Mayor Alderson absent. The minutes of the regular meeting of April 29, 1959 and adjourned meeting thereof, were approved as read. A hearing having been held April 29, 1959 on Resolution No. C -1672, being a resolution of intention to improve South 6th Avenue and various other streets, by grading, ballas ing and surfacing, and there being considerable protests filed in writing by residents of certain streets, and the City Engineer now reporting and recommending the deletion of South 6th Avenue which has a 69,.7% protest, Mead Avenue with a 67.1% protest and 40th Avenue which has 79.8% protest, it was MOVED by Mathews, seconded by Wine that the Engineers report be accepted and the Ordinance creating a local improvement district be corrected deleting these streets from the project: carried, Wine and Mathews voting aye on roll call. Alderson absent. Moved by Mathews, seconded by Wine that Ordinance No. B -2287, providing for the improve , ment of certain streets by surfacing with asphaltic concrete and creating Local Improve ment District No. 870, be passed as corrected: carried, Wine• and - .Mathews voting aye on roll call. Alderson absent. ORDINANCE NO. B -2287, AN ORDINANCE providing for the improvement of certain property by Branding, ballasting, surfacing with asphaltic concrete, and together with the necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. Moved by Mathews, seconded by wine that Ordinance No. B -2288 rezoning property located on the northeast corner and northwest corner of 31st Avenue South and Tieton Drive from R -3 and R -1 residential to B -1 or Modified Business zone, be passed as read: carried, Mathews and Wine voting aye on roll call. Alderson absent. ORDINANCE NO. B -2288, AN ORDINANCE rezoning specific property situate in the City of Yakima, County of Yakima, Washington. Alderson absent. ORDINANCE NO. B -2289, AN ORDINANCE rezoning_ specific property situate in the City of Yakima County of Yakima, Washington. Moved by Mathews, seconded by Wine that Resolution No. C -1688, being a resolution of intention to improve certain property by constructing a domestic water system and pipe sewers, and fixing the date of hearing on said resolution for the hour of 10 o'clock a.m. on Wednesday the 27th day of May, 1959, be passed as read: carried, Wine and Mathews voting aye on roll call. RESOLUTION NO. C -1688, BE IT RESOLVED BY THE CITY 'COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following described property by constructing the necessary mains, fire hydrants, valves, and other appurten- ances for the purpose of supplying water for domestic use and fire protection, and by constructing pipe sewers with the necessary wye branches, manholes, and flush ends, all of said improvement to be constructed in full.accordance with the plans and specifica- tions to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assessed for the above described improvement for domestic water is situate in the City of Yakima, Yakima County, Washington, and described as follows: Tracts 36 to 40 inclusive, of First Addition to Suburban Acre Homes; The W. 183.8 feet of Tracts 59 to 61 inclusive, of First Addition to.Suburban Acre Homes. The district to be. served by and specially benefited by and assessed for the above described improvements for sanitary sewer is situate in the City of Yakima, Yakima County, Washington, and described as follows: Tracts 38 to 40 inclusive, of First Addition to Suburban Acre Homes; Tract 37 of F'irst Addition to Suburban Acre Homes, except the East 77 feet of -the North 164.75 feet; Tract 36 of First Addition to Suburban Acre Homes, except the North 183 feet. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear and present objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10:00 A.M. on Wednesday, -the 27th day of May, 1959, which time and place are hereby fixed for the hearing of all matters J 1 1 I� I ICI MAY 6, 1959 relating to said proposed improvement or objections thereto; and for determining the method of payment for said improvements, and the City Clerk is hereby directed to give notice of said hearing and of the intention to make the aforesaid improvements. A portion of the costs and expenses of said improvement includ- ing engineering, inspection, advertising, publication of notices, if any, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor, as provided by law and as above described, and the balance of the said costs and expenses shall be borne by the City Water Department in accordance with Resolution C -1051. The City Engineer is hereby directed to submit to the City Commission all of the data and any other information required by law to be by him sub- mitted. C -1689, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following streets by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with necessary drainage features: 1. South 6th Avenue - Lenox Avenue to Stewart Street; 2. Cornell Avenue - Lenox Avenue to Stewart Street. That it is also its intention to,improve the following street by constructing concrete curbs and gutters, together 'with the necessary drainage features: 1. South side of Stewart Street from Cornell Avenue to South 5th Avenue. Said proposed district is to embrace all property adjacent to the above improvements which is subject to assessment for the cost of said improvements as provided by the laws of the State of Washington. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington at the hour of 10 o'clock a.m. on Wednesday the 27th day of May, 1959, which time and place are hereby fixed for the hearing of all matters relating to said improve- ments, and for determining the method of payment for said improvements; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvements. Lindeman and others praying for the annexa- tion of certain property and the City Clerk having read the order fixing the date of hearing "on said petition at the hour of 10 o'clock a.m. on Wednesday the 20th day of May, 1959, it was MOVED by Mathews, seconded by Wine that said petition be accepted and the City Clerk be and is hereby instructed to give notice of hearing by publication and posting on the property to be annexed as prescribed by law: carried, Wine, and Mathews voting aye on roll call. Alderson absent. A hearing having been scheduled for the hour of 11 o'clock a.m. on this date for the purpose of considering the appeal from that certain decision of the City Planning Commission in the matter of rezoning of property situated at 614, 616, and,618'West Lenox Avenue and 1103 South 7th Avenue, appsal having been filed by Max J. La Fond and others, and it being desirous by those present that they be heard by all three commis= sioners, it was suggested that this matter be deferred until later in this meeting as Mayor Alderson was due to return for this hearing. This decision was agreeable to all. The City Attorney assuring the City Commission that notice of canncellation and termin- ation of a farm lease held by Jacob Woitt on certain property located at the Municipal Airport, has been duly served, the following informal bids for the lease of the same 497 1498 MAY 6; 1959 property were read by the City Clerk: Tommy & Bill Hughes $ 120.00 per year James R. Eakin $125.00 per year Clyde M. Robinson 50.00 per year . The bid of James R. Eakin being the highest and best bid for the City, was questioned by Commissioner Wine, as to whether or not it was legal and propertfor the city to do business with it's employees. The City Attorney took this matter under advisement and reported that ,,.in accordance with the City Charter and the State Law, the City cannot do busihess with it's employees. MOVED by Mathews, seconded by Wine that these bids be rejected and that we advertise for bids for the lease of this property: carried, Wine and dine and Mathews voting aye on roll call. An ordinance transferring certain equipment from the Street Department and transferring certain funds from the Water Department Budget to the Street Fund, having been read by the City Clerk, it was MOVED by Mathews, seconded by Wine that this­,ordinance:b&. corrected and the emergency clauses stricken from it: carried, Mathews and Wine voting aye on roll call. It was further MOVED by Mathews, seconded by Wine that Ordinance No. B -2290 transferring certain equipment from the Street Department to the Water Department and transferring funds from the Water Department Budget to the Street Fund be passed as corrected: carried, Wine and 1`iathews voting aye on roll call. Alderson absant rr • May 6, 1959 I move that blinker lights be installed on the height restriction sign of the Walnut Avenue Underpass, for the purpose of attracting attention to the re- stricted clearance of the underpass to serve as an aid in reducing truck accidents caused by the restricted clearance. That the traffic engineer be directed to take the necessary steps for the installation of these blinker lights. Alderson absent. ,rr May 6, 1959 I move that the dispute between the City of Yakima and Olson Electric Company regarding payment of liquidated damages in connection with the Airport High Intensity lighting contract be referred to arbitration and that the City Attorney be instructed totake all necessary steps to see that this is done immediately. Alderson absent. it May 6, 1959 I move that the City Attorney be instructed to prepare the necessary resolutions to dissolve the Lenox Local Improvement District. This local improvement district was established as a part of the contemplated Arterial Development program embracing the Lenox Overpass. The bond proposal to finance this improvement was not passed by the electorate. Therefore, the improvement of Lenox Avenue cannot be accomplished at this time and the Improvement District should be dissolved. At the public hearing establishing the Local Improvement District, the people were told that nothing would be done if the bond issue failed to obtain public approval. This is the action contemplated now. It I would like to make a motion that the Planning Commission -be directed to study and hold hearings and prepare the necessary ordinance and other material to put that resolution of -the policy with respect to vacation of streets and alleys into effect in the City of Yakima. They are to start the wheels going so that the City Commission or City Council may consider. " Moved by Wine, seconded by Mathews that we do now adjourn to meet again at the hour of 1:30 o'clock p.m. on this same day for the.purpo'se of hearing the appeal from the decision of the Planning Commission on the rezoning of property located at 614,616, & 618 West Lenox Avenue and 1103 South 7th Ave., since the Mayor has not returned for this hearing: carried, Wine and Mathews voting aye on roll call. City Attorney and Mayor Alderson absant. Due to the fact that Mayor Alderson could not be contacted and it being desirable that all three Commissioners be present to hear the appeal from the decision of the Planning Commission on the rezoning of property located at 614, 616 and 618 west Lenox Avenue and 1103 South 7th Avenue, it was MOVED by Wine, seconded by Mathews that this matter be set aside until the next regular meeting of the City Commission on Wednesday the 13th day of May, 1959: carried, Wine and Mathews voting aye on roll call. Alderson absent. Moved by Mathews, seconded by Wine that any referrence made to the collection of money in connection with the Farm Lease held by Jacob Woitt on certain property.at,the Municipal Airport, be deleted from the records of these meetings: carried, Wine and Mathews voting aye on roll call.
