns,
seconded by Larson.that we do now adjourn: carried, Barber, Bostic, Eurns, Coombs,
Larson, Oliver and Robinson voting aye by voice vote.
