South 6th Avenue - Lenox to Stewart 2. Unnamed Street between Mavis Avenue and Lincoln Avenue from 40th Avenue east 185 feet. 3. The North 1/2 of Mead Avenue .from 12th Avenue to 16th Avenue. 4. All. of Kenny .Drive . 5. Chisholm Trail from Chestnut to Walnut . That it is also its intention to improve the following alley by grading;, ballasting, and surfacing with. asphaltic concrete. 1. RESOLUTION NO. C -1673, A RESOLUTION authorizing the Mayor and City Clerk of the City of Yakima to enter into an agreement with Chateau Enterprises, Inc. for the operation of the restaurant and snack bar at the Yakima Municipal Airport for a six month period. WHEREAS, on May 2, 1956 the City entered into lease agreements with Chateau Enterprises, Inc. for the restaurant and snack bar facilities at the Yakima Municipal Airport, and WHEREAS, the Chateau Enterprises, Inc. are in default on the rentals due and utilities furnished by the City pursuant to said leases, and WHEREAS, it is- deemed in the best interests of the City of Yakima that restaurant facilities be continued at the Yakima Municipal Airport,-and that an agreement be made with the Chateau Enterprises, Inc.- for the operation of said restaurant and snack bar under the supervision. of the City, in order that said default may be cured, now, therefore, BE IT RESOLVED BY THE CITY COM1� ISSION OF THE CITY OF YAKIMA: Section 1. That the Mayor and City Clerk of the City of Yakima be and they hereby are authorized and directed. to enter into an agreement, a copy of which is hereto attached, with Chateau Enterprises, Inc. for the operation of the restaurant and snack bar at the Yakima Municipal Airport for a period of six months, all as in said agreement attached hereto set forth in length. ALDERSO N, City Clerk Mayor It having been determined through the State Examiners Office that the "Working Fund" as created, by Ordinances No. B -2229 and 2246 is in effect a revolving fund and therefore contrary to State Law, it was MOVED by Mathews, seconded by Wine that Ordinance No. B -2275 discontinuing said fund, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. ORDINANCE NO. B- 2275; AN ORDINANCE discontinuing the special fund known as the " "Working Fund" and providing for the transfer of the unexpended balance, less out- standing warrants, to the "Irrigation Fund "; and repealing Ordinances B -2229 and B- 2246 and declaring an emergency. The following bids having been. received and considered by a bid boad comprised of the Purchasing Agent, City Clerk, Supt. of Public Works on April 6, 1959: Decoto Brothers Total item #1 Total item #2 1216,80 1108.65 H. The following-named employees being over compulsory retirement age during the last half of 1959,-Glenn Hogrefe of -the Street Department and Carl. Mogren of the Water Department, and the Superintendent of Public Works recommending the extention of employment for one year in order that these men might complete their Social Security coverage, it was MOVED by Mathews, seconded by Wine that employment be extended for one year for these employees and the City Clerk is hereby directed to notify Statewide City Employees retirement of this action after the individual medical reports are received: carried, Alderson, wine and Mathews voting aye on roll call. The Statewide City Employees Retirement System reporting that Oscar Soderling, an Airport employee, reaches compulsory retirement age as of July 1, 1959, and the Airport Manager recommending extention of employment for said employee, it was MOVED by Mathews secor3d ed by Wine that- extention of employment be granted this employee for one year and the City Clerk ks hereby directed to notify State City Employees Retirement System of this action after Mr. Soderling's medical report is received: carried, Alderson, Wine and Mathews voting aye on roll call. Moved by- Mathews, seconded by Wine that Resolution No. C -1674 authorizing Delbert Zirkle to make the necessary contribution of $210.22 to allow him to become a member of Statewide City Employes Retirement System as of the date of his beginning of employ- ment or February 1, 1951 and authorizing the deduction of a like amount from the unex- • �82 APRIL 8, 1959 pended balance on deposit with said Retirement System, be passed as read: carried, Alderson, Wire and Mathews voting aye on roll call. RESOLUTION NO. C -1674, A RESOLUTION authorizing the Statewide City Employees Retirement System to accept retroactive contri'oution of Delbert Zirkle. WHEREAS, Delbert Zirkle is an employee of the "ity of Yakima as Municipal Court Clerk and has been so employed since February 1, 1951, and WHEREAS, during the period since said date the said Delbert Zirkle had not been making contributions to said system, and WHEREAS, the said Delbert Zirkle is now desirous of contributing to said System and of making the retroactive contributions required, and WHEREAS, the Commission deems it advisable and in the best interests of the City of Yakima and of the said Delbert Zirkle to recommend that the said System accept the retroactive contributions of the said Delbert Zirkle and to take a like amount from the City's unexpended balance on deposit with said System, now, therefore BE IT RESOLVED BY TEE CITY COMMISSION OF THE CI`T'Y OF YAKIMA : Section 1. That the State of Washinrton Statewide City Employees Retirement System be and it hereby is authorized to accept the sum of $210.22 as a retroactive contribution by Delbert Zirkle, Membership No. 2528, the same being the amount required to allow him to become a member of said System as of the date of his beginning of employment, to -wit February 1, 1951. Section 2. The said Statewide City Employees Retirement System is further authorized to take a like amount, to -wit the sum of :210.22 from the City of Yakima's unexpended balance on deposit with said Statewide City Employees Retirement System, the same being the amount required to match the said retroactive con tribution of the said Delbert Zirkle. ALDERSON Mayor A letter from Yakima Asphalt Paving Company having been read by the Clerk, setting forth prices lower than thoseaccepted by the City on bids received in January of this year for the purchase of Asphaltic Concrete Mix. and MC -2 Cold Mix, it was MOVED by Mathews, seconded by WiL -_e that this matter be tabled until it Tcou.ld be investigated further, carried, Alderson, Wine and Mathews voting aye on roll call. Moved by Mathews, seconded by Wine that Resolution No. C -1675 rejecting the claim of Harry Osborne for-damages in the amount of. $8,1 +35,52, be passed as read: carried, Alderson, Wine and Mathews voting aye on roll call. RESOLUTION NO. C-1675, A RESOLUTION rejecting the claim of Harry Osborne for damages. WHEREAS, on March 7, 1958 a claim was filed against the City of Yakima by Harry Osborne in the total sum of $8,435.52, and WHEREAS, due consideration •has been' -given to the. - merits of said claim, and merit, now, therefore, WHEREAS, the City Commission finds that such claim is without EE- IT RESOLVE., 9Y THE CI'T'Y COMMISSION OF THE CITY OI YAKIMA: Section 1. A vacancy having been created on the Planning Commission by the resignation of E. Eernard Wine, it was MOVED by Mathews, seconded by Alderson that James D. Cowan be appointed to fill the unexpired term of Mr. Wine, carried, Alderson, Wine and Mathews voting aye on roll call.
