The minutes of the regular meeting of January 21, 1959 and the adjourned meetings there- of were approved as read. A.petion having been'duly filed by Ottis F. Kelly, Hilliard Joseph and Robert Reinke, petitioning; for adoption of a charter amendment providing for the nomination of district: and election at large of five coucilmen-;and the nomination and election of two councilmei at large in the '-'ity of Yakima and the City Clerk now certifying that there are in ex- cess of 2,375 signatures and information thereon, or more than 15% of the total number of votes cast at the last preceding,'- general state election, it was MOVED by Mathews, seconded by Schutt that'the City Clerkts ;Certificate be accepted and Resolution No. C -1654 prescribing the form of ballot and placing said issue on the general city election ballot to be voted on the 10th day of March, 1959, be passed as read: carried, Alderson Schutt and Mathews vot:'ng aye on roll call. RESOLUTION NO. C -1654, WHEREAS, a petition has been filed with the City Clerk of Yakima requesting that a proposed measure known as "Amendment to the Uity Charter of the City of Yakima, Washington, further amending Article II, Section 1, as amended, and Article III, Section 1, as amended, to provide for the nomination by districts and election at large of five councilmen and the nomination and election of two councilmen at large" be submitted to the qualified voters of the City of Yakima, Yakima County, Wa:�hi.ngton, for their approval or rejection ,at the general city election. to be held on the 10th day of March, 1959, and, WHEREAS, the said City Clerk has duly examined said petition in accordance with law and the city charter and has certified to the City Commission of.- the City of Yakima that said peition has been signed by _qualified voters of the City of Yakima in excess of the number required by the City Charter and in excess of a number equal to 15% of the total number of votes cast in the City of Yakima at the last preced- ing general state election, to -wit: the general state election held November 4, 1958, now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section. 1. That there shall be submitted to the qualified voters of the City of Yakima at the general city election to be held on the 10th day of March, 1959, for their approval or rejection the following ballot proposition: "PROPOSITION' COUNCIL DISTRICTING CHARTER AMENDMENTS Shall Article II, Section 1, as amended, and Article III, Section 1, as amended, of the City Charter of the City of Yakima be amended to provide for the division of the City into five councilmanic districts and for the nomination by said districts and election at large of five councilmen and the nomination and election of two councilmen at large, to become effective upon approval? Yes No Section 2. That the City Clerk shall cause said proposed charter amendments to be published in two daily newspapers in the City of Yakima - kithin the time and in the manner provided by law. Alderson not voting.- In accordance with a call for bids for the construction of West Pierce Street Sanitary Sewer Repair and the following being the only bid received C. P. Peyton, Klamath Falls Oregon $7,111.76 the City Engineer was instructed to check said bid in order that it may be awarded or rejected before the completion of this meeting. Bids having been received and considered.by the bid board in accordance with Ordinance No. B -2235, on Monday the 21st day of January, 1959, for the purchase of petroleum products for the year of 1959 and said board recommending the following bids as the lowest and best bids: 5000 gallons gasoline regular 14_0,000 gallons premium Ethyl Gasoline 7,500 gallons premium Ethyl Gasoline 25,000 gallons Diesel Fuel. 500 gallons Diesel Fuel to Oak Flats 3,000 gallons kerosene 2,500 lbs Gear Oil - all }uprose 900 lbs. The above mentioned bid board also recommending the rejection of all bids on 1,800 gallons of Motor Oil due to the fact that it was intended to obtain the highest grade 'of multi- viscosity oil and the dealers not interpreting the specifications in this manner, thus submitting bids on straight.10 or 30 weight, it was MOVED by Mathews, seconded by Schutt that &11 bids on Motor Oil be.and are hereby rejected and the Purchasing Agent is hereby authorized and instructed to call for bids under new specifications for said motor oil: carried, Alderson, Schutt and Mathews voting aye on roll call. Bids1having been received and considered on December 10, 1958 for the purchase of Water Meters for the Water Department and the Public Works Superintendent having now completed physical check on the meters available, and it being recommended that either Trident Meters or Badger Meters be used, it was MOVED by Schutt, seconded by Mathews that, if the parts for Badger Meters. could be furnished free. of charge,. the. purchasing Agent be authorized to buy either of these two meters since Neptune Meter Compan submitted a bid of $26.20 per meter and Badger Meter Company submitted a bid of 26.20 per meter.:, carried, Alderson, Schutt and Mathews voting aye on roll call. A bid board consisting of the City Clerk, Purchasing Agent and the Superintendent of Public Works, having received and considered bids for the purchase of a 112 ton truck on January 21, 1959, said truck to be purchased for the Engineering Department and the board recommending the bid of Wagner Chevrolet in the amount of $1,8.37.47 as the lowest and best bid, it was MOVED by Schutt, seconded by Mathews that said bid be awarded in accordance with this recommendation: carried; Alderson, Schutt and Mathews voting aye on - roll - call. A bid board consisting of the City Clerk, Purchasing. The same bid board mentioned above having received and considered bids for the purchase of Traffic Line Paint'for the Street Department 1959 operations and said board now recommending the bid of Preservative Paint Company in the