HomeMy WebLinkAbout06/24/1959 Business Meeting526 JUNE 24; 1959 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs, Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson present on roll call. The minutes of the regular meeting of June'17, 1959 were approved as read. Invocation was given by Tom Bostic. This being the time scheduled for the .consideration of the matter of rezoning, from R -3 and R -1 Residential to B -1, Modified Business Zone, certain property in the vicinity of 31st Avenue and Tieton Drive, Councilman Oliver asked to be excused. Since Mr. Oliver owns property in the vicinity,.he was excused from this hearing. Carl Loy, Attorney for Dr. Herr and Kenneth Hawkins, Attorney for the New Valley Osteopathic Hospital and Dr. Marion Herr, who are seeking the rezoning of this property, were present. Fred Palmer and J. S. Applegate Attorneys for the property owners opposing the rezoning and property owners both for and against this matter were present. All persons having been heard, both for and against said rezoning, it was MOVED by Larson, seconded by Coombs that Resolution No. D -7 denying the recommendation of the Planning Commission for the rezon- ing of specific property in the vicinity of South 31st Avenue and Tieton Drive, and re- questing a further report of the Planning Commission with;440 calendar days, be passed as read: carried, Bostic, Coombs, Larson and Robinson voting aye on roll call. Barber and Burns voting Nay. Oliver not voting. RESOLUTION NO. D -71 A RESOLUTION denying the recommendation of the Planning Commission for the rezoning of specific property in the vicinity of South 31st Avenue and Tieton Drive in the City of Yakima, Washington, and requesting a further report of the Planning Commission within 40 calendar days. WHEREAS, on June 24, 1959, at a regularly scheduled meeting of the City Council, a hearing was had upon the recommendation of the Planning Commission that certain specified property in the City of Yakima, to -wit: Lots 13 and 14, Neilan's Memorial Heights; and the North 250 feet of the 'South 280 feet.of the West half of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 23, Township 13 North, Range 18, E.W.M., EXCEPT the West 186.44 feet and EXCEPT the East 25 feet for street be rezoned from R -3 and R -1 Residential respectively, to B -1, Modified Business Zone, and WHEREAS, the City Council finds that such rezoning would have the effect of depreciating residential property values in the adjacent area; that the major- ity of property owners in the immediate vicinity do not favor the "change in classifica- tion; and that the highest and best use of said parcels is for residential purposes, and WHEREAS, public necessity and convenience and general welfare do not require such rezoning, and that the said recommendation of the Planning Commission should be denied, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The recommendation of the Planning�Commission of the City of Yakima that the following described real property situate in the City of Yakima in the vicinity of South 31st Avenue and Tieton Drive and more particularly described as follows, to -wit: Lots 13 and 14, Neilants Memorial Heights; and the North 250 feet of the South 280 feet of the West half of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 23, Township 13 North, Range 18, E.W.M., EXCEPT the West 186.44 feet and EXCEPT the East 25 feet for Street be rezoned from R -3 and R -1 Residential respectively, to B -1, Modified Business Zone, be and the same is hereby denied subject to such condition as hereinafter set forth. Section 2. The Planning Commission of the City of Yal�ima is here- by requested-to make a further report with respect to said rezoning and the Clerk of the Council is directed to deliver a copy of this Resolution to said Planning Commission forthwith. Section 3. In the event that the said Planning Commission fails to act within 40 calendar days of receipt of a copy of this Resolution, then the Action of the City Council in denying said recommendation of the Planning Commission shall automat- ically become final. Miller praying for the vacation of an 8 foot strip of Spruce Street, on June 17, 1959, and said hearing having been continued until this date, and the matter of vacating this strip having been referred to the City Manager for investigation`and recommendation, and the Manager now recommending against this action, it was MOVED by Barber, seconded by Burns that the City Council accept City Manager Allison's recommendations and reject the ordinance-vacating this portion of Spruce Street: carried, Bostic, Barber, Burns, Coombs, Larson,Oliver and Robinson voting aye by voice vote. 1 1 1 1 fl I� 1 I JUNE 24+, 1959 An ordinance providing for the appropriation of $90.00 in the Current Expense Fund for the purpose of adjusting the pay of the Municipal Court Clerk was read in its entirety by the Clerk of the Council and ordered laid on the table for one week. Moved by Coombs, seconded by Barber that Resolution No. D -8 permitting E. J. Allison, City Manager of the City of Yakima to become a member of the Statewide City Employees Retirement System commencing as of June 1, 1959 or the date of his employment, be passes as read: carried, Bostic, Barber, Burns, Coombs, Oliver, Larson and Robinson voting aye by voice vote. RESOLUTION NO. D -8, WHEREAS, E. J. Alison was appointed City Manager of the City of Yakima on June 1, 1959, and earning more than $50.00 per month as a full time employee of the City of Yakima, and WHEREAS, the said E. J. Allison has elected in writing to become a member of the Statewide City Employees Retirement System commencing as of the date of his employment, and the City Council finds that it is in the best interests of the City of Yakima to approve -the same, now, therefore, 'BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City of Yakima