FEBRUARY 4, 1959
The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews present on roll call. City Attorney Arntson absent.
The minutes of the regular meeting of January 28, were approved as read.
This being; the time fm the hearing on Resolution No. C -1646, being a resolution of in-
tention to improve certain property by constructing a pipe sewer on lots 1 to 17 inclu-
sive of Mary Lin_ Park and other property fully described in said resolution, and there
being protests in-writing and otherwise, it was ordered that the City Engineer review
said protests and report his findings at the next regular meeting of the City Commission
This being the date and time set for the .hearing on assessment roll for L.I.,D. No. 867,
or the 41st Avenue Surfacing District, and there being no protests in' writing or other-
wise, it was MOVED by Mathews, seconded-by Schutt that Ordinance No. B -2243 confirming
said assessment roll and every part thereof, be.passed as read: carried, Alderson,
Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2243, AN ORDINANCE confirming the assessment roll-covering Local
Improvement District No. 867 as created and established by Ordinance No. B -2193 of the
Ordinances of the City of Yakima.
Moved by Mathews, seconded by Schutt that Ordinance No. B -2244 amending Section 8 and
repealing section 15 (a) of Ordinance No. B -810, or the sigh and billboard ordinance,
section 8 providing for the permit fee schedule on signs and billboards in the City of
Yakima, be passed as corrected making the billboard or signboard permit fee $7.50 per
unit instead of $5.00: carried, Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE No. B- 2214, AN ORDINANCE amending .Section - 8,-:'and-, repealing' Section -15( d) -•of,-.--
Ordinance N_o:,B= _510...entitled' "An Ordinance.':relati'ng to and regulating the erection and
maintenance of advertising signs, billboards and banners in the City of Yakima; regulat-
ing advertising on the streets of the City; requiring a license for bill posing, a bond
and license for sign erectors, a permit for the erection of signs and billboards and the
inspection of such signs and billboards; providing for license, permit and inspection
fees, fixing penalties for the violation thereof, and repealing Ordinane No. A -136
passed and approved by the �'ity Commission November 14, 1913, and any and all
ordinances amendatory thereof."
An ordinance amending Ordinance.No. B -850 or the Electrical Code having been read,and
considered and referred back to the Building Inspector. at the regular meeting of January
28, 1959 and now being brought on 2)r Commission action, it was MOVED by Mathews, second-
ed by Schutt that Ordinance No. B -2245; be passed as read: carried, Alderson, Schutt
and Mathews voting aye on roll call.
ORDINANCE NO. B -2245, AN ORDINANCE amending Ordinance No. B -850, entitled "An
Ordinance to be known as the Electrical Code of the (City of Yakima for safeguarding life
and property by regulating the installation, alteration, repair, use and operation of
electric wires, appliances, apparatus and devices in or about buildings on private or
public property; providing for the licensing for regulation and revenue of electrical
contractors, dealers and wiremen; defining approved electrical materials and appliances;
prohibiting the sale or use of uapproved materials and appliances; providing penalties
for the violation hereof; repealing Ordinance No. B -25 of the City of Yakima and all
other ordinances or parts of ordinances in conflict herewith."
Moved by Mathews, seconded by Schutt that Ordinance No. B -2246 appropriating $2,500.00
for the Working Fund as created by Ordinance No. B -2229, be passed as read: carried,
Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2246, AN ORDINANCE amending Section 1 of Ordinance No. B -2229, "pro-
viding for the appropriation of funds from the unappropriated funds of the current ex-
pense fund to establish a working fund, and declaring an emergency," and declaring an
emergency.
Moved by Mathews, seconded by Schutt that Ordinance No. B -2247 establishing a Fire Zone
classification of all business, commercial and industrial zones as established by the
zoning code or ordinance No. B -2095, be passed as read: carried, Alderson, Schutt and
Mathews voting aye on roll call.
ORDINANCE NO. B -2247, AN ORDINANCE establishing a Fire Zone classification of all
business, commercial and industrial zones as established by Zoning Ordinance No. B -2095
and Amendments thereto, repealing Ordinances Nos. B -539, B -906 and B -1447•
An ordinance providing for the appropriation of $64,000.00 for the construction of two
domestic water wells, now under construction, said amount not.included in the 1959
Water -Sewer Budget, was read in its entirety by the City Clerk and ordered laid on the
table for one week, to be read and considered at the next regular meeting of the City
Commiss on on Wednesday the 11th day of February, 1959.

