MAY 27,: 1959
The City Commission met in.regular::session,.Mayor Alderson, Commissioners Wine and
Mathews and City Attorney Arntson, present on roll call.
The minutes of the regular meeting of May 20, 1959 and adjourned meeting thereof, were
approved as read:
This being the time for the hearing on Resolution No. C -1688, being a resolution of in-
tention to improve certain property by,the construction of a domestic water system, and
there being protests made by persons presenit, it was ordered that said protests be made
in writing and filed with the City Engineer and the City Engineer report his findings
to the City Commission.

B. Ingram offering $141.00 annually; for the lease of said property, it was MOVED by
Wine, seconded by Mathews that this bid be accepted and the City Attorney be and is
hereby directed to prepare the necessary resolution,and lease for said transaction:

of $100.00 within the Municipal Garbage Department 1959 Budget, be passed as read:

RESOLUTION NO. C -16959 A RESOLUTION providing for the transfer of funds within the
Maintenance and .Operation classification of the 1959 Budget for the Sanitation Department
WHEREAS, it is necessary in the operation of the Sanitation
Department to obtain certain office supplies, and
WHEREAS, there are not sufficient funds in the 1959 Budget
therefor, and
WHEREAS, the City Commission deems it in the best interest of
the City of Yakima to make the transfer herein, and the action contemplated .is author-
ized by R.C.W.35.120, now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY, OF YAKIMA:
Section 1. That the sum of $100.00 is hereby transferred from
Account 7 -31, Supplies, Publications and Printing to Account 7 -30, Supplies, Clerical
and Office, all within the Maintenance and Operation classification of the Sanitation
Department Budget for 1959, and the Chief pity Accountant is hereby authorized and
directed to make the aforementioned transfer herein provided.

RESOLUTION NO. C -1696, A RESOLUTION providing for the transfer of funds within the

WHEREAS, it is necessary in the operation of the Cemetery to
remove dead trees and stumps and to purchase and plant new trees, and,
therefor, and

/An ordinance providing for the appropriation of $1,000.00 in the Municipal Garbage Fund
for .equipment parts and repairs; was read in its entirety by the City Clerk and ordered
laid on the table for one week.
Moved by Wine,-seconded by Mathews that Ordinance No. B -2304 amending Section 1 of
Ordinance No. B -2291, which provides for the transfer of money and investments, now held
by the City of Yakima, in the Cumulative Reserve Fund for Yakima City Library Building
Fund, to the County Treasurer, said ordinance No. B -2304 authorizing the City Treasurer
and Chief City Accountant to convert all bonds or invested collateral in this fund into
cash to be turned over to the County Treasurer, be passed as read: carried, Alderson,
Wine and Mathews voting aye on -roll call.
ORDINANCE NO. B -23049 AN ORDINANCE amending Section 1 of Ordinance No. B -2291 and de-
claring an emergency.
A letter directed to the City Commission from the City Traffic Board was read by the
the City Clerk, reporting that this board had held a.special meeting at 2 p.m. on the
25th day of May, 1959 to study and make further recommendations regarding the median
barrier curb in the 100 block on South 5th Avenue and that they had studied plans of
curbs, sidewalks and..specific driveways which might be installed to minimize accidents
in this block without use of a barrier curb and found that any arrangement would still
invite illegal left turns at four different locations in the block and advising the
Commission that the Traffic Board agrees unanimously that the present median barrier
curb should remain. Business= people in this block being present were heard and Mr.
Elery Van Diest, attorney; for this group was also heard and all expressed the opinion
that their business had been cut from 25 to 50% and appealed to the City Commission to
consider some other means to take care of this traffic problem. Mayor Alderson indicated
that some other method of solving the problem should be tried. Commissioner Mathews
refused to make any - further decision on the matter since this Commission has only a few
more days in office. Commiss ioner Wine, due to previous.committment, asked to be ex-
cused from this meeting at this time, but made arrangements to meet with parties interest
ed in the median barrierat 1:30 p.m. on this same day.
Commissioner Wine excused and absent from the balance of this meeting.
The Superintendent of Public Works calling to the attention of the City Commission that
a portion of the area presently being used in the Sanitary Landfill operation at the
Municipal Airport is under an agricultural lease to Mr. Ross Davis and that this lease
was inadvertantly renewed last March, 1959 and recomaiending that said lease be cancelled
and the payment of $25.00 be refunded to avoid any possible legal difficulties that may
develop due-to the leasor being denied use of the area during the landfil operation, it
was MOVED by Mathews, seconded by Alderson that the City Attorney be and is hereby
directed to prepare the necessary legal documents to carry out these recommendations:

Moved by Mathews, seconded by Alderson that Resolution No. C -1697, being a resolution of
in.tention.to improve 32nd Avenue, Lincoln Avenue and Powerhouse Road by the installatinn
of concrete curbs and gutters and fixing the date of hearing of said improvement at the
hour of 4 p.m. on the lst day of July, 1959, be passed as read: carried, Alderson and
Mathews voting aye on roll call. Wine absent.
RESOLUTION NO. C -1697, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That it is its intention to improve the following streets by
the installation of concrete curbs and gutters, together with the necessary drainage
features.
1. East side of 32nd Avenue from Summitview Avenue to
Englewood Avenue;
2. Both sides of Lincoln Avenue from 32nd to 3.5th Avenue;
3. North side of Lincoln Avenue from a point 140 feet East
to 23rd Avenue to a point 305 feet East of 23rd Avenue;
4. North side of Powerhbuse'-Road from a point approximately
220 feet Northwest of 26th Avenue to Englewood - North
side only.
Said proposed district is to embrace all property adjacent to
the above improvements which is subject to assessment for the cost of said improvements
as provided by the laws of the State of Washington.
All persons who may desire to be heard with reference to said
proposed improvements are hereby notified to appear at a meeting of the City Council to
be held at its office in the City Hall in the City of Yakima, Yakima County, Washington
at the hour of 4 otclock P.M. on Wednesday the 1st day of July, 1959, which time and
place are hereby fixed for the hearing of all matters relating to said improvements,
and for determining the method of payment for said improvements; and the City Clerk is
hereby directed to give due notice of said hearing and of the intention to make the
aforesaid improvements.
All costs and expenses -in connection with the.constr-uction of
said improvements, including the engineering, inspection, advertising, publication of
notices, and all other expenses incident thereto, shall be levied and assessed against
all of the property legally and properly assessable therefor as provided by the laws
and as above described. The -City Engineer is hereby directed to submit to the City
Commission at or prior to the date fixed herein for said hearing, all of the data and
other information required by law to be by him submitted; all of said improvements to be
constructed in full accordance withtthe plans and specifications to be prepared by the
City Engineer and filed with the City Clerk.
The assessments shall be made according to special benefits de-
rived from the improvement without regard to the zone and termini method.

No. 1 to the Grant Agreement of Federal Aviation Agency on the Municipal Airport
Approach Lighting project and authorizing the Mayor and City Clerk to execute said

RESOLUTION NO. C -1699, A RESOLUTION approving acceptance of the Amendment No. 1 to the
Grant Agreement of Federal Aviation Agency, Project No. 9 -45 -023- 5906; Contract FA4 -17;
Yakima Municipal Airport.
WHEREAS, the City of Yakima has heretofore entered into an
agreement with the Federal Aviation Agency under Project No. 9 -45- 023 -5906, Contract
No. FA4 -17, and
WHEREAS, it is necessary to execute an amendment to said Grant
Agreement, to revise the describption by adding "lower utility line in southeast clear
zone of runway 9 -27" and to increase the maximum obligation from $18,765 to $192566,
now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That the City of Yakima hereby approves acceptance
of the following amendment, to -wit:
AMENDMENT NUMBER 1 to GRANT AGREEMENT

