AUGUST 12, 1959
The City Council met in regular session, Assistant Mayor Robinson presiding, Councilmen
Barber, Coombs, Larson and City Attorney Arntson present on roll call. Bostic, Burns
and Oliver - absent.
Councilman Barber gave the. invocation.
The minutes of the regular meeting of August 5, 1959 were approved as corrected.
This being the time for the continuation of the hearing on Resolution No. D -15 being a
resolution of intention to improve certain streets by surfacing and the construction of
Curbs and gutters, Lincoln Shropshire, Attorney, appearing on behalf of Attorney�V.--O-..
Nichoson, filed action in the form of protest and objection to this hearing on behalf
of Mrs. L. C. Rogers, a property owner in the district to be improved. Attorney .
Schropshire explained that, through some error in the records of Mrs. Robers property,
notice of hearing did not reach her until after August 5., 1959, the beginning date of
this hearing and that ahe.was.not.necessarily protesting the project, but wished to .
,have time to .correct the records and give this matter due consideration,. After. hearing
one protest to the improvement of Swan Tracts and comments of other persons present,
it was MOVED by Coombs, seconded by Barber that this hearing be continued on item 5 of
Resolution No. D -15 or the improvement of North 37th Avenue from Linsoln Avenue to a
point 486 feet more or less South thereof, and that the hearing on items 1 through 4
of this. Resolution be closed: carried, Robinson,. Barber, Coombs and Larson-voting aye
by voice vote. Bostic Burns and Oliver absent.
This being the time for the hearing on the-Assessment Roll of L.I.D. No. 863, being the
Lincoln Heights Domestic Water District, and City Attorney Arntson explaining that a
legal problem has arisen in this.local improvement district and asking that the Council
continue this' hearing for one week, it was MOVED by Barber, seconded by Coombs that the
hearing on the assessment roll for L.I.D. No. 863 be _continued until'the next regular
meeting of the Council on August 19, 1959: carried, Robinson, Barber, Coombs and Larsol
voting aye by voice vote: Bostic, Burns and Oliver absent.
The Clerk of t_he Council having read a letter from the City Planning Commission directed
to the City Council, recommending that Sections 700 and 800 of the Zoning Code, or
Ordinance No. B -2095, be amended as fully set forth in said letter, it was MOVED by
Coombs, seconded by Larson that the City Attorney report on the proceedures of the

Moved by Barber, seconded by Larson that Resolution No. D -26 providing for the transfer
of $539.69 said transfer being necessary due to the appointment of a Water Superinten-
dent and -the appointment of John Mayo:lto the combined position of Public Works
Supervisor and City Engireer, be passed as read: carried, Robinson, Barber, Coombs
and Larson voting aye by voice vote: Bostic, Burns and Oliver absent.
RESOLUTION NO. D -261 A RESOLUTION providing for the transfer of 9539.69 within the
1959 appropriation for the Street Department.
WHEREAS, because of the appointment of,a Water Superintendent in
the Water Department and the appointment of John Mayo to the combined position of
Public Works Supervisor for the Street Department and City Engineer, all effective
August 1, 1959, and the resignation of Sam Hobbs as City Engineer effective August 25,
there is insufficient money in said administrative positions to pay the salaries of said
three individuals, and
WHEREAS, a surplus exists in Account 7 -01 Salaries, Sub -item
Hourly Labor, all within the 1959 appropriation for 45- Street Department, and
WHEREAS, the City Council deems it in the best interest of the
City of Yakima to make the transfer in the sum of 9539.69 from said account to Account
7- 01.Salaries, Sub -item Public Works Supervisor, all within -the same classification and
an emergency exists requiring such transfer and the action contemplated is authorized
by R.C.W. 35. 33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the sum of 9539.69 is hereby transferred from
Sub -item Hourly Labor to Sub -item Public Works Supervisor, all within Account 7 -01,
Salaries, of the 1959 appropriation for 45- Street Department.
Section 2. The Director of Finance is hereby authorized and
directed to make the aforesaid transfer.
ADOPTED BY THE CITY COUNCIL, signed and approved this 12th day
of August, 1959.

There being no further business to come before the Council, Assistant Mayor Robinson
declared the meeting adjourned at the hour of 4 :40.
