The minutes of the regular meeting of September 10, 1958 were approved as read. This being the time for receiving bids for the purchase of concrete sewer pipe with rubber joints and wyes for sewer construction and the following bids having been recei Yakima Cement Products Union Pipe Company $5,115.00 $5,027.17 it was MOVED by Mathews, seconded by Schutt that said bids be referred to the ,City " Engineer for recommendation: carried, Alderson, Schutt and Mathews voting aye on roll call. A petition praying for the annexation of property located on Lincoln Avenue and 23rd Avenue having been filed August 27, 1958 by Pibatti Brothers and this being the time fixed for hearing on said petition and there being no objectlions in writing or otherwise to said annexation, it was MOVED by Mathews, seconded by Schutt that Ordinance No. B -21 annexing said property and every part thereof, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO.�B -21990 AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima. An ordinance providing for the borrowing of $1,2002000.00 and issuing and selling negotiable general obligation bonds for the purpose of constructing overpasses on Lenox Avenue and on "C" Street and for certain improvements to city streets and arterials and providing for the submission of this proposition of incurring such indebtedness to the qualified voters of the (%Ity of Yakima having been read twice prior to this meeting and laid on the table for one week each time and now having been read�for the third time by caption only, it was MOVED by Mathews, seconded by Schutt that Ordinance No. B -22002 be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -2200, AN ORDINANCE of the City of Yakima, Washington providing for the borrowing of $1,2000000.00 and issuing and selling negotiable general obligation bonds' for the purpose of constructing a railroad grade separation at Lenox Avenue, a railroad grade separation at "C" Street, and for certain improvements to city streets and arter "lals, to be a part of a general plan, a portion of the cost of which shall be paid by Local Improvement District assessments, Federal Aid funds where.impr.ovements are made on routes as approved now or in the future; the general obligation bonds to be payable by annual tax levies without limitation as to rate or amount; and providing for the sub- mission of the proposition of incurring such indebtedness and issuing such general -obligation bonds to the qualified electors of the city in a special election to be held therein on November 4, 1958; and declaring an emergency. A petition having been filed with the City Clerk requesting that a proposed measure known as "Amendments to the City Charter amending Articles 2 and 3 thereof and providing for the government of said City under the Council- Manager and repealing Articles 2 and 3 of said charter as same now exists" be submitted to the qualified voters of the City of Yakima, and the City Clerk now certifying that the number of genuine signatures of qualified voters is in excess of 2,790 or more than 15% of the total number of votes cast at the last- preceding general state election held November 6,.1956 as required by law, it was MOVED by Alderson, seconded by Mathews that Resolution No. C -1619 authorizin the City Clerk to certify to the County Auditor the caption of the ballot with referrenc to the Charter Amendments for the General Election to be held November 4, 1958, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1619, WHEREAS, a petition has been filed with the City Clerk of the City of Yakima requesting that a proposed measure known as "Amendments to the City Charter of the City of Yakima, Washington, amending Articles 2 and 3 thereof and provid- ingfbr the government of said City under the Council- Manager plan and repealing Articles 2 and 3 of said charter as same now exist ", be submitted to the qualified voters of the City of Yakima, Yakima bounty, Washington for their approval or rejection and that a special election be held for such purpose on the 4th day of November, 1958, anJ WHEREAS, the said City Clerk has duly examined said petition in accordance with law and the City Charter and has certified to the City Commission of the City of Yakima that said petition has been signed by qualified voters of the City of Yakima in excess of the number required by the City Charter and in excess of a:. number of votes cast in the City of Yakima at the last preceding general state election, to -wit: the general state election held November 6, 1956, and WHEREAS, the City'Commission is of the opinion that a special election should be held on the 4th day of November, 1958, for the purpose of submitting said proposed measure to the qualified voters of the City of Yakima for their approval or rejection. NOW, THEREFORE, EE IT RESOLVED BY THE CITY COMMISSL ON OF THE CITY OF YAK IMA : Section 1. That a special election be held on the 4th day of November, 1958, in the City of Yakima, Washington, for the submission to the qualified voters thereof of a proposed measure known as "Amendments to the City charter of the City of Yakima, Washington, amending Articles 2.and 3 thereof and providing for the government of said city under the Council- Manager plan and repealing Articles 2 and 3 of said charter.as same...now exist" for their approval or rejection. Section 2. That the ballot title to be used at said special election for the submission of said proposed measure shall be substantially in the following form: "PROPOSITION Council- Manager Charter Amendments Shall Articles 2 and 3 of the City Charter of the City of Yakima be amended to provide for the government of said City under the Council - Manager plan, effective the first Monday in June, 1959, and to provide for the election of a City Council? 