HomeMy WebLinkAbout05/13/1959 Business MeetingF'500 MAY 13, 1959 The City Commission met in regular session, Mayor Alderson, Commissioners Wine and Mathews and City Attorney Arntson present on roll call. The minutes of the regular meeting of May 6, 1959 and adjourned meeting thereof, were approved as read. An ordinance directing the City Treasurer to transfer all funds,in the Accumulative Library Reserve Fund to the Yakima County Treasurer, having been read by the City Clerk and the City Attorney having read a portion of a letter from the Attorney Generals office on this subject, it was MOVED by Mathews, seconded by Wire that Ordinance No. B -2291, providing for said transfer of funds, be passed ax read: carried, Alderson, Wine and Mathews voting aye on roll call. The City Treasurer questioning the title of the fund in said ordinance, it was MOVED by Wine, seconded by Mathews that this ordinance be reconsidered, carried, Alderson, Wine and Mathews voting aye on roll call. It then being established with persons present representing the Yakima Valley Regional Library, that the Library is in immediate need of these funds, it was MOVED by Wine, seconded by Mathews that Ordinance No. B -2291 be corrected as to the title of the Fund to be transferred, which is "Cumulative Reserve Fund for Yakima City Library Building Fund; and that the transfer read all money and investments, since part of this money is invested at this time, and that the 30 day clause be deleted and said ordinance be made an emergency: carried, Alderson, Wine and Mathews voting aye on roll call. ORDINANCE NO. B -22911 AN ORDINANCE directing the City Treasurer of the City of Yakima to transfer all funds in the Cumulative Reserve Fund for Yakima City Library Building Fund of the City of Yakima to the Yakima County Treasurer and declaring an emergency. An ordinance appropriating $200.00 from the Airport Fund having been read in its entiret at the regular meeting of the City Commission on May 6, 1959, and now having been read by title only, and it having been established that Section One had been corrected as ordered in the first reading, it was MOVED by Mathews, seconded by Wine that Ordinance No. B -2292 providing for said appropriation, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. ORDINANCE NO. B -2292, AN ORDINANCE appropriating $200.00 from the unappropriated funds of the Airport Fund for the,purchase of a used automobile and creating an emergency. Moved by Mathews, seconded by wire that Ordinance No. B -2293 appropriating x$2,000.00 of the Current Expense fund to the Engineering Department for the purchase of two used automobiles, said ordinance having been read in its entirety at the regular meeting of the City - Commission on May 6, 1959 and now having been read by title only, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. ORDINANCE NO. B -2293, AN ORDINANCE appropriating 2.,000.00 from the unappropriated . funds of the Current Expense fund for the Engineering Department for the purchase of two used automobiles and creating an emergency. An ordinance appropriating $8,450.00 in the Current Expense Fund for payment of legal publications in the local newspapers of proposed amendments to the City Charter voted on March 10, 1959, having been read in its entirety at a regular meeting of,the City Commission on April 29, 1959 and laid on the table since that time, and now being read by title only, it was MOVED bar „-Wine; secoftoed .by-�Matl;ews that -Ordinance- No:.:,B- 2294 providi•irig.for said appropriation, be passed as read: carried, Alderson, Wine & Mathews -Voting aye on roll call. ORDINANCE NO. B -2294, AN ORDINANCE-appropriating the sum of x$8,450.00 of the unappropri ed Current Expense Fund to Account 7 -31 Supplies Publications and Printing of the Maintenance and Operation classification of the City Clerk in the 1959 Budget and de- claring an emergency. An ordinance appropriating the sum of x$2,288.00 of the Current Expense Fund to specific salary classifications in the Finance 'Department Budget and eliminating certain positions in the Water Department 1959 Budget, having been read in its entirety at the regular meeting of the City Commission on April 29, 1959 and laid on the table since that time, it was.: MOVED- by,Wine, ;­ secorid.ed'.by Mathews that'Ordinance;No.. B- 2295- :prbv ding'for said appropriation be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. ORDINANCE NO. B -2295, AN ORDINANCE appropriating the sum fo $3,288.00 of the unappropria ed Current Expense Fund to the Salary Classification, Clerk II, Finance Department, and eliminating the positions of Senior Clerk at $4,470.00 per annum and Clerk II at $3,432.00 per annum in the Salary Classification, of the Water -Sewer Fund which were appropriated for in the 1959 Budget, and declaring an emergency. An'ordinance appropriating specific sums in the Airport Fund, Cemetery Fund, Garbage Fund, Street Fund and Current Expense Fund, said appropriations being needed to take care of increased insuranbe rates, was read in its entirety and.ordered laid on the table for one week. Moved by Mathews, seconded by Wine that Resolution No. C -1690 providing for the transfer of x$380.00 within the Airport 1959 Budget, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. RESOLUTION NO. C -16901 A RESOLUTION providing for the transfer of funds within the 1959 appropriation of the Airport Fund. WHEREAS, a surplus exists in some accounts of the Maintenance and Operation classification of the Airport Fund, and WHEREAS, it is necessary that funds be transferred because of shortages in certain established accounts of the Maintenance and Operation classification of the Airport Fund, and WHEREAS, such shortages could not have been reasonably foreseen at the time of