hereby consents and agrees that E. J. Allison,.City Manager of said city, shall be covered under the Statewide City Employees Retirement System commencing as of June 1, 1959, the date of his employment by said citN pursuant to the existing agreement between said City and the Statewide City Employees Retirement System. Clay, Purchasing Agent for the City of Yakima,to become a member of the Statewide City Emplyee Retirement System commencing as of the date of his employment of June 22, 1959 and re- cording his former employment with the Washington Department of Highways and the State Employees Retirement System with said Statewide Retirement System, be passed as read: carried, Bostic, Barber, Burns, Coombs; Oliver, Larson and Robinson voting aye by voice vote. RESOLUTION NO. D -91 WHEREAS, Jack M. Clay was formerly-employed by the Washington Department of Highways and was under the State Employees Retirement System, and he recently left said employment and became employed by the City of Yakima as purchasing Agent for the City of Yakima, and he desires immediately to come under the Statewide City Employees Retirement System, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City of Yakima hereby consents and agrees that said Jack . Clay, as an employee of said city, shall be covered under the Statewise City Employee: Retirement System commencing as of the date of his employment by said city, pursuant to' the existing agreement between said City and the Statewide City Employees Retirement System. Taylor, an employee of the Parking Meter Department, will reach the extended retirement age of 68 by August 1, 1959, and the City Manager recommending the extention of Mr. Taylors employment, it was MOVED by Burns, seconded by Barber that Resolution No. D -10 extending the employment of Floyd W. Taylor for one year, be passed as read: carried, Bostic, Barber, Burns, Coombs, Oliver, Larson and Robinson voting aye by voice vote. RESOLUTION NO. D -10, WHEREAS, Floyd W. Taylor is an employee of the City of Yakima and under the Statewide City Employees Retirement System, and, WHEREAS, the said Floyd W. Taylor will reach the extended retire- ment age of 68 .on August 1, 1959, and WHEREAS, the date of retirement may be extended on year beyond said date, and WHEREAS, the said Floyd W. Taylor is satisfactorily performing his duties as a city employee and is in good physical condition and health, and it is deemed in the best interests of the City of Yakima to extend the retirement date of the said Floyd W. Taylor for one year, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the retirement date of Floyd W. Taylor, an'employee of the City of Yakima, is extended for the period of one year from August 1, 1959. ADOPTED BY THE CITY COUNSIL, signed and approved this 24th day of June, 1959. ATTEST: J. A. BOSTIC Clerk of the Council Mayor An ordinance providing for the appropriation of $1000.00 in the Municipal Garbage Fund for maintenance and equipment repairs and parts, was read in its entirety by the Clerk of the Council and ordered laid on the table for one week. 527 FP-- 28 JUNE 24, 1959 Moved by Robinson, seconded by Coombs that Ordinance No. 9 providing for the transfering of funds within the 1959 Current Expense Budget, said transfers being necessary to take care of the purchase of one dictating machine allowed the City Manager and tables for the City Council meeting room, be passed as read: carried, Bostic, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 91 AN ORDINANCE transferring funds within the Current Expense Ol- Adminis trative Fund of the 1959 Budget to provide the necessary funds for the operation of the new City Government under the Council- Manager plan and declaring an emergency. City Manager Allison reporting; that the Congdon Orchard lease of property „lying west and "south of the west end of runways #27 and #9 at the Yakima Municipal Airport has expired and that said Congdon Orchard, Inc., desires to renew this lease for another year, and recommending that the lease be offered to them for $150.00 per year instead of the $50.00 per year as in the old lease, it was MOVED by Larson, seconded by Coombs that the City'Manager's recommendation be accepted and that he be and is hereby directed to negotiate with said Congdon Orchard, Inc., on this basis: carried, Bostic, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice—Vote. City Manager Allison reported on the following items: 1. Arrangements have been made for a job classification of City Employees to be made by the Employment Securities Division of the State of Washington.. 2. That the streets and sewers of the City of Yakima need a thorough study and checking to bring up to standard. He suggested that Citizens groups study this matter and work with the City to build a well laid plan for the City's need. 3. That the West Coast Airlines who rent space in the Administration Building at the Yakima Municipal Airport have asked for more space. City Manager was asked to investigate and report further at a later date. The City Council asked City Manager Allison for information with regard to the leasing of the Sherwood Roberts Building and also asked that he prepare rules of proceedure for Council meetings. Sam Kinville, State Representative of Council No. 2 of the American Federation of State County and Municipal Employees, being present, introduced himself to the Council and stated that he was interested in establishing a line of communication for the City of Yakima Employees Local No. 1122. He was asked to present all employee problems to the City Manager. Newsman for the Yakima Daily Republic registered a complaint as to the latness of the Council meetings, stating that he is�,unable to give City business proper coverage. There being no further business to come before the Council, Mayor Bostic declared the meeting adjourned, at the hour of 6:40 P.M.