3'89 SEPTEM EER 17, 1958 For C7 Against Z-77711 Section 2. That the City Clerk shall forthwith certify to the County Auditor of Yakima County the foregoing caption and statement of ballot proposition to- gether with a full and complete.copy of the proposed measure amending the City Charter, ADOPTED BY THE CITY COMMISSION this 17th day of September, 1958- ATTEST: J. ALDERSON City Clerk Mayor Members of the Citizens Committee for Council Manager Government and members of a Labor group being present and the Labor group asking that an amendment also be added to the Ci Charter making it possible to elect the councilmen under the Council Manager Form of Government under the ward system, a thorough discussion of the Council Manager Amendment and the ward system ensued. The Mayor informed the groups that it i.s-his_ understanding that °the City Commission could not, under its power, put the amendment on the ballot of the special election of November 4, 1958 and that it must be done by petition, or the City Commission could put it on the ballot at the next Municipal General Election. The City Attorney "was ordered to instruct the City Commission as to whether or not they could put the matter of Ward system on the ballot at this time. Moved by Mathews, seconded by Schutt that Ordinance No. B -2201 rezoning property at 312, 314 and 318 South l2th Avenue from R -2 Two Family Residential to B -1 Modified Business zone and property at 108 West Mead Avenue from R -2 Two Family Residential to M -1 light Industrial Zone, said rezoning recommended by the Planning Commission, be passed as read carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -22019 AN ORDINANCE rezoning certain specific property situate in the City of Yakima, County of Yakima, Washington; and declaring an emergency. . An ordinance providing for the expenditure of $1600.00 for the purchase of law books for the Legal Department having -had., its first reading at the regular meeting of the City Commission on September 109 1958 and now being read again by caption only, it was MOVED by Mathews, seconded by Schutt that Ordinance No. B -2202 providing for said expenditure, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -22021 AN ORDINANCE providing for the expenditures of funds not budgeted for the office equipment account of the Legal Department: to -wit: Law books; and de- claring an emergency. Moved by Mathews, seconded ,by Schutt that we do now recess to meet at the hour of 2 :00 d otclock p.m. on this same ay: -carried, Alderson, Schutt and Mathews voting aye on roll call. RECESSED MEETING, WEDNESDAY, SEPTEMBER 17, 1958 2 OICLOCK P.M. The City Commission met pursuant to recession, Mayor Alderson and Commissioner Mathews and City Arntson present on roll call. Commissioner Schutt absent. _ The City Attorney having obtained the information asked for as to proceedure for putting an amendment to the City Charter on the special election called for November 4, 19580 he reported that he had talked by phone to the Attorney Generals office in Olympia and searched the laws of the State for his information and that in accordance.with his find- ings, the City Commission, by its own power, could not put.this issue on the special election ballot, but they could put it on the ballot at the next regular General City Election and that the only way this amendment could be placed on the ballot at this time would be by petition of the voters and there is not time enough to do this. With this information the Labor group withdrew their request to place the ward system for electing Councilmen under the Council Manager form of government on the ballot. RECESSED MEETING, THURSDAY, SEPTEMBER 18, 19582 2 OtCLOCK P.M. y The City Commission met pursuant to recession, Mayor Alderson, Commissioners Schutt and Mathews present on roll call. City Attorney absent. Moved by Mathews, seconded by.Schutt that Resolution No. C -1620 authorizing the City Clerk to certify to the County Auditor the caption of the ballot with reference to a $1,200,000.00 bond issue for the construction of two Overpasses and for certain improve- ments to certain streets as per plan filed with the City Clerk by the City Engineer, be passed as read: carried, Alderson, Schu tt and Mathews voting aye on roll call. RESOLUTION NO. C -16202 WHEREAS, on September 17, 1958, Ordinance No. B -2200, relating to the Lenox Avenue and "C" Street railroad grade separations and street improvement bond issue was passed and approved by the City Commission of the City of Yakima, and a certified copy thereof was duly transmitted to the County Auditor of Yakima County; and said ordi.nance•provides for a special election to be held thereon on November 42 1958, and prescribes the form of ballot proposition therefor; Now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That an urgent need exists for funds for the purpose of con- structing railroad grade separations at Lenox Avenue and at "C "'Street referred to 1 1 1 1 ::391 1 SEPTEMBER 17 o, 1958 as the "Lenox Avenue Overpass and "C" Street Overpass" and for certain improvements to city, streets and arterials; and that a special city election shall be held at the pollin places in the City of Yakima on Tuesday, November 4, 1958, between the• hours of 8:00 o'clock a.m.'and 6:00 ofclock p.m. for voting upon the said proposition and for approval or disapproval of-said railroad grade separation and street improvement bond issue. Section 2. That as provided in Section 6 of said Ordinance No. B -2200 the caption of the ballot with reference to said Lenox Avenue and "C" Street railroad grade separations and street improvement bond issue shall be as follows: PROPOSITION NO. LENOX AVENUE OVERPASS, "C "'STREET OVERPASS AND STREET IMPROVEMENT BONDS - 1,200,000.00 Shall the City of Yakima, Washington issue its general obligation bonds in the principal sum of $1,200,000.00, said bonds to bear interest at a rate of not to exceed 6% per annum, to mature in.from two to ten years from date of issue, and to be payable both principal and interest by annual tax levies tote made without limitation as to.rate or amount, for the purpose of constructing a railroad grade separation at Lenox Avenue and a railroad grade separation at "C" Street and for making certain improvements to city streets, arterials, and to be a part of a general plan prepared by the City Engineer under date of September 6, 1956, amended August 27, 1958, and on file in the office of the City Clerk, all as more specifically provided in Ordinance No. B -2200 of the City, passed and approved this 17th day of September, 1958- BONDS, yes. BONDS, no Section 4. That the City Clerk shall forthwith certify.to the County Auditor of Yakima County the foregoing caption and statement of ballot proposition. ALDERSON City Clerk Mayor Bids having been received on the 17th day of September, 1958 for the purchase of concrete sewer pipe with rubber joints and wyes for sewer construction and referred to the City Engineer for recommendation and it now being recommended that the bid of Union Concrete Pipe totaling $5,027.17 is the lowest and best bid, it was MOVED by Mathews, seconded by Schutt that said bid be awarded: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Schutt, seconded by Mathews that we do now recess and meet at the hour of 9 o'clock a.m. on Friday, the 19th day of September for the purpose of considering the - preliminary budget for the ensuing year: carried, Alderson, Schutt and Mathews voting aye on roll call. RECESSED MEETING, FRIDAY, SEPTEMBER 19, 1958, 9:000CLOCK A.M. The City Commission met pursuant to recession, Mayor Alderson, -Commissioner Schutt and Mathews present on,roll call. City Attorney absent.: Moved by Schutt, seconded by Mathews that Resolution No. C -1621 adopting the preliminary budget for the City of Yakima for the ensuing fiscal year and directing the City Clerk to give.notice that the City Commission will meet on the 6th day of October, 1958 at the hour of 10 o'clock a.m. for the purpose of fixing the final budget was read by the City Clerk. The estimated revenues for 1959 were read by total only. Ala la recapitulation of expense was read by totals only since the detailed budget was not available. Moved by Schutt, seconded by Mathews that Resolution No. C -1621 adopting the 1959 Preliminary Budget be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -16210 WHEREAS, There has been submitted to the City Commission of the City of Yakima, Washington, a budget co vering the detailed estimates of all expenditur proposed to be made by the City of Yakima for the ensuing fiscal year, and a statement of the probable revenue from sources other than Taxation for the ensuing'fiscal year, in the manner and form prescribed by law; WHEREAS, the same has been considered by the City Commission in detail and such revisions and additions made as had been deemed necessary; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA: That the aforesaid preliminary budget be and the same is hereby adopted and approved as the preliminary budget for the City of Yakima for the ensuing fiscal year, and the City Clerk is hereby directed to give notice that said preliminary budget has been completed and placed on file, and a copy thereof will be furnished any taxpayer who will call at the office of the City Clerk therefor, and that the City Commission of the City of Yakima will meet on the 6th day of October, 1958s at the offices of the City Commission in the City Hall, at the hour of 10 A.M. for the purpose of fixing the final budget and making the tax levies and notifying any taxpayer that he may appear at said meeting and be heard for or against any part of said budget and said notice shall be published once each week for two consecutive weeks immediately following the adoption of said preliminary budget.
