The City Council met in regular session, Mayor Bostic, Councilmen.Barber., Burns, Coombs,
Larson and Robinson, City Manager Allison, 'ndyCity.Attorney Arntson present on roll
call. Councilman Oliver absent.
Invocation was given by Councilman Coombs.
The minutes of the regular meeting of July 22, 1959 were approved as read.
This being the time for the hearing on Petition No. 4, praying for the annexation of
certain property, being a 32.acre tract located between 34th Avenue and 40th Avenue and
Englewood and Lincoln Avenue and a petition having, °been filed, oh,_�_this date, praying for
the exclusion of that area bounded on the West by the West boundary line of 35th Avenue
extended; on the South by the present city limits; on the East by the East boundary of
Frankland Avenue extended and on the North by the South boundary line of Englewood
Avenue, and withdrawing certain names from the original petition, it was MOVED by Barber
seconded by Larson that Ordinance No. 18' providing for the annexation of the lesser
tract, fully described in said ordinance, be passed as read: carried, Bostic, Barber,
Burns, Coombs and Larson voting aye on roll call. Robinson not voting. Oliver absent.
ORDINANCE NO. 18, AN ORDINANCE providing for the annexation by the City of Yakima,
Washington of certain property contiguous to the City of Yakima.
The City Planning Commission recommending that the property annexed to the City of
Yakima by Ordinance No. 18 on Lincoln Avenue between Frankland Avenue and Crescent Drive
be zoned as follows; Lot 1, Kern Addition, R -3 Mlutiple Family Residential and the re-
mainder of the area R -1 Single Family Residential, it was MOVED by Coombs, seconded by
Burns that Ordinance No. 19 classifying the zone of this area in accordance with the
Planning Commissions recommendation be passed as read: carried, Bostic, Barber, Burns,
Coombs and Larson voting aye. on roll call. Robinson not voting. Oliver absent.
ORDINANCE NO. 19, AN ORDINANCE classifying the zone of a certain area annexed to the
City of Yakima under- Ordinance No. 18 and declaring an emergency.
A petition, being Petition No. 5, having been duly filed by A. R. Kern and others on
July 2, 1959, petitioning for a local improvement district for the construction of a
domestic water system in Kern +s Addition as annexed by Ordinance No. 18, it was MOVED
by Burns, seconded by Larson that Resolution No. D -19 providing for said improvement
and fixing the time of hearing on said matter at the hour of 4 o'clock P.M. on Wednesday
the 19th day of August, 1959, be passed as corrected, the correction being made in the
description of the property to be improved: carried, Bostic, Barber, Burns, Coombs and
Larson voting aye by voice vote. Robinson not.:voting. Oliver absent.
RESOLUTION NO. D -19, BE IT RESOLVED BY.THE CITY COUNCIL OF THE CITY OF YAKIMA:
That it is its intention to improve the following described proper
by constructing the necessary mains, fire hydrants, valves, and other appurtenances for
the purpose of supplying water for domestic use and fire protection; all of said improve-
ment to be constructed in full accordance with the plans and specifications to be pre-
pared by the office of the City Engineer and filed with the City Clerk.
The district to be served by and specially benefited by and asses-
sed for the above described improvements is situate in the City of Yakima, Yakima County,
Washington, and described as follows:
Beginning at the intersection of the centerline of.Lincoln
Avenue and Grandview Avenue; thence West to the centerline
of 40th Avenue North; thence North to the North line of
Kern Addition, thence Easterly along the North line of Kern
Addition to the NE corner of Lot 10; thence Northerly along
West line of Lot 1 to the NW corner of Lot 1, Kern Addition;
thence East along the North line of Lot 1, Kern Addition to
the centerline of 35th Avenue North; thence South to the
North line of Block 2 Flagg Addition. thence East to the
Centerlire of Grandview Avenue; thence South to the point
of beginning.
All persons who may desire to be heard with reference to said pro-
posed improvement are hereby notified to appear and present objections, if any, at a
- meeting of the City Council to be held at.its office in the City Hall in the City of
Yakima, Yakima County, Washington, at the hour of 4 o'clock P.M. on Wednesday, the 19th
day of August, 1959, w rich time and place are hereby fixed for the hearing of all matters
relating to said proposed improvement or objections thereto; and for determining the
method of payment for said improvement, and the City Clerk is hereby directed to give
notice of said hearing and of the intention to make the aforesaid improvement.
A portion of the costs and expenses of said improvement including
engineering, inspection, advertising, publication of notices, if any, and all other ex-
penses incident thereto, shall be levied and assessed against all of the property
legally and properly assessable therefor, as provided by law and as above described,
and the balance of the said costs and expenses shall be borne by the City Water Depart-
ment in accordance with Resolution No. C -1051.
The City Engineer is hereby directed to submit to the City Council
all of the data and any other information required by law to be by him submitted.
The assessments shall be made according to special benefits de-
rived from the improvement without regard to the zone termini method.

