The minutes of the :regular meeting of November 19, 1958 and adjourned meeting thereof were approved as read. A petition having been filed by C. W. Keltner et al praying for the annexation of a 7.57 acre tract west of what would be.44th Avenue extended between West Chestnut Street and-West Walnut Street and the City Engneer.now reporting that Mr. G. A. Drake and Lulu E. Drake have filed a protest against said annexation and that the Drake property constitutes 53% of the assessed valuation.of proposed annexation, it was MOVED by Mathews seconded by Schutt that said annexation proceedings be dropped since the statutory re- quirement for annexation is 75% of the assessed value: carried, Alderson, Schutt and Mathews voting aye on roll call. The Supervisor of the Irrigation Department requesting the elimination of the:new library at Third and "B" Streets and a triangular block bounded by South Second and Third Streets Adams and Pacific now occupied by a bowling alley from the Irrigation Maintenance Assessment Rolls, it was MOVED by Mathews, seconded by Schutt that said'request be re- ferred to the City Attorney for the necessary ordinance: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Schutt, seconded by Alderson that Resolution No. C -1632 authorizing the compro- mise settlement of a condemnation action for the acquisition of easements described as parcel 1 belonging to Sam Christoff and Ganna C. Cristoff, Parcel 2 belonging to Joe and Jane Doe Wong, Parcel 3 belonging to Thomas H..Pollock land Lilli Ann Pollock, Parcel 4 belonging to Fred Batt and June Marie Batt and Marie Rowley easement, said easements being for the construction, operating and maintaining of an approach lighting system for the Municipal Airport, be passed as read: carried, Alderson, and''Schutt voting aye on roll call. Elathews voting ray. RESOLUTION NO. C -1632, RESOLUTION authorizing compromise settlement of a condemnation for constructing, operating and maintaining an action for the acquisition of easements approach lighting system for the Yakima Municipal Airport; authorizing the acceptance of an easement deed from Marie Rowley for the aforementioned purpose; authorizing the Mayor and City Clerk to execute an agreement on behalf of the City with Thomas H. Pollock; and authorizing payment of attorneyls fees and costs in connection with the acquisition of said easements. WHEREAS, the City of Yakima has sought to acquire certain per- petual easements for the purpose of constructing, operating and maintaining an approach lighting system at Yakima Municipal Airport; and WHEREAS, on May 14, 19582 the City filed its petition and notice of condemnation (Cause No. 42633 in the Superior Court of Yakima County) for the acquisi- tion of easements for the purposes mentioned hereinabove, said condemnation action being taken pursuant to Ordinance No. B- 2155., passed and approved by the City Commission on April 23, 1958; and WHEREAS, the City has,.after trial on the merits, taken judgment with respect to parcel 4, the court decreeing the fair and just compensation to be $1,500.00; and WHEREAS, the City of Yakima has heretofore retained the services of Kenneth C. Hawkins to represent the City in this matter, and whose fees in connection herwith are as follsbws: Parcel 1, respondents Christoff 200.00 Parcel 21 respondents Wong 200.00, Parcel 3, .respondents Pollock 200.00 Parcel 4, Respondents Batt 300.00 Rowley easement 100.00 WHEREAS, it is deemed to be in the best interests of the City to enter into a compromise settlement with the owners of Parcels 1, 2 and 3; to accept an easement deed from Marie Rowley; and to enter into an agreement with Thomas H. Pollock for removal of trees and placement of obstruction lights adjacent to Station 16 plus 00; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMISSION OF THE CITY OF YAKIMA: Section 1, That Kenneth C. Hawkins, acting for and on behalf of the City of Yakima, is hereby authorized and directed to compromise and settle said condemnation action for the following amounts: ° Parcel 1 $162000.00 Parcel 2 82000.00 Parcel 3 3 400.00 said amounts to be in. full payment for the perpetual easements acquired as to parcels 1 and 2, and full payment for the fee simple title taken with respect.to parcel 3. Section 2.. That the Mayor is hereby authorized and directed to accept the easement deed from Marie Rowley, said deed conveying a perpetual easement to the City of Yakima for the purposes set forth hereinabove, for the stated consideration of $4,000.00. Section 3. That the Mayor and City Clerk are hereby authorized to execute on behalf of the City an agreement with Thomas H. Pollock for the removal of trees and placement of obstruction lights adjacent to Station 16 pluss 00. Section 4. That upon receipt of the Court's decree of appropri- ation, the City Treasurer is hereby authorized and directed to pay the aforementioned sums into the registry of the Court in and for Yakima County for distribution to the F_ 112 NOVEMBER 26 1 8 = owners of record of Parcels 11 2 and 3. That upon receipt of the executed easement deed from Marie Rowley, the City Treasurer is hereby authorized and directed to pay the sum of $4,000.00 to said Marie Rowley, said amount being the stated consideration there- in. The City Treasurer is further authorized and directed to pay the sum of $12500.00 into the reistry of the court in and for Yakima County for distribution to the owners of record of Parcel No. 4. Section 5. That the City Treasurer is hereby authorized and direct ed to pay to Kenneth C. Hawkins the sum of $1,000.00 for legal services rendered in con- nection herewith and to pay necessary costs incurred and advanced by said Kenneth C. Hawkins with respect to the within matter. C -1633, BEFORE THE CITY COMMISSION OF THE CITY OF YAKIMA, STATE OF WASHINGTON IN THE MATTER OF THE VACATION OF certain dedicated public utility easements across the following described property, to -wit: Lot 1, of Rice - Dibbert Addition, according to the official plat thereof recorded in Volume "Q" of Plats, page 8, records of Yakima County, Washington; and That part of Lot 1, Glenview, according to the official plat thereof recorded in Volume "Q" of Plats, page 28, records of Yakima County, Washington, described as follows: Beginning at the Southeast corner of said Lot 1; thence North along the East line thereof.a distance of 77 feet 4 inches; thence Southwesterly 53 feet, more or less, to a point in a Westerly line of said Lot 1, 74 feet Northwesterly and measured along the Westerly line from the Southwest corner of said Lot 1; thence South- easterly along said Westerly line 74 feet to the Southwest corner of said Lot 1; thence East 6,feet to the point of beginning, said property being situated in Yakima, Yakima County, Washington. "I move that it is the order of the commission that no garbage, waste material or refuse be dumped at the Airport or upon the Airport property until such order is recinded by commission action."