amount of $2.17 per gallon for White Paint and $2.57 per gallon for Yellow Paint, it was MOVED by Mathews, seconded by Schutt that said bid be awarded in accordance with this recommendation: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Schutt that Resolution No. C -1655 authorizing the purchase of radio equipment for the Fire Department without calling for bids, be passed as read: carried, Alderson, Schutt and Mathews voting aye.on roll call. RESOLUTION.NO. C -1655, A RESOLUTION authorizing purchase of radio equipment. WHEREAS, on November 5, 1958, pursuant to a call for bids duly made, one bid was received for radio equipment required by the City of Yakima, from Motorola Communications & Electronics, Inc., and, WHEREAS, the specifications in said call for bids contained the following provisions, to -wit: "Bid ouantities may or may not be exact. The City reserves the right to delete any item or quantity and to add to any item for a period of 120 days." and, WHEREAS.,-there has been a rise in prices in the items contained in said bid, and, WHEREAS, there is an appropriation for radio equipment in the 1959 Budget for the Fire Department, now therefore,. BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. That the Purchasing, Agent of the City of Yakima be and he hereby is, authorized to purchase the following: 4 CD/u43GGT -1100C Mob.THP 4 1101B Ace GRD at the prices quoted in said bid from Motorola Communications & Electronics, Inc., without calling for bids. (See Motion. and Caption of Ordinance No. B -2242 below) Moved by Schutt, seconded by Mathews that the City Attorney be and is hereby instructed to draw a renewal lease for Loren H. Miller who now has orchard land leased from the City at the Water Department Reservoir and also prepare the same type lease for Robert F. Tormaschey for the 1959 lease of orchard property at Tahoma Cemetery, both leases to require the payment of 22% of the gross income from said properties to the. City of Yakima: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Schutt that Resolution No. C-1656-providing for the transfer of $800.00 within the Capital Outlay classification of the Irrigation Depart- ment 1959 budget, be passed as read: carried, Alderson Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -16561 A RESOLUTION providing for the transfer of funds within the 1959 appropriation of the Irrigation Department Budget. WHEREAS, a surplus exists in the Machinery and Equipment fund of the Irrigation Department appropriation in the 1959 i?udget, and the funds in the Automotive Equipment of the Irrigation Department appropriation in the 1959 Budget are insufficient, and . WHEREAS, the City Commission deems it in the best interest of the City of Yakima to make the transfer provided herein and the action contemplated is authorized by R.C.W. 35.33.120, now therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. That the sum of $800.00 be and the same hereby is transferred from the Machinery and Equipment account of the Irrigation Department in the 1959 Budget to the Automotive Equipment account of the Irrigation Depa- rtment in the 1959 Budget; all of said accounts being within the Capital Outlay classification in said appropriation. ALDERSON Mayor Bids having been received and considered on the-21st day of January., 1959. by the bid board consisting of the City Clerk, Purchasing Agent and the Superintendent.of Public Works for the purchase of a 112 ton peck -up truck for the Irrigation Department and the Purchasing Agent now advising that a 112 ton truck is not heavy enough for the load and work to be given it, and asking that all bid be rejected and authority granted to cal for new bids for the purchase of a"3/4 ton, 6 cylinder pick -up for said department, it was MOVED by Mathews, seconded by Schutt that all bids received for Ntpurchase of a. 1/2 ton pickup truth be and are hereby rejected and the Purchasing /� ereby authorized to call for bids for the purchase of a 3/4 ton truck for the Irrigation Department, said bids to be received up to the hour of 10 o'clock a.m. on Monday, the 9th day of February, 1959: carried, Alderson,-.Sdhutt and Mathews voting; aye on roll call. The City Engineer now reporting that the bid received from C. P. Peyton, Klamath Falls, Oregon in the amount of $7,111.76 for the construction of West Pierce Street Sanitary Sewer Repair, is in order and acceptable, it was MOVED by Mathews, seconded by Schutt the said bid be awarded and the Mayor and the City Clerk be and is hereby authorized to enter into a contract with said company upon the filing of the proper bond: carried, Alderson, Schutt and Mathews voting aye on roll call. Mayor Alderson upon consultation with the City Attorney ordered that a resolution be prepared recinding action taken through Resolution No. C -1644, adopted January 7, 1959, authorizing the Mayor and City Clerk to enter into a lease agreement for certain parking areas at the Yakima Municipal Airport with Joseph L. O1Brien c /b /a the Airport Parking Lot Company. Mayor Alderson stated that he wished to have this action stricken from the record. Moved by Mathews, seconded by Alderson that Ordinance No. 'B -2242, amending specific sections of the Building Code as adopted by Ordinance No. B -2141, be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. ORDII-,,?ANCE NO. B -22422 AN ORDINANCE amending Section 104 (h) and 4406 (b) of Ordinance No. B -2141 entitled "An Ordinance regulating erection, construction, enlargement, alteration, repair, moving, removal, conversior_, occupancy, equipment, use, height, area and maintenance of buildings and /or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefore; declaring and establishing fire districts, adopting with certain exceptions the Uniform Building Code, 1958 Edition; providing exceptions, penalties for the violation thereof, and repealing all ordinances and /or parts of ordinances in conflict therewith ".