the adoption of the 1959 Budget, and WHEREAS, the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, C r' C 1 1 Y 1 I MAY 13, 1959 BE IT . RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. The City Engineer reporting further on the protests filed on Local Improvement District No. 870, being Kenny Drive and Various Streets Paving District, that 61.4% of the total assessments against the improvement of Blackburn Street, these protests not having been among those recorded on May 6, 1959, it was MOVED by Wine, seconded by Alderson that Blackburn Street be deleted from Local Improvement District No. 870 as created by Ordinance No. B -2287: carried, Alderson and Wine voting aye on roll call. Mathews voting nay. Moved by Mathews, seconded by Wine that Ordinance exchange of equipment between the Airport Departme the Water Department furnish pipe and labor to the $1,900.00 in exchange for 1053.7 lineal feet CT1 x 2" mesh, #9 gage wire, be passed as read: carried, aye on roll call. No. B -2296 providing for the mutual at and the Water Department and that Airport Department in the sum of 3t6" high Steel Fence, round posts, Alderson, Wine and Mathews voting AN ORDINANCE providing for the mutual exchange of equipment between the Airport Depart- ment and the Water Department and declaring an emergency. 501. An appeal from that certain decision of the City Planning Commission in the matter of rezoning property located at 61L}, 616, 618 West Lenox and 1103 South 7th Avenue from R -2 two family residential, to B -3 general business I zone, having been duly filed by Max J. La Fond, Garold E. Sessions and Elza W. Scott, Elwood Hutcheson, Attorney for said property owners, explained that the people in this area were 100 percent for the rezoning to a general business zone and that since west Lenox is an arterial and always will be, it is not desireable for residential property. A realator speaking for these property owners explained that he had lost one'sale of this property because it was not rezoned to general business. The Planning Director explained that the Planning Commission - believes the boundaries of the existing zone should not be expanded further west, as it would compound the strip zone situation that exists on Lenox Avenue, and that this type of zoning is objectionable from the standpoint of traffic movements on arterials economical land use patterns and overall neighlborhood planning principles. Mayor Alderson explained, after all persons had been heard, that this matter would be taken Under advisement and a decision issued at a latter date. The first draft of an amendment to the Water Code, being Ordinance No. B -606 was read by the City Clerk. Moved by Mathews, seconded by Wine that this ordinance be prepared in its official form making the necessary corrections and brought,forth at the next regular meeting of the City Commission: carried, Alderson, Wine and Mathews voting aye on roll call. The following letter addressed to the City Commission from the City,Attorney, was read by the City Clerk MAY 11, 1959 " City Commission City of Yakima Yakimy., Washington Re: 20th Avenue South between Lombard Lane and the Naches - Cowiche Canal Gentlemen: Subsequent to the trip made by members of the Commission, City Engineer and my- self to the above location, I wrote a letter to Mr. and Mrs Paul G. Magnusson demanding that they remove the fence from the path on South 20th Avenue and open it for travel., A copy of my letter is attached. Upon receipt of the letter Mr. Charles R. Lyon, Attorney for the Magnussons, came in and we discussed the problem. It had been my information that the path had existed in its present location for well in excess of ten years. Mr. Lyon claims that he can show that the path has been in its present location only since Mr. Tipple, the adjoining property owner to the West, erected the,fence which extends twenty feet into the F, 502 MAY 13, 1959 former street, and tint prior to that the the path meandered c®nsiderably but was confined mainly to the center ten feet. Mr. Lyon, at that time, stated that he would try to get together with Mr. Tipple's attorney to straighten the mess out so that the path would be again opened to the public. Friday afternoon Mr. Lyon called to say that he had talked to Mr. Halverson, Tipple's attorney, and was told by Mr. Halverson that he might contact Mr. Tipple directly.. Upon doing so, Mr. Lyon was informed by Mr. Tipple that he would have nothing to do with any settlement and did not want to even discuss the matter. Since neither of the it would appear that proceedings will have legal-actibn to abate under the statute. AA /mc Encl Copies Furn- fished: Mayor Comm. Pub.. Works Comm. Magnusson and Mr. Tipple and leting- the court decide this matter, it was MOVED by Mathews, seconded by Wine that the City Attorney be and is hereby authorized to take-, - necessary::action to'open the path on South 20th Avenue to public travel: carried, Alderson, Wine and lylathews voting a ye on roll call. Moved by Mathews that trustees from the City Jail be permitted to work on mowing and g grass trimming at.the Tahoma Cemetery. This motion lost for want of a second. Commis- sioner Wine expressed the opinion that this matter should have public hearing before action is taken. Mayor Alderson contended that a policy for such proceedure should be worked out by the City Commission before any action is taken. Some discussion was held regarding the Ohlson Electric arbitration. MOVED by Wine that we reconsider this matter. Motion lost for want of a second. Moved by Alderson, seconded by Wine that we do now adjourn to meet again in regular session at the hour of 10 o'clock a.m. on Wednesday the 20th day of May, 1959: carried Alderson, Wine and Mathews voting aye on roll call.
