MAY 20, 1959
The City Commission met in regular meeting, Mayor Alderson, Commissioners Wine and
Mathews and City Attorney Arntson present on roll call.
The minutes of the regular meeting of May 13, 1959 and adjourned meeting thereof, were
approved as read.
This being the time for hearing on'the petition filed by J. G. Lindeman and others,
praying for the annexation of certain property contiguous to the City of Yakima located
between Tieton Drive and West Chestnut, an ordinance - providing for said annexation and
a protest filed by Catherine G. Card were read by the City Clerk. Mr. Richard Smith ,
Attorney representing Mrs. Card, stated that this annexation would create two islands
instead of one, which he believed would be harder for the City to annex in the future
and that his client and Dr. Myers are being very,.conscientious in developing the business
area and that he did not believe that a well developed shopping area in this location
would devaluate the adjoining property. Other persons present voiced objections to the
drive in hamburger business now under construction in the area,and were of the opinion tY
businesses being built were not conforming to any building code, and that this business
area would definitely devaluate adjoining residential property and were therefore for
the annexation in order that restrictions in zoning and building could be enforced.
Mayor Alderson contended that the business area could be developed even though annexed
to the City. Commissioner Wine intimated that an island is very undesireable within
the boundaries of the City. All persons being heard.and protests filed, it was MOVED
by Wine, seconded by Mathews that Ordinance No. B -2297 providing for said annexation
be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call.
ORDINANCE NO. B -2297, AN ORDINANCE providing for the annexation by the City of Yakima,
Washington., of certain property contiguous to the City of Yakima.
An ordinance appropriating specific sums to the Airport Fund, Cemetery Fund, Garbage
Fund, Street Fund and Current Expense Fund, said amounts needed because of increase in
insurance rates, having been read in its entirety at a regular meeting of the City
Commission on May 13, 1959 and laid on the table for one week and now having been read
by title only, it was MOVED by Wine, seconded by Mathews that Ordinance No. B -22982
providing for said appropriations, be passed as read:- carried, Alderson, Wine and
Mathews voting aye on roll call: carried, Alderson, Wine and Mathews voting aye on
roll call.
ORDINANCE NO. B -2298, AN ORDINANCE appropriating the sum of $159.15 to the Airport Fund
$7.93 to account 7 -67 Insurance - Fire -Theft and, $151.22 to account 7 -68 Insurance -
Liability; and the sum of $163.31 to the Cemetery Fund account 7 -68 Insurance - Liabilit:
and the sum of $61.43 to the Garbage Fund account 7 -,67 Insurance - Fire - Theft; .and the
sum of $134.37 to the Street Fund account 7 -68 Insurance - Liability; and the sum of
$138.17 to the Current Expense Fund Fire, Department, $64.69 to account 7 -67 Insurance
Fire -Theft and $73.48 to account 7 -68 Insurance - Liability, all in the Maintenance
and Operation—classification of the 1959 Budget, and declaring an emergency.
An ordinance repealing Ordinance No. B -2165 and dissolving Local Improvement District
No. 864, or the Lenox Avenue Curb, Gutter and Surfacing .District, having been read at
the last regular meeting of the City Commission and tabled for further consideration and
now being brought forth fo,r decision, it was MOVED by Mathews, seconded by Wine that
said ordinance be passed as read: Alderson and Wine voting Nay on roll call. Mathews
voting aye. This motion failed to carry the necessary majority vote to .pass the
ordinance.
This being the time for the hearing on a petition duly filed by the Washington Canners
Cooperative,.praying for the annexation of certain property contiguous to the city, it
was MOVED by Wine, seconded by Alderson that Ordinance No. B -2299 providing for said
annexation be passed as read: carried, Alderson, Wine and Mathews voting aye on roll
call.
ORDINANCE NO. B -2299, AN ORDINANCE providing for the annexation by the City of Yakima,
Washington of certain property contiguous to the City of Yakima.
Moved by Mathews., seconded by Wine that Ordinance No. B -2300 amending Ordinance No. B -22f
which rezones Lots 13 and 14 Neilan's Memorial Heights and the North 250 feet of the
South 280 feet of the West half of the Southwest quarter of the Southwest quarter of the
Southwest quarter of Section 23, Township 13 North, Range 18, E.W.M., EXCEPT the west
186.44 feet and EXCEPT the East 25 feet for street, from R -3 and R -1 Residential re-
spectively to B -1 Modified Business Zone, be passed as read: carried, Wine and Mathews
voting aye on roll call. Alderson voting nay.
ORDINANCE NO. B -23002 AN ORDINANCE amending Ordinance No. B -2288 relating to zoning.
The term of W. H. Glenn as member of the Civil Service having expired January 1, 1959,
it was MOVED by Alderson, seconded by Wine that W. H. Glenn be reappointed to the Civil
Service Commission for a term of 6 years, or until January 1, 1965, in accordance with
Ordinance No. B -199: _carried, Alderson, Wine and Mathews voting aye on roll-'call.
Moved by Wine, seconded by Mathews that Resolution No. C -1691, transferring funds with-
in the 1959 Budget of the Current Expense Fund, said transfers .being necessary because
of repairs needed for the Air Conditioning System in the City Hall, be passed as read:
carried, Alderson, Wine and Mathews voting aye on roll call.
RESOLUTION NO. C -16912 A RESOLUTION transferring funds within tthe 1959 Budget of the
Current Expense Fund, General Government and City Hall Department, Maintenance &
Operation classification.
WHEREAS, there is an excess of funds in the Maintenance &
Operation classification account 7 -20 Services - State Examiner for the Department of
General Government & City Hall, Current Expense Fund, and
WHEREAS, there is a shortage of funds in the Maintenance &
Operation classification account 7 -46 Maintenance - Equipment, parts & Repairs for the
department of General Government & City-Hall, Current Expense Fund, due to the purchase
of Freon for the Air Conditioning System of City hall, and