RESOLUTION NO. D -20, 'BE IT RESOLVED BY THE CITY COUNCIL OF 'THE CITY OF YAKIMA:
- That it is its int.ention to improve the property within the
following described district by constructing a pipe sewer with the necessary wye branch-
es and manholes; all of said improvement to be constructed in full accordance with the
plans and specifications to be prepared by the office of the City Engineer and filed
with the City Clerk.
The district to be served by and specially benefited by and asses
ed for the above- 'described improvement is situate in the City of Yakima, Yakima County,
Washington, and described as follows:
Lots 1 to 32 inclusive of Kern Addition
All persons who may desire to object to said proposed improvement
are hereby notified to appear and present such objection, if any, at a meeting of the
City Council to be held at its office in the City Hall in the City of Yakima, Yakima
County, Washington, at.the hour of 4 o'clock P.M. on Wednesday, the 19th day of August,
1959, which time and place are hereby fixed for the hearing of all matters relating to
said proposed improvement or objections thereto, and for determining the method'of pay-
ment for said improvement; and the City Clerk is hereby directed to give due notice of
said hearing and of the intention to make the aforesaid improvements.
All costs and expenses in connection with the construction of
said improvement, including the engineering, inspection, advertising, publication of
notices, and all other expenses incident thereto, shall be levied and assessed against
the above. described property.

RESOLUTION NO. D=21, BE IT RESOLVED BY TT-E CITY COUNCIL OF THE CITY OF YAKIMA:
That it is its intention to improve the following streets by
grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs
and gutters, together with necessary drainage features:
1. Richey Road from Crescent Drive to North 36th Avenue.
2. North 37th Avenue from Lincoln Avenue to Richey Road.
3. North 36th Avenue from Lincoln Avenue to Richey Road.
That it is also its intention to improve the following street by
grading, ballasting, surfacing with asphaltic concrete, .constructi.ng concrete curb and
gutter, and constructing concrete sidewalks.
1. Lincoln Avenue from North 35th Avenue to a point
230.feet, more or less West of North 40th Avenue.
Said proposed district is to embrace all property adjacent to the
above improvements which is subject to assessment for the cost of said improvements as
provided by the laws of the State of Washington.
All persons who may desire to be heard with reference to said
proposed improvements are hereby notified to appear at a meeting of the City Council to
be held at its office in the City Council to be held at its office in the City Hall in
the City of Yakima, Yakima County, Washington at the hour of 4 o'clock P.M. on Wednesday
the 19th day of August, 1959, which time and place are hereby fixed for the hearing of
all matters relating to said improvements, and for determining the method of payment
for said improvements; and the City Clerk is hereby directed to give due notice of said
hearing and of the intention to make the aforesaid improvements.
All costs and expenses in-connection with the construction of
said improvements, including the engineering, inspection, advertising, publication of
notices, and all other expenses incident thereto, shall be levied and assessed against
all of the property legally and properly assessable therefor as provided by the laws
and as above described. Except -that on Lincoln Avenuei, the City shall bear the cost of
two foot width of the sidewalks and shall bear the.cost of the paving in excess of a
standard 32 foot residential street. The City Engineer is hereby directed to submit to
the City Council at or prior to the date fixed herein all- of the data and other informa-
tion required by law to be by him submitted; all of said improvements to be constructed
in full accordance with the plans and specifications to be prepared by the City Engineer
and filed with the City Clerk.

for property and services at the Tahoma Cemetery, be passed as read: carried, Bostic,
Barber, Burns, Coombs., Larson and Robinson voting aye by voice vote. Oliver absent.
RESOLUTION NO. D -22, A RESOLUTION establishing the sale price of cemetery lots and
rates and charges for services performed and materials furnished at Tahoma Cemetery.
WHEREAS, the City of Yakima in Resolution Nos C -769, C -1135,
C -1312, C -1420 and C -1474 established certain rates and charges in connection with.the
sale of cemetery lots, material furnished and services performed at the Tahoma Cemetery,
and
WHEREAS, it is necessary in the best interests of the City of
Yakima to revise and amend the same, now, therefore,

Section 1. That as of the effective date of this resolution,

Section 2. Whenever a Disabled American Veteran is buried who
is certified by the Disabled Veterans of America or such local committee as said
Organization may designate to be without sufficient funds, then the charge shall be
$60.00 for opening, closing, preparing the lot and furnishing a liner, to which said
liner charge shall be added the Washington State sales tax.

