Mayor Alderson absent. The minutes of the regular meeting of January 14th, 1959 were approved as read. Alderson absent. - An ordinance amending the building code, requiring an inspection fee of -50.00 before a building is moved and prescribing certain safety:,­-regulations, was read by the Uity Clerk and there being verbal. protest to said inspection fee, it was ordered that said ordinance be �iven-:further :consideration by the Building Inspector and others interest- ed in said ordinance. An ordinance amending Ordinance No. B -850 or the Electrical Code providing for certain changes in materials and methods for electrical _ eontracting,;in the `City of Yakima and there being verbal protests to said changes, it was ordered that said ordinance be given further consideration by the Building Inspection and others interested in said ordinance. ?`Roved by Mathews,- seconded by Schutt that Resolution No. C -1650 authorizing an agreement between the City of Yakima and the State Department of Highways, permitting the reloca- tion of the existin_r irrigation water transmission facilities in connection with the construction of a• section of Primary State Highway No. 5, known as Jacobson to Fruitvale Boulevard section, be passed as read: carried, Schutt an,d Mathews voting aye on roll call. Alderson absent. RESOLUTION NO. C -16501 A RESOLUTION authorizing an agreement between the City of Yakima and the State of Washington, Department of Highways for the relocation of the water transmission facilities of the City between Jacobson and Fruitvale Blvd., such agreement shall cancel and supersede the agreement made and entered into the 19th day of November 1958, signed by Joe K. Alderson, Mayor, City of Yakima, and W. E. Schussler, Right of Way Agent, State of Washington Department of Highways. WHEREAS, the State of Washington, Department of Highways has pre- pared plans and specifications for the relocation of primary State Highway No. 5 upon a section known as Jacobson to Fruitvale Blvd., and, WHEREAS, in connection with said relocation it will be necessary for the said Department of Highways to relocate portions of the existing, irrigation water transmission facilities belonging to the City, and, WHEREAS, it is necessary prior to said construction work that an agreement be made - between said Department of Highways and the City permitting the said Department of Highways to enter upon the easement owned by the City, upon which said water transmission facilities are located and to perform such work, now therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. That the Mayor of the City of Yakima be and he is hereby authorized -to enter into an agreement with the State of Washington; Department of Highways allowing said Department of Highways to enter upon the easement owned by the City of Yakima and upon which are located the irrigation water transmission faciliti of said City for the purpose of relocating the same in connection with the construction by said Department of Highways of a section of primary State Highway No. 5, known as Jacobson to Fruitvale Blvd. section. Section 2. That the above mentioned agreement cancel and super- sedes the agreement, with respect to the same subject matter, made and entered into the 19th day of November, 1958, signed by Joe K. Moved by Mathews, seconded by Schutt that Resolution No. C -1651 authorizing the Mayor to enter into an agreement with the Nob Hill Water Company for the installation of a cross connection to be used only during periods of emergency between the City of Yakima and Nob Hill Water Company, be passed as read: carried, Schutt and Mathews voting aye on roll call. Alderson absent. RESOLUTION NO. C -1651, A RESOLUTION authorizing the Mayor to enter into an agreement, with the Nob Hill Water Company for the installation of a cross connection, to be used for emergency purposes only, between the Nob Hill Water system and the City of Yakima domestic water system. WHEREAS, both the (ity of Yakima and the Nob Hill Water Company have water supply and distribution facilities in the western part of the City, and , WHEREAS, it is deemed to be mutually beneficial to provide for a cross connection, to be used only during periods of emergency, between the two above named systems, now , therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. The Mayor of the City of Yakima is hereby authorized to enter into an agreement with the Nob Hill Water Company providing for the installation of said cross connection to be located at Summitview and 44th Ave.,nYakima, Washington, and installed according to plans prepared by the City Engineer. The following motion was read by Commissioner Mathews: "I mover'that the appointment of John Mayo as Public .Works Superintend as provided by Ordinance No. B -2234 be hereby confirmed and the'Clerk directed to administer the oath of office. said motion seconded by Commissioner Schutt; carried, Mathews and Schutt voting aye on roll call. Alderson absent. Commissioner Mathews opened the discussion of where to dump the garbage, stating that we are running out of space at the Sewage Disposal Plant. Mr. Wm. Mullens displayed pictures of dumping operations at the Sewage Disposal Plant and further protested dump- ing at the old burning dump. Mr. R. R. Lewis and Mr. Junker protested dumping garbage at the Airport because of contamination,of wells in the area. Moved by Schutt, seconded by Mathews that we do now adjourn to meet at the hour of 10 o'clock a.m. on Thursday, January 22:,, 1959: carried, Schutt and Mathews voting aye on roll call. The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Schutt and Mathews and City Attorney Arntson present on roll call. Moved by Mathews, seconded by Alderson that Ordinance No. B -2241 amending Ordinance No. B -2095, or the zoning code, be passed as read: carried, Alderson, Schutt and Mathew; voting aye on roll call. ORDINANCE NO. B -22419 AN ORDINANCE adding Section 282, 408, 508, 606, 800 and 1618 