City of Yakima, Washington
Project No. 9 -45 -023 -5906
Contract No. FA4 -17
WHEREAS, the Administrator of the Federal Aviation Agency (hereinafter called the
"Administrator ") has determined'that in the interest of the United States the Grant
Agreement relating to the above numbered project between the United States and the City
of Yakima, Washington, (hereinafter called the "Sponsor ") accepted by the Sponsor on
February 4, 1959, should be amended as hereinafter provided;
NOW, THEREFORE, WITNESSETH:
That in consideration of the benefits to accrue to the parties hereto, the Administrator,
acting for and on behalf of the United States on the one part, and the .City of Yakima,
Washington, on the other part, do hereby mutually agree that said Brant Agreement be
and hereby is amended as follows:
1. By revising the scope and description of development as
set forth in the second WHEREAS paragraph Page 1 of said
Grant Agreement to provide for the lowering of a utility
line in the southeast clear zone of runway 9 -27, thereby
making said description read as follows:
"Land acquisition (Parcels 4A through 4G); lower utility
line in southeast clear zone of runway 9 -27
"(The airport development to be accomplished, herein
described, is in addition to that contemplated under the
Grant Agreements between the Sponsor and the United States
for Projects 9 -45- 023 -901, -902, -203, -504, and - 705.)"
2. By increasing the maximum obligation of the United States
9 ayable under said Grant Agreement from $18,765.00 to
19,566.00.
It is understood and agreed by and between the parties hereto that the terms "Administra-
tion of Civil Aeronautics ", " Administrator", "Civil Aeronautics Administration '', "Depart-
ment of Commerce ", "CAA", or "Section 303 of the Civil Aeronautics Act of 1938" where -
ever they appear in said Grant Agreement, in the Project Application, plans and specifi-
cations or in any other documents constituting a part of said Grant Agreement shall be
deemed to mean the Federal Aviation Agency or the Administrator thereof of Section 308
(a) of the Federal Aviation Act of 1958, as the case may be.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to said Grant Agree--
ment to be duly executed as of the day of , 1959.

by the City of Yakima in connection with the sales promotion event known

The City Engineer reporting 16.7% protest as a summary of the protests received to date
on Resolution No. C -1688, being a resolution of intention to improve certain property
by the construction of a domestic water system, it was MOVED by Mathews, seconded by
Wine that Ordinance No. B -2305 providing for said improvement and creating L.I.D. No.
872, be passed as read: carried, Alderson, Wine and i "lathews voting aye on roll call.
ORDINANCE NO. B -23051 AN ORDINANCE providing for the improvement of property int he
City of Yakima by the construction of necessary mains, fire hydrants, valves and other
appurtenances for the purpose of supplying water for domestic use and fire protection,
and the construction of'pipe sewers with the necessary wye branches, manholes, and flush
ends, establishing a Local Improvement District, providing for the method of payment
therefor, and creating a spectial fund.
An ordinance amending certain sections of Ordinance No. B -2136 relating to and regulati
the installation of sidesewers having been read in its entirety at the regular meeting
of the City Commission on May 20, 1959 and tabled at that time and now being brought
forth for consideration, it was MOVED by Mathews, seconded by Wine that said ordinance
again be tabled and brought before the new City Council at a later date: carried,
Alderson, Wine and Mathews voting aye on roll call.

Gentlemen:
The Investment Board met Thursday morning at 9:00 A.M., May 14, 1959,
pursuant to call by Mayor Joseph K. Alderson in regard to Ordinance No.
B -2291.
Ordinance No. B -2291 directed the transfer of the funds in the Cumulative
Reserve for Yakima City Library Building Fund to the County Treasurer, who
is the treasurer for the lal¢ima Valley Regional Library pursuant to R.C.W.
27.12.080, This Ordinance-No. B -2291 was passed by the City Commission at
its regular meeting Wednesday, May 13, 1959.
Due to the fact that the Yakima Valley Regional Library wants the money in
the city's Cumulative Reserve for City Library Building Fund to expend for
Capital outlay, it was moved by Finance Commissioner, E. Bernard Wine and
seconded by Mayor Joseph K. Alderson that the City Treasurer purchase
$55,000.00 worth of bonds held in the Cumulative Reserve for City Library
Building 'Fund with city funds as follows:
Firements Relief and/Pension 30,000.00
Cemetery Trust 15,000.00
Policemen's Relief and Pension 110,000.00