Gordon Road, a street running from North lst Street westerly for a distance of 600 feet,
to Tamarack Avenue and designating an unnamed street in the plat "Central Addition to
North Yakima "as "Gordon Road ", be passed as read: carried, Alderson, Schutt and Mathews
voting aye on roll call.
ORDINANCE NO. B- 2218, AN ORDINANCE changing the names of certain streets yin the City of
Yakima as follows: The name "Gordon RoaAlfrom North First Street westerly'.for a distant(
of six hundred (600) feet, to "TAMARACK AVENUE "; and designating an unnamed street in
the plat " Central Addition to North Yakima ", as "GORDON ROAD ".

The following letters written to Commissioner Mathews, ordered "to be a part of these
minutes.

Dear Mr. Matthews:
Enclosed herewith is a letter that I have just written to each of our
State Senators and Legislators at Olympia in connection with the Area
Beautification Program of the Yakima Chamber of Commerce with which project
I believe you and the other members of the City Commission are generally
familiar. I urge that if you are not fully familiar with the details of
this project that you make inquiry and inform yourself and the Commission
so that whatever you can do toward bringing about a development of the
river area in question may be d)ne before other development renders the
cost excessive or. prohibitive.
Please do not consider this letter as one that is written in a sudden
burst of good will toward community activity without considerable prior
thought and study. While I do not pose as an expert on all the issues in-
volved, ,I have at least served for about a year with the Yakima Chamber
Area Beautification Committee and not infrequently have sat in on numerous
meetings concerned with the feasibility of the project. I have had the
pleasure of discussing the project in some considerable detail with Mr.
Pyle;: D'_stridt:_Engineer:for the State Highway Department for this district,
one of the State Highway Commission members, members of the City and County
Planning Commissions, Mayor Alderson and yourself of the City Commission.
I have also taken time to discuss tha project in some detail with various
business mega of the community and adjacent valley towns and can accurately
state that all of those with whom I have had any opportunity to discuss the
matter are enthusiastic about it as an economically sound project deserving
of prompt city and county action,
Solely by way of identification you are reminded that I am a member
of the Kiwanis Club and for the last year I have headed a committee'reprer
senting that organization which is on record as urging positive action on
this project, a member of the Yakima School Board, a member of the Yakima
Chamber Area:.,Beautification Committee as well as being a practicing attorney
in Yakima. Each of the organizations mentioned favors prompt positive
action in any way possible to corral this area for development as a beauty
and recreational area as soon as at all feasible.

The following is a copy of the letter mentioned above as sent to the State Senators and
Legislators.
You have, I believe, -been posted on the current project being widely pushed
in Yakima and surrounding communities for the development and beautification of the
Yakima River area lying between the Moxee Bridge and the Terrace Heights Bridge bordered
on the east side of the river for a part of the distance by the Sportsments State Park
and to be bordered on the west side of the rifrer by the new Interstate Highway By -Pass.
As you know, this is a high priority project of the Yakima Chamber of Commerce and it
is widely endorsed by business men in Yakima and is particularly worthy of your attention
at this session of the Legislature. This letter is being written to you at this time in
appreciation of efforts that I understand'you have already made and to encourage your
further efforts toward an allocation of state funds available to the State Parks Program
for use by the State Parks Committee in extending the Sportsments State Park to include
the area along the river between the two bridges above mentioned. It is my understanding
that our section of the state is in line for application of State Parks funds during the
coming* biennium. Certainly there is no project in this part of the state that is more
worthy of consideration than this particular river improvement area. Certainly you are
aware of the benefits that would - follow to the Yakima Valley if this project can ultimate
ly be completed in providing natural and developed beauty along the course of the river
and of the new interstate By -Pass. Certainly its importance in supporting property
values is evident as well as the incident benefits to the citizens of Yakima, Terrace
Heights and nearby Valley citizens.
Please continue to do everything that you can to nail down -State Parks funds
for use during the coming biennium in acquiring the property in question as an extension
of the present SportsmenIs State Park. Mantis of us in Yakima, individuals and organizatio
are also urging our County Planning Commission to zone the property surrounding Sports -
men +s State Park in prohibiting industrial expansion of the overall area involved on
both sides of the river so that ultimate acquisition may be held to a minimum of cost.
We are also urging City Officials here to cooperate within the limits of their authority
and means with the State Highway Department in present acquisitions of property on the
west side of the fiver adjacent to the new Highway By -Pass.
Your cooperation and efforts in connection with the above will be appreciated
by the vast majority of the citizens of the Yakima Valley for many years to come.