and amending.Section 900 and 1606 of Ordinance No. B -2209, "AN ORDINANCE amending Section 212, Paragraph 2 of Section 400, Paragraph 6 of Section 9000 Paragraph 1 of Section 1300 and Paragraph 4 of Section 1409; deleting Section 271 and adding Section 281, Paragraph 15 of Section 400, Paragraphs 10 and 11 of Section 700, Paragraphs 15, 16 and 17 of Section 800, and Section 1617 of Ordinance No. B -2095, establishing zones in the City of Yakima; regulating and limiting the use of buildings and land; establishing use, height area and off - street parking regulations; providing for yards, courts and other open spaces; providing for the adoption of maps showing the boundaries of said zones; pro- viding for a Board of Adjustment; providing for the administration and enforcement of this Ordinance, and fixing penalties for the violation of its provisions; repealing Ordinances numbered B -22, B -35, B -43, B -51, B -71, B -1261 B -1471 B -172 and B -293, and all amendments thereto, and all other Ordinances and parts of Ordinances °in conflict here- with; and declaring an emergen©y." C -16522 BEFORE THE CITY COMMISSION OF THE CITY OF YAKIMA., STATE OF WASHINGTON, IN THE MATTER OF THE VACATION OF that certain alley described as follows, to- wit: the west 140 feet of the east -west alley in Block 91, Town of North Yakima (now Yakima) according to the plat there- of recorded in Volume "A" of Plats, page 10, and re- recorded in Volume "E" of Plats, page 1, records of Yakima County, Washington. RESOLUTION NO. C -1652 35-1 36 JANUARY 21, 1959 A RESOLUTION fixing the time for hearing on petition for vacation of alley. WHEREAS,, a petition has been filed with the City Commission of the .City of Yakima, a municipal corporation, praying for the vacation of that certain alley described as follows, to -wit: now, therefore, The west 140 feet of the east -west alley in Block 91, Town of North Yakima (now Yakimg) according to the plat thereof recorded in Volume "A" of Plats, page 10, and re- recorded in Volume "E" of Plats, page 1, records of Yakima County, Washington; BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That said petition shall be brought on for hearing an determin- ation on Wednesday, the 18th day of February, 1959, at the hour of 10:00 o +clock in the forenoon on said day at the o"fice of the City Commission of the City of Yakima, at the City Hall in Yakima, Yakima County, Washington, or as soon threafter as the same may be heard, and that notice of such hearing be given as provided by law. day of January, 1959. ALDERSON Mayor Moved by Mathews, seconded by Alderson.that the City Purchasing Agent be and is hereby authorized to call for bids for the purchase of one 22 ton truck for Dump Body Mounting for the Street Department said bids to be received and considered by the bid board at the hour of 10 o1clock on Monday the 9th day of February, 1959: carried, Alderson and Mathews voting aye on roll call. Schutt not voting. Commissioner Mathews asked to continue the discussion on the dumping of garbage, stating that we must continue at the old burning dump or be allowed to go forward with the landfill method at the airport. He also stated that rates would have to be increased to haul garbage to any of the County Dumps outside the City of Yakima. He asked the City Commission to pass on the following resolutions: "RESOLUTION No. , WHEREAS, the City of Yakima has unimproved land located upon the Yal�ima Municipal Airport, and, WHEREAS, it is in the best interests of the City of Yakima to improve and unimproved land by filling the same up to the level of the balance of the Airport so that the same may be used for. sites for the development of affiliat- ed airport industries, 'and, WHEREAS, said filling and reclamation of said unimproved land can be obtained by the City of Yakima through the means of locating sanitary land- fill thereon, and, WHEREAS, in January, 1957, the Yakima City Engineer made a report to the City Commission with respect to the location of such sanitary landfill upon the airport premises, now, therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: That as soon as road restrictions are removed on Ahtanum Road the City of Yakima shall begin to haul the garbage from said City to unimproved sites upon the Yakima Municipal Airport and shall use the same in the construction of a sani- tary landfill; said sanitary landfill operation to be conducted in a manner approved ?.,... 'by the State Health Department and other state regulatory bodies that might be con- cerned therein. WHEREAS, the City of Yakima has completed the land- fillinE operation at the industrial. waste site and further operations are no longer economic: ally feasible at this time, and WHEREAS, the City of Yakima must have a disposal site for the cityls garbage and refuse, now, therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. 'That the Commissioner of Public Works be and he hereby is directed to reinstitute garbage disposal operations at the old burning garbage dump in the customary manner. Mayor Alderson stated The amount of extra money you (Commissioner Mathews) have spent on these two landfill operations - this amount would enable you to several miles without additional cost. A petition for annexation presented to the Yakima County Board of Commissioners by J. A. Thompson, Walter Laton et al, said petition calling for an election to be held among the qualified voters within the area to be annexed, said property lying between East Lenox and East Mead and the present boundary on the weatside of the railroad to approximately 350 feet east of Fair Avenue, and the Board of County Commissioners now submitting said petition to the City Commission for approval in the event that the election carries, it was MOVED by Alderson, seconded by Schutt that Resolution No. C -1653 approving the above proposed action, be passed as read: carried, Alderson and Schutt voting aye on roll call. Mathews absent. RESOLUTION NO.
