The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns,
Coombs, Larson, Oliver and Robinson, City Attorney Arntson and City Manager Allison
present on roll call.
The minutes of the regular meeting of June 24, 1959 were approved as corrected.
An ordinance providing for the appropriation of $1,000.00 in the Municipal Garbage
Fund for maintenance - equipment parts and repairs, having been read in its entirety
at the regular meeting on June 24, 1959, and laid on the table for one week and now
being read by title only, it was MOVED by Burns, seconded by Oliver that said ordinance
No. 10 providing for such appropriation, be passed as read: carried, Bostic, Barber,
Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call.
ORDINANCE NO. 10, AN ORDINANCE providing for the appropriation from the unappropriated
moneys in the Municipal Garbage Fund for credit to Account 7 -46, Maintenance-Equipment-
Parts & Repairs of the Maintenance and Operation classif ication.of the Murd--ipal Garbage
Budget, and declaring an emergency.
An ordinance providing for the appropriation of $90.00 in the Current Expense Fund
for the purpose of adjusting the pay of the Municipal Court Clerk due to a typograp-
hical error in the 1959 Budget, having been read in its entirety at the regular meeting
on June 24, 1959 and laid on the table for one week, and now being read by title only,
it was MOVED•by Larson, seconded by Barber that Ordinance No. 11 providing for said
appropriation be passed as read: carried, Bostic, Barber, Burns, Coombs, Larson,
Oliver and Robinson voting aye on roll call.
ORDINANCE NO. 11, AN ORDINANCE providing for the appropriation from the unappropriated
moneys in the Current Expense Fund for the purpose of adjusting the pay of the Municip-
al Court Clerk and declaring an emergency. .
This being the time for hearing on Resolution No. C -1698 providing for the improvement
of certain property by the construction of sidewalks and there having been many petit-
ions, duly filed, protesting said project and Don - Tunstall Attorney representing Garret
Anderson, Florence Hamburg and many other-s &n--d property owners both for and against
said project being.present and all persons having been heard, it was MOVED by Coombs,
seconded.by Barber that this hearing be continued to the regular meeting of July 15,
1959 and the protests be referred to the City Engineer for tabulation and recommend-
ation: carried, Bostic, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye
by voice vote.
This being the time for the hearing on Resolution No. C -1697 providing for the improve-
ment of certain property by the installation of concrete curbs and gutters and this
improvement being closely related to and being in some of the same area covered by the
Sidewalk improvement provided for in Resolution No. C -169$, it was MOVED by Robinson,
seconded by Oliver that this hearing be continued to the regular meeting of July 15,
1959 with the Sidewalk hearing: carried, Bostic, 'Barber, Burns, Coombs, Larson, Oliver
and Robinson voting aye by voice vote.
This being the time for the hearing on Resolution No. C -1704 providing for the improve-
ment of certain property by the construction of concrete curbs and gutters and concrete
sidewalks on the East side of Fifth Avenue from Walnut Street to Chestnut Street and
Mr. Elery Van Diest, attorney, representing certain property owners wanting the removal
of he �n�dian barrier located in this area and Mr. Carl Loy representing Mr. Rd1ph ,H.Irw' n,,
arbian` rUIP- $ Dairy Queen who is protesting the construction of the curb, gutter and
sidewalks, and Mr. Marion Pierce, realtor testifying on the devaluation of property and
income due to the median barrier and some property owners being present and all being
heard both for and against said improvement and the removal of the median barrier, it
was MOVED by Robinson, seconded by Barber that the City Attorney be and is hereby
directed to prepare the necessary resolution directing the removal of the traffic divid-
er and the City Engineer be and is hereby directed to prepare plans and estimates
excluding sidewalks from X11 ": of the north two lots: carried, Bostic, Barber,
Burns, Coombs, Larson, Olivet and Robinson voting aye by voice vote.
This being the time for hearing on Resolution No. C -1700 providing for the impry vement
of certain property by construction of water mains and sewers in Harland Phipps' Addit-
ion and the South 164 feet of the Northwest Quarter, of the Northeast Quarter, of the
Northwest Quarter, of Section 22, Township 13,North, Range 18 E.W.M. EXCEPT R/W for
Streets and Mr. Walter Kohagen protesting the improvements because he would not receive
any benefits therefrom - Mr. Kohagen's property being an orchard and the income from
the orchard being greater than that of platted property, it was MOVED by Robinson,
seconded by Barber that this hearing be postponed one week to July 8, 1959, 4 P1M. for
further investigation: carried, Bostic, Barber, Burns, Coombs, Larson, Oliver and
Robinson voting aye by voice vote.
A letter from City Manager Allison to the Council regarding the appointment of three
council members to the City County Health Board as required by State law R.C.W. 70.46.
030. Moved by Robinson, seconded by Burns that Council members Coombs, Barber and
Oliver serve on the City County Health Board (the next meeting to be called July 10,
1959, 2 P.M.): carried, Bostic, Barber, Burns, Coombs, Larson, Oliver and Robinson
voting aye by voice vote.
The City Clerk certifying Byron W. Yaden, Stephen
three members selected by Employees' Referendum on
Coombs, seconded by Barber that the certificate be
under advisement: carried, Bostic, Barber, Burns,
voting aye by voice vote.

The Clerk of the Council read a letter of resignation from Walter J. Robinson,
resigning as a member of the Civil Service Commission of the Fire and Police Depart-
ments. It was moved by Barber, seconded by Oliver that the Council accept Mr..Robinson's
resignation with great regret: carried, Bostic, Barber, Burns, Coombs, Larson, Oliver
and Robinson voting aye by voice vote.

Moved by Robinson, seconded by Coombs that Charles R. Lyon, a local attorney, be appoint
ed to fill the unexpired term of Mr. Robinson on the Civil Service Commission from
July 1, 1959 to December 31, 1961: carried, Bostic, Barber, Burns, Coombs, Larson,
Oliver and Robinson voting aye by voice vote.

The City Attorney having been requested by the Council to prepare a Resolution before
the close of this meeting and said request having been complied with, the Clerk of the
Council read a Resolution directing the removal of the traffic divider on South 5th
Avenue between Walnut and Chestnut Streets and repealing Resolution No. C -1705. It was
moved by Robinson, seconded by Barber that said Resolution be passed as read: carried,
Bostic, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote.
RESOLUTION NO. D -11, A RESOLUTION directing the removal of the traffic divider
on South 5th Avenue between Walnut and Chestnut Streets
and repealing Resolution No. C -1705.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the traffic divider located in the center
of South 5th Avenue between Walnut and Chestnut Streets
shall be removed forthwith and-the City Manager is hereby
directed to procure such removal.
Section 2. That Resolution No. C -1705 of the City of
Yakima is hereby repealed.
ADOPTED BY THE CITY COUNCIL this 1st day of July,1959.

Moved by Coombs, seconded by Robinson that said estimates be accepted as read-: carried,
Bostic, Barber, Burns', Coombs, Larson, Oliver and Robinson voting aye by voice vote.
City Manager Allison read a letter from City Attorney Arntson outlining the present
ordinances and the findings were that the City does not have authority to control
weeds inside the City. The Council then authorized the writing of an ordinance to cover
the situation.
The City Council-also authorized City Manager Allison to make a study and get
bidsr ° re- codifying city ordinances.
There being no further business, the meeting was adjourned by the Mayor at the hour
of 7:40 P.M.