The following is a letter received by Mr. Mathews from the Lions Club on Area Beautifi-
cation:

Dear Larry:
I think you know that for 37 years the Yakima Lions Club has been in the forefroni
of Parks & Parks & Playgounds development for the City of Yakima. Now we see an
opportunity for someone to do more at one time for the entire Central Washington
area than we have been able to accomplish with all our past effort. That is the
development of the area on both sides of the-Yakima River between the Terrace
Heights and Moxee bridges.
While this area is in transition and development by reason of the State Highway
By -Pass, we sincerely hope that no means may be overlooked by which the land
T mentioned may be acquired by the State of Washington, Yakima County', and the
City of Yakima, so that it may be available for recreational.purposes when funds
can be found.
The Board of the Yakima Lions Club has authorized this letter so that you, and
,through you the City Commission and the City Planning Commission, may be
apprised of our interest. We hope these lands may be acquired at this time,
and assure you. of our whole- hearted support of any effort you. may be able to
initiate leading to their acquisition for community recreational purposes
The matter of funds and taxes are, rightfully, now very much in everyone�s mind.
As to the land on the East side of the river, we urge action now only because wa
understand that the State Park Commission has funds ayailable after their opera-
tional expenses are paid which can be allotted for the purchase of additional
park sites. We hope that the State Park Commission may see the desirability of
acquiring now that land North of the present SportsmenIs State Park to Terrace
Heights Way on the East side of the Yakima River, and that local bodies can
acquire the land on the West side.

The -following is a letter to the City Commission from Larry Mathews:
Memo to: City Commission
From: Larry Mathews, Public Works Commissioner
The Chamber of Commerce Beautification Committee has recommended that the
"Riverside Area" located between the Moxee and Terrace Hgts. Bridges be developed
for recreational purposes. Various civic groups and individuals have been con-
tacted and the general attitude was one of enthusiastic support. The attached
letter'kabove) is indicative of this feeling.
Preliminary plans are being developed now. The City of Yakima can help by adopt-
ing this project as a part of the comprehensive plan for the future development
of the city.
The cost of acquiring part of this land whould be reduced if the city would enter
into an agreement with the State of Washington Highway Department to participate
in the acquisition of land along th,e ,proposed freeway route. The city could
arrange to purchase the pieces of property outside of the state right -of -way re-
o,uirements. The saving to both the City and the State would be in avoiding
severance damages.
.I respectfully recommend that the City Commission authorize the City Engineer
to make a preliminary investigation of this proposal and that he report to the
City Commission by February 11 the results of his investigation.

RESOLUTION NO. C -1657, WHEREAS, by ordinance, it is provided that, on the first Monday
in February of each year, the City Commission of the City of Yakima, Washington, shall
pass a resolution prescribing the form of contract for the city advertising for the
ensuing year;
NOW, THEREFORE, BE IT'RESOLVED by the City Commission that the
form of contract for the city printing for the ensuing year shall be in substantially.
the form hereto attached and made a part hereof, and the City Clerk, is hereby directed
to give notice for sealed proposals for a contract for doing the city advertising for
the ensuing year by publishing the same for two consecutive issues in the newspaper
doing the city printing, which notice shall contain a general statement,.of the terms of

In accordance with an order made at the regular meeting on Wednesday the 28th day of
January, 1959 the following resolution was prepared and submitted by the City Attorney,
repealing Resolution No. C -1644 authorizing a lease agreement for parking areas at the
Yakima Municipal Airport:

A RESOLUTION repealing Resolution No. C -1644, adopted January 7, 1959, author-
izing a lease agreement for parking areas at the Yakima Municipal Airport.
WHEREAS, on January 7, 1959, the City Commission of the City of Yakima adopted
Resolution No. C -1644, authorizing the Mayor and City Clerk, on behalf of the
City of Yakima, to enter into a lease agreement for certain - narking areas at
the Yakima Municipal Airport with Joseph L. Otbrien, doing business as the
Airport Parking Lot Company and
WHEREAS, it is deemed necessary and advisable to reconsider the advisability of
entering into such a lease and that the said Resolution No. C -1644 should be
repealed, now therefore
BE IT RESOLVED BY THE CITY OF YAKIMA:
That Resolution No. C -1644 adopted by the City Commission of the City of Yakima
on January 7, 1959, be and the same hereby is repealed.