WHEREAS, said shortage of funds could not have been reasonably
foreseen at the time of the adoption of the 1959 Budget,and
WHEREAS, the action contemplated herein is authorized by R.C.W.
35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That a transfer be made of $500.00 from account
7 -20 Services - State-Examiner to account 7 -46 Maintenance - Equipment, Parts & Repairs
both within the Maintenance & Operation classification of the Current Expense Fund,
Department of General Government and City Hall to provide for the purchase of Freon for
the Air Conditioning System of City Hall.
Section 2. That the Chief City Accountant is hereby authorized
and directed to make the aforementioned transfers of funds.

Moved by Wine, seconded by Mathews that Ordinance No. B -2301, transferring specific
amounts within the 1959 Budget from a Capital Outlay item to certain salary items in
the Finance Department, all within the Current Expense Fund, be passed as read:

ORDINANCE NO. B -2301, AN ORDINANCE transferring funds from the Capital or Betterment
classification to the Maintenance & Operation and the Salary classifications of tr"e
Current Expense Fund, Finance Department, and declaring an emergency.
After due consideration and a public hearing on May 13, 1959 on an appeal,duly filed
by Max J. La Fond and others, from that certain decision of the City Planning Commission
in the matter of rezoning of property located at 614, 616, 618 West Lenox and 1103
South 7th Avenue from R -2 two family residential, to B -3 general business zone, it was
MOVED by Wine, seconded by Mathews that we abide by the decision of the Planning
Commission which denied the rezoning of this property: carried, Wine and Mathews voting
aye on roll call. Alderson voting nay.
An ordinance amending Ordinance No. B -2136 relating to and regulating the installation
of side sewers,having been read by the City Clerk, it was MOVED by Mathews,- secondedby
Wine that this ordinance be tabled until June 3, 1959 for the consideration of the-new
City Council and City Manager: carried, Alderson, Wine and Mathews-voting aye on roll
call.
A petition praying for the vacation of a portion of- the south side of Spruce Street
between 1st and Front Street having been filed by George Miller, it was MOVED by
Mathews, seconded by Wine that said petition be accepted and Resolution No. C -1692 fix-
ing the date of public hearing at the hour of 10 otclock a.m. on Wednesday the 17th
day of June, 1959, be passed as read: carried, Alderson, Wine and Mathews voting aye
on roll call.

WASHINGTON, IN THE MATTER OF THE VACATION OF that certain street described as follows

thence NW'ly parallel to South 1st Street a distance of 8 feet, thence SW+ly parallel

The following bids having been - received /and considered by a bid board comprised of the
Commis "sioher Wine, City Clerk and the Police Chief, for the purchase of 5 automobiles
for the Police Department:

best bid, it was MOVED by Alderson, seconded by Wine that said bid be so awarded:

The following bids having been received May 18, 1959 and considered by a bid board
comprised of the City Clerk, Commissioner Wine and the Fire Chief, for the purchase of
60 Uniform Pants, 10 Uniform Coats, 15 Unifbrm Jackets and 10 Uniform Caps for the Fire
Department:

and Commissioner Wine now recommending the bid of Nudelman Brothers as, the best bid,
it.was MOVED by Alderson, seconded by Wine that said bid be awarded as recommended:

Mr. Cecil Purdy an employee of the Irrigation Department becoming of compulsory retire-
ment age the last half of 1959 in accordance with the Statewide City Employees Retiremen
law and the Superintendent of Public Works reb6rmazding. the extention of employment for
one year for said employee, it was MOVED by Mathews, seconded by Wine that said
recommendation be granted in order that this employee might complete his Social Security
coverage: carried, Alderson, Wine and Mathews - voting aye on roll call.
Damage claims having been duly filed by F. Reed Collins, and Roy J.- Capen, police officei
said damage being claimed for wrist watches lost or stollen and damaged in connection
with police operations, it was MOVED by Alderson, seconded by Wine that F. Reed Collins
be paid $25.00 and Roy J. Capen be paid $11.27 to cover the loss and repairs of said
watches: carried, Alderson and Wine voting aye on roll call. Mathews voting nay.
A claim for damages resulting from the construction of a sewer in the vicinity of 20th
Avenue and Plath Avenue, said construction having been installed the full length of
Lot 5 Sutor Addition without the consent of the property owner, Manual B. Lyon, it was
MOVED by Wine, seconded by Mathews that the City Attorney prepare the necessary
resolution authorizing the payment of $250.00 as recommended by the City Engineer:
carried, Alderson, Wine and Mathews voting aye on roll call.
Moved by Alderson, seconded by Wine that we do now adjourn to meet again on this same
day at the hour of 3 o'clock p.m.: carried, Alderson, Wine and Mathews voting aye on
roll call.

The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Wine
and Mathews and City Attorney Arntson present on roll call.
An ordinance amending the Water Code having been read in part by the City Clerk, it
was MOVED by Wine, seconded by Alderson that this ordinance be tabled and brought before
the new City Council and City Manager: carried, Alderson, Wine and Mathews voting aye
on roll call.
Moved by Wine, seconded by.Mathews that Ordinance No. B -2302 creating a Special
Deposit Fund in Lieu of L.I.D. as requested by the State Examiner for the Water Depart-
ment, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call.
ORDINANCE NO. B -23029 AN ORDINANCE creating the SPECIAL DEPOSIT FUND IN LIEU OF LID
ASSESSMENTS and transferring $66,775.66 from the Water -Sewer Fund to said special fund.
Moved by Mathews, seconded by Wine that Resolution No. C -1693 authorizing the payment
of the sum of $250.00 to Manuel B. Lyon and Mildred E. Lyon for damages to certain
property in the vicinity of 20th Avenue and Plath Avenue caused by the construction of
-a sewer on said property, be passed as read: carried, Alderson, Wine and Mathews
voting aye on roll call.
RESOLUTION NO. C -16939 A RESOLUTION authorizing the payment of the sum of $250.00 to
Manuel B. Lyon and Mildred E. Lyon, his wife.
WHEREAS, during the year 1956 a sewer etas constructed by the
City of Yakima in the vicinity of 20th Avenue and Plath Street, a portion of which was
installed the full length of Lo.- 5 of Sutor Addition to the City of Yakima, the same be-
ing owned by Manuel B. Lyon and Mildred E. Lyon, his wife, and
WHEREAS, said construction over said property was without the
consent or approval of the said Lyons, and
WHEREAS, the said Lyons have made claim against the City of
Yakima for damages to said property on account of said.sewer construction, and
WHEREAS, the damage to said property by reason of the construc-
tion.,of said sewer has been assessed by an appraisor appointed by the (-ity of Yakima in
the amount of $250.00, and
WHEREAS., the said Lyons are willing.to accept said sum of $250.0
and will in return grant an easement ten feet in width along the south side of said Lot
5, Block 2 of Sutor Addition to the City of Yakima, and

WHEREAS, the City Commission . finds that said amount is a
reasonable amount and is necessary in the public interest of the people of the City of
Yakima, now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1., The Chief City Accountant and the City Treasurer
are hereby authorized and directed to pay to Manuel B. Lyon:and Mildred E. Lyon, his
wife, the sum of $250.00 upon receipt by the City of an executed easement to the
south 10 feet of Lot 5, Block 2, Sutor Addition to the City of Yakima.

of $600.00 within the Legal Department Budget in the Current Expense Fund, be passed

RESOLUTION NO. C -16941 A RESOLUTION providing for the transfer of funds within the
Maintenance and Operation classification of the 1959 appropriation for the Legal
Department.
WHEREAS, it is necessary in the operation of the Legal Depart-
ment to purchase more books, and
WHEREAS, there are not sufficient funds in the 1959 Budget
therefor, and
WHEREAS, the City Commission deems it in the best interest of
the City of ;akima to make the transfer herein, and the action contemplated is author-
ized by R.;C.W. 35. 33. 120, now, therefore,,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
Section 1. That the sum of $600.00 is hereby transferred from
Account 7 -21 Professional, Legal and Accounting account to Account 7 -31 Publications
and Printing Account, all within the Mai ntenance and Operation classification of the
Legal Department appropriation in the 1959 Budget and the Chief City Accountant is
hereby authorized and directed to make the aforementioned transfer herein provided.