of $2,900.00 in the Current Expense 1959 Budget for the purpose of purchasing a Grapho-

RESOLUTION NO. D -23, A RESOLUTION.providing for the transfer of 02,900.00 within the
1959 apnropriatio n for the Finance Department.
WHEREAS, the Graphotype Machine in the Finance Department.is
obsolete and it is necessary for the proper functinning of said department that a new
such machine be purchased and that the need for the same could not have been contemplated

at the time of the adoption of the 1959 budget, and
WHEREAS, a surplus exists in Account 6 -39, Special Equipment of
the Capital or Betterment Accounts classification for the 1959 appropriation for the
Finance Department, and
WHEREAS, the City Council deems it in the best interests of the
people of the City of Yakima to make a transfer from said account to Account 6 -51,
Office Machines within the same classification, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the sum of $2,900.00 is hereby transferred from
Account 6 -39, Special Equipment, to Account 6 -51, Office Machines, all within the Capital
or Betterment Accounts classification of the 1959 appropriation for 04- Finance Department
Section 2. The Director of Finance of the City of Yalfima is hereby
authorized and directed to make the aforesaid transfer.

A petition being Petition No. 8, having been duly filed by Fred Brooks, Jr., and others,
petitioning for a local improvement district to surface and construct curbs and gutters
on North 15th Avenue from Fruitvale to Swan Avenue, it was MOVED by Coombs, seconded by
Robinson that said petition be referred to the City Manager for further action carried,
Bostic Barber, Burns, Coombs, Larson and Robinson voting aye by voice vote. Oliver abse7
A petition, being Petition No. 9, having been duly filed by W. M. Rafferty and others,
petitioning for paving of -the Alley in Block 267 in the Syndicate Subdivision, it was
MOVED by Farber, seconded by Larson that said petition be referred to the City Manager
for further action: carried Bostic, Barber, Burns, Coombs, Larson and Robinson voting
aye by voice vote. Oliver absent.
John Bourn, operator of the Avis Rent -a -Car Agency, being present, requested permission
to establish his agency at the Yakima Municipal Airport and after reviewing his ex-
pierence with the former City .Commission and the City Manager recommending that this
matter be set aside until October of this year, at which time the Western -Way Agency
Agreement expires, it was MOVED by Robinson, seconded by Coombs that this matter be set
aside until October and the City Manager notify Mr. Bourn at that time in order that
negotiations may be continued: carried, Bostic Barber, Burns, Coombs, Larson and
Robinson voting aye by voice vote. Oliver absent.
Dr.. Weinberg,a,.memb.er of the Planning Commission, appearing before -the City Council on
July 15, 1959, requesting the City Council to take action to open up 40th Avenue from
Summitview Avenue to Ti ' eton Drive, and reporting that easement for said street will be
given in exchange for certain water and sewer connections and the City Manager now re-
porting on the costs of this project and the problems to be surmounted, it was MOVED
by Robinson, seconded by Coombs that Manager Allison proceed to obtain the right of way
for this street: carried, Bostic, Barber, Burns, Coombs, Larson and Robinson voting aye
by voice vote. Oliver absent.
The City Clerk having certified to the Council the election of Byron W. Yaden, Stephen
H. Huza and W. B. Mc Lain by the City Employees, from which one member is to be appoint-
ed to the Civil Service Commission in. accordance with the Charter Amendment granting
Civil Service to certain city employees other than Fire and Police,*it was MOVED by
Robinson, seconded by Larson that Byron W. Yadon be appointed to the Civil Service
Commission in accordance with the Charter Amendment: carried, Bostic, Barber, Burns,,
Coombs, Larson and Robinson voting aye by voice vote. Oliver absent.
A letter from Attorney Elwood Hutcheson directed to the City Manager, together with
copies of petitions signed by licensed pilots flying in and out of the Yakima Municipal
Airport, said petition directed to the General Safety Inspector of the Federal Aviation
Agency and petitioning said agency to take steps to abolish dangers resulting from de-
bris blowing on to the runways from the City Garbage Landfill, was read by Manager
Allison and discussed by the Council. The Council directed Manager Allison to obtain
a report from Burgess Carratt, Airport Manager, on this matter and to draft some rules
and regulations for the independent collectors dumping at this landfill.
Manager Allison reporting that there is no place for the Airport Crash Truck at the
old Administration Building, the Council directed him to prepare an agreement satisfacto
to the Civil Air Patrol for theirr:usage of this building, said agreement to be voted on
by the Council.
There being no further businss to come before the Coucil, Mayor Bostic declared the
meeting adjourned at 7:00 P.M.