RESOLUTION NO. C- 1658, A RESOLUTION authorizing the City of Yakima to enter into an
agreement with C. A. Siles and B. E. Kirby with respect to the temporary use of certain
real property a& a garbage dump.
WHEREAS, the City of Yakima is in dire need for a site upon
which to deposit the garbage and refuse from the City of Yakima, and
WHEREAS, C. A. Siles and B. E. Kirby areowners of the following
property, to -wit:
That portion of the SW4 of the SW4 of Section 17, Township
13 N, Range 19 E.W.M., lying SW►ly of the Yakima River and
E'ly of the right -of -way of the proposed primary state high-
way,
and ,
WHEREAS, the said C. A. Siles and B. E. Kirby are desirous of
entering into an-agreement for the depositing upon said real property of the garbage
and refuse of the City of Yakima for the purpose of reclaiming the same and building
it up to the elevation of the surrounding ground,,and
WHEREAS, the City of Yakima may obtain the use of the said
property at no cost to the City, now therefore,
BE IT RESOLVED BY THE CITY OF YAKINIP :
That the Mayor and the City Clerk of the City of Yakima be and
they hereby are authorized and directed to enter into an agreement with C. A. Siles

the United States Department of Commerce Civil Aeronautics Administration for the right -

WHEREAS, At is deemed in the best interests of the City of
Yakima for the maintenance and operation of the Yakima Municipal Airport that an
approach lighting system be installed on the East approach, and,
WHEREAS, it is anticipated that the United States Department
of Commerce Civil Aeronautics Administration will participate-to the extent of making
a grant for the acquisition and construction thereof, and,
WHEREAS, to accomplish the same it is necessary that the City
of Yakima enter into an agreement with said Civil Aeronautics Administration with respect
to the same, now therefore,_

(herein referred to as the "Sponsor ")
FROM: The United States of America (acting through
The Administrator of Civil Aeronautics, herein
referred to as the "Administrator ")
WHEREAS, the Sponsor has submitted to the Administrator a
Project Application dated December 12, 1958 for a grant of .Federal Funds for a project
for development of the Yakima Municipal Airport (herein called the "Airport "), together
with plans and specifications for such project, which Project Application, as approved
by the Administrator, is hereby incorporated herein and made a part hereof; and
WHEREAS, the administrator has approved a project for develop-
ment of the Airport (herein called the "Project ") consisting of the following described
airport development:
Land acquisition (Parcels 4A through 4G)
"`The airport development to be accomplished, herein described,
is in addition to that contemplated under the Grant Agreements between the Sponsor and
the United States for Projects 9 -45- 023 -901, -902, -203, -504, and -0705.
= t'.all as more particularly described in the property map and
plans and specifications incorporated in the said Project Application;
"NOW THEREFORE, pursuant to and for the purposes of carrying
out the provisions of the Federal Airport Act (60 Stat. 170;. Pub. Law 377, 79th Congress;
and in consideration of (a) the Sponsor's adoption and ratification of the representa-
tions and assurances contained in said Project Application, and its acceptance of this
Offer, as hereinafter provided, and (b.) the benefits to accrue to the United States
and the public from the accomplishment of the Project and the operation and maintenance
of the Airport, as herein provided,
"THE ADMINISTRATOR, FOR AND ON BEHALF OF THE UNITED STATES,
HEREBY OFFERS AND AGREES TO pay, as the United States' share of costs incurred in
accomplishing the project, 51.68 per centum of all allowable projects costs, subject
to the following terms and consistons:
1. The maximum obli ation of the United States payable under
this offer shall be 18,765.00
2, The Sponsor shall
(a) begin accomplishment of the Project within a reasonable
time after acceptance of this Offer, and
(b) carry out and complete the Project in accordance with
the terms of this Offer, and the Federal Airport Act and the
Regulations promulgated thereunder by the Administrator in
effect on the date of this Offer, which Act and Regulations
are incorporated herein and made a part hereof, and

