HomeMy WebLinkAbout09/30/1959 Business MeetingX566 SEPTEMBER 30, 1959 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson present on roll call. Invocation was given by Councilman Larson. The minutes of the regular meeting of -September 23, 1959, were approved as read. This being the time fixed by Resolution No. 33 for the hearing on Petitons No. 13 and 14, petitioning for the construction of domestic water System and pipe sewers for the improvement of certain property in Central Addition by the formation of a local improve- ment district, and there being no protests in writing or otherwise, it was MOVED by Larson, seconded by Barber that Ordinance No. B -32 providing for said improvements and creating Local Improvement District No. '88'0, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver, Robinson and Bostic voting aye on roll call. ORDINANCE NO. 32, AN ORDINANCE providing for the improvement of certain property by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection, and by constructing pipe sewers with the necessary wye branches, manholes, and flush ends; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the time fixed by Resolution No. 34 for the hearing on Petition No. 12, filed by the Holiday Motel Inc., petitioning for the paving; of the Alley West from North lst Street 325 feet South of and parallel of Oak Street, and there being no protests in writing or otherwise, it was MOVED by Coombs, seconded by Robinson that; Ordinance No. 33, providing; for°said improvement and creating L.I.D. No. 881, be passed as. read: carried Barber Burns Coombs Larson Oliver, Robinson R and Bostic voting aye on roll call. ORDINANCE NO. 33, AN ORDINANCE providing for the improvement of certain property by grading;, ballasting and surfacing with asphaltic concrete, establishing a Local Improve- ment District, providing for the method of payment thereof and creating a spe.cipl ;,'fund. A petition, being Petition No. 16, having been filed by Yakima School District No. 7, .petitioning for the construction of water mains for the New Whitney School, it was MOVED by Ro.bir_son, seconded by Oliver that Resolution No. D -38, being a resolution of intention to improve said property by the tors truction of water mains and fixing the time of hearing at the hour of 3 o'clock P.M. on Wednesday the 21st day of October, 1959, be passed as read: carried, Barber, Burns-, Coombs, Larson, Oliver, Robinson and Bostic voting aye on roll call. RESOLUTION NO. D -38, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That it is its intention to improve the following described property by constructing the necessary mains, fire hydrants, valves, and other appurten- ances for the purpose of supplying water for domestic use and fire protection; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assessed for the above described improvements is situate in the City of Yakima, Yakima County, Washington, and described as follows: E2 of SW, NW4, Section 27, Township 13 North, Range 18, E.W.M. All persons who may desire to be heard'with reference to said proposed improvement are hereby notified to appear and present objections, if any, at a meeting of the City Council to be held at its office in the City Hall in the City of Y Yakima, Yakima County, Washington, at the hour of 3:00 o'clock P.M. on Wednesday, the 21st day of October, 1959, which time and place are hereby fixed for the hearing, of all matters •ablating, to said proposed improvement or•objections thereto; and for deter- mining the method of payment for said improvement, and the City Clerk is hereby directed to give notice of said hearing and of the intention to make the aforesaid improvement. A portion of the costs and expenses of s =aid improvement including engineering, inspection, advertising, publication of notices, if any, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor, as provided by law and as above described, and the balance of the said costs and expenses shall be borne by the City Water Depart- ment in accordance with Resolution No. C -1051. The City Engineer is hereby directed to submit to the City Council all of the data and any other information required by law to be by him submitted. The assessments shall be made according to special benefits de- rived from the improvement without regard to the zone and termini method. ATTEST: J. A. BOSTIC Mayor Yakima School District 'No. 7, requesting in a letter to the City Manager, the installa- tion of sewer lines at Whitney Elementary School and the new Junior High School site on Nob Hill Boulevard, it was MOVED by Coombs_, seconded by Larson that Resolution No. D -39 authorizing the execution of an agreement with said School district for the construction, by the City, of a sewer line on Nob Hill Blvd to furnish sewer service for the new Whitney Grade School, bb_,pa-ssed, as _read: carried, Barber, Burns, Coombs, Larson, Oliver, Robinson and Posti_c voting; aye by voice vote. RESOLUTION NO. D -39, BE IT RESOLVED BY THE CITY COIPTC.L OF THE CITY OF' YAKIMA: That the Mayor and City Clerk are hereby authorized on behalf of 1 1 I 1 C �J I 1 SEPTEMFER ,30, 1959 the City of Yakima to execute an agreement with Yakima School District No. 7, a municipal corporation, for the construction by the City of a sewer line on Nob Hill Blvd. to furnish sewer service for the new Whitney Grade School to be constructed in the vicinity of Nob Hill Blvd and South 44th Avenue, subject to the terms and conditions as more fully set forth in said agreement, a copy of which is hereto attached and by this reference made a part hereof. BOSTIC Clerk of the Council Mayor Moved by Larson, seconded by Oliver that Resolution No. D -40 granting permission to the Equitable Savings and Loan Association to install., maintain and u.se carillon bells on the roof of the Larson Building, be passed as read: carried, Barber, Burns, Coombs -, Larson, Oliver, Robinson and Bostic voting aye by voice vote. RESOLUTION N0. D -40, A RESOLUTION granting permission to Equitable Savings and Loan Association to install, maintain and use carillon bells on the roof of the Larson Build- ing, and prescribing conditions. WHEREAS, the Equitable Savings and Loan Association has applied for permission to construct, maintain and use carillon bells on the roof of the Larson Building, and WHEREAS, the City Council finds that such installation, maintenancE and use, under certain conditions, will be in the best interests of the people of the City of Yakima, iiow, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Permission is hereby granted to the Equitable Savings and Loan Association to install and maintain carillon bells on the roof of the Larson Building e Section 2. Said carillon bells shall in no event be operated before the hour of 9 A.M. nor after the hour of 6 P.M. Monday through Saturday. Section. 