Commissioner Schutt absent. The minutes of the regular meeting of September 17th, 1958 and recessed meetings thereof were approved as read. This being the time for hearing on the assessment_ roll for L.I.D. No. 865, being the East King & Maryland Surfacing district, and there being no protests in writing or otherwise, it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -2203 con- firming said assessment roll and every part thereof, be passed as read: carried, A Alderson and.Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -2203, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 865 as created and established by Ordinance No. B -2167 of the Ordinances of the City of Yakima. This being the time for hearing on the assessment roll for L.I.D. No.. 866, being the Elm Street Surfacing District, and-there being no protests in writing or otherwise, it was MOVED by Mathews, seconded by Alderson that Ordira nce No. B -2204 confirming said assessment roll and every part thereof, be passed as read: carried, Alderson and Mathews. voting aye on roll call. Schutt absent. ORDINANCE NO. B -2204, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 866 as created and established by.Ordinance No. B -2176 of the Ordinances of the City of Yakima. A petition having been filed by Neal D. Turner et al, praying for the annexation of property lying between West Chestnut Street on the North and West Walnut Street (Home Drive) as extended on the south and the east and west boundaries as extended of that property which abuts Bel Air Drive and lying within the southeast quarter of the south- west quarter of Section 22, Township 13 North, Range 18 E.W.M., said property being contiguous to the City of Yakima, it was MOVED by Mathews, seconded by Alderson that said petition be accepted and the City Clerk be and is hereby authorized to give notice of hearing by publication and posting on the property,:: -as "required by law, for the 15th day of October, 1958 at the hour of 10 o'clock a.m.: carried, Alderson, and Mathews voting aye on roll call. Schutt absent. Moved by Mathews, seconded by Alderson that the City Clerk be and is hereby authorized to call.. for bids for the .purchase of 50 tons more of less of coal for city use, said bids to be received on Wednesday the 8th day of October, 1958 up to the hour of 10' otclock .a.m.: carried, Alderson and Mathews voting aye on roll call. Schutt absent. Moved by Mathews, seconded by Alderson that Resolution No. C -1622 authorizing the Street Department to survey defective sidewalks in the City of Yakima and notifying the abutting property owners of their responsibility of maintaining said sidewalks.and authorizing the City Street Department to furnish labor and equipment at no charge for the repairs of said sidewalks be passed as read: carried, Alderson; -.and Mathews voting aye on roll call. Schutt absent. RESOLUTION NO. C -1622, WHEREAS, many old, existing sidewalks in the City of Yakima have become defective and dangerous through settleing, the action of weather or have been disturbed by tree roots and: WHEREAS, the abutting property owners, under law, are charged with the burden of maintaining the sidewalks in a safe condition and: WHEREAS, the City of Yakima may become liable for injuries sus- tained by reason of accidents odcurring on defective sidewalks of which it has notice and: WHEREAS, abutting property owners at such loddl'oris where such defective sidewalks may exist should be immediately put on notice of their responsibility and WHEREAS, it is deemed advisable for the City of Yakima to parti- cipate in,the eliminating of defective and hazardous sidewalks, now THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: 1. That the Street Department of the City of Yakima be, and it hereby is, authorized to make a survey of defective sidewalks in the City of Yakima; 2. That upon the determination of defective sidewalk conditions the abutting property owners charged with responsibility of maintaining the same shall be forthwith notified in writing of such defective conditions and directed to have the same repaired; 3. That in each such case where repair is ordered by the Street Department of the City of Yakima, at the option of the abutting property owner, will furnish all labor and. equipment necessary to repair the same at no charge to the abutting property owner; 4- In no event shall the City of Iakima pay for the materials used in such repair and the same shall be paid for by the abutting property owners.