(c) carry out and complete the Project in accordance with the
plans and specifications and property map incorporated herein
as they may be revised or modified with the qpproval of the
Administrator or his duly authorized representatives.
3. The Sponsor shall operate and maintain the Airport as pro-
vided in the Project Application incorporated herein.
4. The maximum amounts of building space which the Sponsor
shall be obligated to furnish civil agencies of the United
States for the purposes and on the terms and conditions stated i
paragraph 9 of Part III of the Project Application, shall be as
set forth in the attached schedule of maximum space requirements
which is incorporated herein and made a part.-hereof.
5. Any misrepresentation or omission of a material fact by the
sponsor concerning the rroject or the Sponsor's authority or
ability to carry out the obligations assumed by the Sponsor
in accepting this Offer shall terminate the obligation of the
United States, and it is understood and agreed by the Sponsor
in accepting this Offer that if a material fact has been mis-
represented or omitted by the Sponsor, the- Administrator on
behalf of the United States may recover all grant payments made.
6. The Administrator reserves the right to amend or withdraw
this Offer at any time prior to its acceptance by the Sponsor.
7. This Offer shall expire and the United States shall not be
obligated to pay any of the allowable costs of the Project un-
less this Offer has been accepted by the Sponsor within 60 days
from the above date of Offer or such longer time as may be
prescribed by the Administrator in writing.
8. It is hereby understood and agreed by and between the partie
hereto that the Sponsor will acquire property interests
satisfactory to the Administrator to Parcels 4A throu.i7h 4G, as
shown on the property map attached hereto and identified as E
Exhibit "A "; and that the United States will not make nor be
obligated to make any payments involving any of the land in-
cluded in this project.until the Sponsor has submitted evidence
that it -has acquired said satisfactory property interests in and
to said land (or any portion thereof for which grant payment is
sought) subiject to no liens, encumbrances, reservations or ex-
/' ceptions which in the opinion of the Administrator might create
an undue risk of interference with the use and operation of the
airport.
9. It is understood and agreed by and between the parties
hereto that the terms. "Administrator of Civil Aeronautics ",
"Administrator ", "Civil Aeronautics Administration ", "Depart-
ment of Commerce ", "CAA" or "Section 303 of the Civil Aeronautic:
Act of 1938" wherever they appear in this Agreement, in the
Project Application, plans and specifications or in any other
documents constituting a part of this Agreement shall be deemed
to mean the Federal Avidation Agency or the Administrator there-
of or Section 308 (a) of the Federal Aviation Act of 1958 as
the case may be.
"The Sponsor's acceptance of this Offer and ratification and
adoption of the Project Application incorporated herein shall be evidenced by execution
of this instrument by the Sponsor, as hereinafter provided, and said Offer.and accept-
ance shall comprise a Grant Agreement, as provided by the Federal Airport Act, con-
stituting the obligations and rights of the United States and the Sponsor with respect
to the accomplishment of the Project and the operation and maintenance of the Airport.

County Dump Site:

Gentlemen:
A short time ago the Board of County Commissioners enjoined the City of
Yakima from conducting a sanitary landfill operation at the Municipal Airport. Pending
a final decision in the matter,the City of Yakima is making a study of alternate sites
for garbage disposal.
The Cowiche dump on Summitview Extension. is one of the locations presently
under condideration. The control of the Cowiche Dump is under the jurisdiction of the
Board of County Commissioners. Therefore, your approval is necessary.
It would be a great help to the City of Yakima if the Board of County
Commissioners would express its views concerning this tentative location for Yaliima's
garbage dump. ,
I would appreciate your early decision in the matter.

This is in reply to your recent letter regarding your interest in the use of
the Cowiche Dump for the disposal of garbage from the City of Yakima.
Mr. Jim Nichols and Mr. Lee Crossen, composing a majority of the Yakima County
Commission, have discussed the implications of your letter and join in this reply. We
have had no application or proposition from the Yakima City Commission_ for the lease or
purchase of the county owned dumpsite.
The county could take action only after the provisions of the statutes governin€
county property were met and legal public hearings were held.