It was moved by Finance Commissioner E. Bernard Wine and seconded by Mayor
Joseph K. Alderson that the City Treasurer transfer by check the cash and
investments plus any earned interest pursuant to Ordinance No. B -2291 to'
Fred G. Redmon, County Treasurer, Treasurer of Yakima Valley Regional Library.
The motion carried.
Pursuant to the recommendation of State Examiner Warren Sinclair, it was
moved by Finance Commissioner E. Bernard Wine and seconded by Mayor Joseph K.
Alderson that the investments held in the Water Sewer Revenue "Bond Redemption,
"1956 ", Reserve Account be purchased by the L.I. Guaranty Fund and that the
available cash in the Water Sewer Revenue Bond Redemption, "1956 ", Reserve
Account be invested in 91 -day U.S. Treasury Discount Bills.
The motion carried.
The Investment Board met Wednesday afternoon at 3:00 P.M., May 27, 1959,
pursuant to call by Mayor Joseph K. Alderson in regard to. Ordinance No. B -2304.
Ordinance No. B -2304, amending Ordinance No. B -2291, was passed as Mr. Fred
G. Redmon, County Treasurer, Treasurer of the Yakima Valley Regional Library,
advised the City of Yakima that the Yakima Valley Regional Library plans to
spend the money and asked if the investments could be converted into cash.
Ordinance No. B -2304 was issued amending section 1 of Ordinance No. B -2291
authorizing the.City Treasurer to convert all bonds or invested collateral
within the Cumulative Reserve for Yakima City Library Building Fund into cash and
to transfer the money realized therefrom together with all'cash presently in
said Cumulative Reserve for Yakima City Library Building Fund to the Yakima

The City Treasurer has been advised'that $25,000.00 U.S. Treasury Discount
Bills held in safekeeping at Seattle -First National Bank for the Water Deposit
Fund will mature June 4, 1959, and $25,000.00 U.S. Treasury Discount Bills
held in s.afekeepirg at The National Bank of Commerce will mature June 4, 1959.
The local banks must be advised of the desire for renewal of purchase of U.S.
Treasury Discount Bills by Thursday, May 28, 1959.
It was moved by Finance Commissioner E. Bernard Wine and seconded by Mayor
Joseph K. Alderson that the investments in 91 -day U.S. Treasury Discount Bills
in the Water Deposit Fund maturing: June 4, 1959 be re- invested in new 91 -day
U. S. Treasury Discount Bills.
The City Treasurer was directed to re- invest:
(1) Invest $25,000.00 91 -day U.S. Treasury Discount Bills maturing June 4,
1959 at Seattle -First National Bank in new 91 -day U.S.Treasury Discount
Bills for the. Water Deposit Fund.

A resolution, authorizing the assignment of A'-les -se now,`,held by Dale Butler to Stanley
Rodom, said lease covering certain property at the Sewage Disposal plant,and the
agreement for said assignment, were read by the City Clerk. Commissioner Wine challenged
the validity of these documents as the lease held by Mr. Butler was invalid in that he
is a city employee and it has been found that the City cannot do business with it s
employees. MOVED by Wine seconded by Alderson that the lease now held by Dale Butler
be cancelled and his payment of $100.00 be refunded to him and a new lease be drawn for

Section 1. That the above - mentioned farm lease executed on
March 1, 1959 leasing the above described property situated on the Yakima Municipal
Airport to Gus Swanson, the same having been subsequently assigned to Ross Davis, is

Section 2. That the Chief City Accountant and the City Treasure
are hereby authorized and directed to refund the sum of $25.00 to the said Ross Davis

Dear Sirs:
In the past few years, several "private" sewers have been constructed outside
the City limits and tied into the City's system. These were paid for by the
person desiring the sewer, and were constructed by him according to the ex-
istirg standards. Other properties along these sewers have been permitted.
to connect to the sewer and have paid the original "user" for that privilege.
As a result several connections have been made without the knowledge of the
Water -Sewer Department, and the connection charge as established in Ordinance
B -2192 has not been paid. In other instances the connection charge has been
paid, and the City has acted as a collectionagent for others.
It is felt that it would be better for the sewer to be purchased from the
original constructors, so that there is no question as to control. The
estimated cost of purchasing the various sewers is:
