The City Council met in regular session, Mayor Bostic, Councilmen, Barber, Burns, Coombs
Larson, Oliver and Robinson and City Manager Allison and City Attorney Arntson present
on roll call,
The invocation was given by Councilman Oliver.
The minutes of the regular meeting of September 2, 1959, were approved as read.
A petition, being petition No. 10, having been duly filed by A. E. Clift and others,
praying, for the annexation of certain property in Tract 48 of State Addition to City of
North Yakima No. 2 and Englewood Hill Addition, and the Planning Commission having
recommended that, as a prerequisite to approval of annexation, an additional right of
way of thirty ( 30) feet should be obtained to make Minnesota Avenue a full width street
and!0.the City Manager now reporting that the 30 foot easement has been obtained and the
easemEnt1..debd' is oir' ;file with the City Clerk, it was MOVED by Coombs, seconded by
Robinson that Ordinance No. 28, providing for said annexation, be passed as read:
carried, Barber, Burns, Coombs, Larson, Oliver, Robinson and Bostic voting aye on roll
call.
ORDINANCE N.O. 28, AN ORDINANCE providing for the annexation by the City of Yakima,
Washington of certain property contiguous to the City. of Yakima.
This being the time fixed by the Council for the hearing on the recommendation of the
Planning Commission to amend sections 700 and 800 of the zoning code, Ordinance No.
B -2095, being the sections setting forth the types of businesses classified as B -1,
Modified Business Zone and B -2 Local Business zone, and it being suggested that
pharmacies should to included in the B -1 Zone, Councilman Burns stated that there is a
very fine line between merchandising and services and that it would be impossible to
control the operations of a drug store therefore he is not in favor of including
pharmacies in the B -1 zone. Manager Allison pointed out that the B -1 zone is- the buffer
zone between the residential zones and business zones. Upon completion of discussion,
it was MOVED by Robinson, seconded by Coombs that the Council concur'with the recommenda-
t,ion of the Planning Commission, accept that said amendment be made to include
Prescription Pharmacies and Prescription Opticians and that the City Attorney be and is
hereby instructed to prepare a resolution covering this recommendation in accordance
with Article 20, Amendments, of the zoning code: carried, Barber, Coombs, Larson,
Robinson and Bostic voting aye by voice vote. Burns voting nay. Oliver not voting.
Moved by Barber, seconded by Coombs that Ordinance No. 29 amending Ordinance No. 5 and
fixing the'time for the meetings of the City Council-at the hour of three otclock P.M.,
be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver, Robinson and Bostic,
voting aye on roll call..
ORDINANCE NO. 29, AN ORDINANCE amending'Section 1 of Ordinance No. 5 and fixing the
times for meetings of the City Council, and declaring an emergency.
Moved by Larson, seconded by Barber that Ordinance No. 30, providing for the transfer
of certain funds in the 1959 Budget -for the Current Expense Fund,,Municipal Garbage
Fund and Water Sewer Fund, be passed as read: carried, Barber, Burns, Coombs, Larson,
Oliver, Robinson and Bostic voting aye on roll call.
ORDIII .'?ANCE -N0. 30, AN ORDINANCE providing for the transfer of funds within the 1959
appropriations for Ol- Administrative, 04 - Finance Department, 40 - Municipal Garbage
Department and 55 - Water -Sewer and declaring an emergency.
Moved by Oliver, seconded by Barber that Resolution No. D -32 providing for the transfer
of certain funds within the Street Department and Current Expense Fund, 1959 Budgets,
be passed as read: carried, Barbber, 'urns, Coombs, Larson, Oliver, Robinson and Bostic
voting aye by voice vote.
.RESOLUTION NO. D-32, A RESOLUTION providing for the transfer of funds within the 1959
appropriation for Ol- Administrative and 45 - Street Department.
WHEREAS, surplusses exist in several of the'accounts of the 1959
appropriation for Ol- Administrative and 45 - Street Department, and
WHEREAS, it is necessary that funds be transferred from said
accounts to other accounts within said'departments because of shortages that exist and
could not have been contemplated at the time of the adoption of the 1959 Budget, and
WHEREAS, the City Council deems it in the best interest of the
City of Yakima to make the transfers provided for herein, and the action contemplated is
authorized by R. C. W. 35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY C "OUNCIL OF THE CITY OF YAKIMA:
Section 1. That the following sums are hereby transferred be-
tween the accounts hereinafter set forth, each within the 1959 appropriations for the
respective :departments.

Petitions, being No. 13 and 14, having been duly filed by- the Holliday Motels Inc.,
asking for the construction of domestic Water System and Sewers by the formation of
local improvement districts, it was MOVED by Coombs, seconded by Robinson that Resolution
No. D -33, providing for said improvements to certain property in Central Addition and
fixing the date of hearing at the hour of 3 o'clock P.M. or Wednesday the 30th day of
September, 1959, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver,
Robinson and Bostic voting aye by voice vote.
RESOLUTION NO. D -33, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That it is its intention to improve the following described
property by constructing the necessary mains, fire hydrants, valves, and other appurten-
andces for the purpose of supplying water for domestic use and fire pro.tectio n, and by
constructing pipe sewers with the necessary wye branches, manholes, and flush ends, all
of said improvement to be constructed in full accordance with the plans and specificatio s
to be prepared by the office of City Engineer and filed with the City Clerk.
The district to be served by and specially benefited by and assess-
ed for the above described improvement for domestic water is situate in the City of Yakin
Yakima County, Washington, and described as follows:
Lots 1 to 10, Block 5, Central Addition.
South 441.5 feet of SW', NE4, NE4, of Section 13
Township 13 North, Range 18 E.W.M.
The district to be served by and specially benefited by and assess-
ed for the above described improvements for sanitary sewer is situate in the City of
Yakima, Yakima County, Washington, and described as follows:
Lots 8 to 14, Block 4, Central Addition
Lots 1 to 10, Block 5, Central Addition
North 416.5 feet of South 441.5 feet of SW47 NE4, NE4, Section
13, Township 13 N., Mange 18, E.W.M. Exc..the South 150 .feet
of West 230 feet of the. East 260 feet.
All persons who -may desire to be heard with reference to said pro-
posed improvements are hereby notified to appear and present objections, if any, at a
meeting of the City Council to be. held at its office in the City of Yakima, Yakima
County, Washington, at the hour of 3 :00 o'clock P.M. on Wednesday, the 30th day of
September, 1959, which time and place are hereby fixed for the hearing of all matters
relating to said proposed improvement or objections thereto; and for determining the
method of payment for said improvement, and the City Clerk is hereby directed to give
notice of said hearing and of the intention to make the aforesaid improvement.
A portion of the costs and expenses of said improvement including,
engineering, inspection, advertising, publication of notices, if any, and all other
expenses incident thereto, shall.be levied and assessed against all of the property
legally and properly assessable therefor, as provided by law and as above described, and
the balance of the said costs and expenses shall be borne by the City Water Department
in accordance with Resolution C -1051.
The City Engineer is hereby directed to submit to the City Council
all of the data and any other information required by law to be by him submitted.
The assessments s -,all be made according to special benefits de-
rived from the improvement without regard to the zone and termini method.

A petition, being petition No. 12, having been duly filed by the Holiday Motels Inc:.,
asking for the paying of the Alley West from North lst Street-325 feet South of and
parallel to Oak Street by the formation of a local improvement district, it was MOVED
by Larson, seconded by Oliver that Resolution No. D -34 providing for said improvement
and fixing: the time of hearing at the hour of 3 o'clock P.M. on Wednesday, the 30th
day of September., 1959, be passed as read: carried, Barber, Burns, Coombs, Larson,
Oliver, Robinson and Bostic voting aye by voice vote.
RESOLUTION NO. D -34, BE IT RESOLVED BY THE CITY COUNCIL OF TEE CITY OF YAKIMA:
Than it is its intention to improve the following alley by
grading, ballasting, surfacing with asphaltic concrete.
Alley West from North lst Street 325 feet
South of and parallel to Oak Street.
Said proposed district is to embrace all property adjacent to the
above improvements which is subject to assessment for the coot of said improvements as
provided by the laws of the State of Washing ton.
All persons who may desire to be heard with reference to said pro-
posed irrlprovements are hereby notified to appear at a meeting of the City Council to be
held at its office in the City Hall in the City of Yakima, Yakima County, Washington at
the hour of 3 o'clock P.M. on Wednesday the 30th day of September, 1959, which time and
place are hereby fixed for the hearing of all matters relating to said improvements,

and for determining the method of payment for said improvements; and the City Clerk is
hereby directed to give due notice of said hearing and of the intention to make the
aforesaid improvements.

said improvements, including the engineering_, inspection, advertising, publication of
notices, and all other expenses incident thereto, shall be levied and assessed against
all of the property legally and properly 'assessable therefor as provided by the laws

Council at or prior to the date fixed herein all of the data and any other information
required by law to be by him submitted; all of said improvements to be constructed in

and filed with the City Clerk.

City Clerk to execute.a Supplemental Lease Agreement with the West Coast Airlines, Inc.,
leasing the garage area in the West Administration Building at the Yakima Municipal
Airport be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver, Fbbinson

RESOLUTION NO. D -35, A RESOLUTION authorizing the'Mayor and City Clerk to execute a
Supplemental Lease Agreement with-West Coast Airlines, Inc.
WHEREAS, Wrest Coast Airlines, Inc., a Washington corporation,
presently has under . lease frown the City of Yakima certain are.a in the Administration
Building at the Yakima Municipal Airport and desires to rent additional space in said
Administration Building, and
WHEREAS, it is deemed in the best interest of the City of Yakima
to enter into a Supplemental Agreement with said West Coast Airlines, Inc., how,
therefore.,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the.Mayor and City Clerk are hereby authorized and directed
to enter into a Supplemental Lease Agreement with West Coast A- rlines, Inc., leasing
the garage area in the West end of the Administration Building at the Yakima Municipal
Airport to said West Coast Airlines, Inc., for a period ending April 17, 1960 for the
sum of $43.90 per month, and that a copy of said Supplemental Lease Agreement is hereto
attached and by this reference made a part hereof.

asking for the improvement of the South Side of Stewart Street from Hanratty Drive to
Cornell Avenue by the construction of curbs and gutters, it was MOVED by Larson,
seconded by Coombs that said petition be referred to the City Manager: carried, Barber
Burns, Coombs, Larson, Oliver, Robinson and Bostic voting aye by voice vote
There being no further business to come before the Council, Mayor Bostic declared the
meeting adjourned at the hour of 5:30 P.M.