3. Under no circumstances shall the amplification system of said carillon bells be used for the broadcasting of publicity or advertising matter and any violation shall be ground for immediate revocation of this permit. Section 4. The installation, maintenance and use of said carillon bells shall be subject to all ordinances of the City of Yakima not inconsistent herewith. - Section 5. The permission herein granted shall be revocable at any time at the option of the Cit�r Council and no expenditure of money, lapse of time nor any other thing shall be deemed to grant the Equitable Savings and Loan Association any vested rights under the terms of this resolution. BOSTIC Mayor The City Planning Commission recommending the rezoning of certain property South of Titon Drive between 36th and 38th.Avenues from R -1 Residential to B -2 Local Business zone and a hearing having been held by the City Council on the 16th day of September ,at which time action was postponed to this date, and the City Attorney now informing; the Council that he had prepared an Ordinance concuring with the Planning Commissions recommendation and a Resolution denying said recommendation, to be accepted or rejected by the City Council, it was MOVED by Robinson, seconded by Coombs that Resolution No. D -41 denying the recommendation of the Planning Commission for the rezoning of certain property in the vicinity of South 36th Avenue and Tieton Drive from R -1 Residential to B -2 Local Business, be passed as read. Mrs. Card and Dr. A. J. Meyers, owners of property to be rezoned and their counsel, Attorney Richard Smith and Kenneth Hawkins respectively and Mr. Higgins, representative for the Albertson Company, being present, had nothing further to add to their appeal for the rezoning. Each Councilman gave his reason for approving or disapproving the recommendation of the Planning Commission, the majority wishing to deny the recommendation because they believed that is is not in accord with good planning nor in accord with the Comprehensive Plan as adopted by the City of Yakima, that the majority of property owners in the vicinity do not favor the change, that the needs of the city and co mnunity do not require such change, that the highest and best use is for residential purposes, and that 10 acres is too large an area for this purpose. Mayor Bostic being for the rezoning of this property stated that he was thinking in terms of a regional shopping center in keeping with the Comprehensive Plan and that he believed that this is the highest and best use for this property, that other shopping centers in the area are now wishing that they had more space and that he did not believe 10 acres is too large for the type of.center being planned. He also stated that these people had purchased this property for this purpose and had secured a building permit from the County before being annexed to the City of Yakima which would indicate that there should be closer relationship between the City and County Planning Boards. He also emphasised the- „fact that he believed that a shopping center would go into this area and that it would be better to have it inside the city where it could be supervised and controlled and the City would benefit from the taxes and license: After the discussion was completed by the Council, it was again MOVED.by Robinson, seconded by Coombs that Resolution No. D -41 denying the recommendation of the Planning Commission for the rezone of certain property in the vicinity of South 36th Avenue and Tieton Drive and requesting a further report lof the Planning Commission within 40 calendar days of the receipt of 1a:, copy of this resolution, be passed as read: carried, Barber, Burns, Coombs, Larson, Ol ^iver and Ro binson• voting aye on roll call. Bostic voting nay. There being no further business to come before the Council, Mayor Bostic declared the meeting adjourne at the hour of 4:10 P.M- ATTEST4 M A Y O R t/ZL of the COUNCIL 56'7 x568 OCTOBER i5, 1959 In accordance with the Laws of the State of Washington, the City Council met on this date to consider the budget for 1960, Mayor. Bostic, Councilman Barber, Burns, Coombs, Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson, present on roll call. Mayor Bostic read a letter from the Chamber of Commerce complimenting the City Manager and the Council on the sound and comprehensive budget as submitted to them. There being no protests in writing or otherwise against the budget as prepared an: :It filed with the City Clerk, it was MOVED by Burns, seconded by Barber that Ordinance No. 34 adopting a budget for the City of Yakima, Washington for the year of 1960, appropriating funds for the estimated expenditures and fixing and levying the amount of taxes necessary to balance the estimated revenue with the estimated expenditures, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver, Robinson and Bostic voting aye on roll call. ORDINANCE NO. 34, AN ORDINANCE adopting a budget for the City of Yakima,_,Washington for the year of 1960, appropriating funds for the estimated expenditures, and fixing and levying the amount of taxes necessary to balance the estimated revenue with the estimated revenue with the estimated expenditures.
