AUGUST 61 1958
The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews and City Attorney Arntson present on roll call.
The.minutes of the regular meeting of July 30, 1958 were approved as read.
Moved by Mathews, seconded by Schutt that Resolution No. C -1613 fixing the date and time
for hearing at the hour of 10:00 a.m. on Wednesday the 27th day of August on the
petition filed by Rachel A. Whitaker, said petition praying for the vacation of a por-
tion of. Lots 47, 48 and 49 of ST. PAUL ACRE LOTS; be passed as read: carried, Alderson,
Schutt and Mathews voting aye on roll call.
/RESOLUTION NO. C -1613, A RESOLUTION fixing the time for hearing on the petition for
Vacation of those parts of Lots 47, 48 and 4.9 of St. Paul Acre Lots of Yakiiia County,
according to the official plat thereof.
WHEREAS, a Petition has been ffiled.with the City Commission of
the City of Yakima, a municipal corporation, praying for the vacation of all of the
property described as Follows, to wit:
Those parts of Lots 47, 48 and 49 of St. Paul Acre Lots of
Yakima County, according to the official plat thereof now on
file and of record in the office of the Auditor of Yakima
County, being a strip of land 50 feet in width lying east of
and adjacent to and parallel with the westerly boundary line
of said lots extending southerly to a point 19 feet south of
the north line of Lot 42 of said St. Paul Acre Lots extended;
and the south 31 feet of-Lot 41 of.said St. Paul Acre Lots -
extended east to the center line of Clark Street vacated,
and. that pa=nt of Lot 47 of said St. Paul Acre Lots lying within
50 feet south of the line which is 31 feet north of the-'
south boundary line of Lot 41 of said St. Paul Acre Lots
extended, -and the north 19 feet of Lot 42 of said St. Paul
Acre Lots extended to the center line.of Clark Street vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE

TbLat said Petition shall be brought on for hearing and determin-
ation on Wednesday the 27th day of August, 1958,.at the hour of 10:00 a.m., at the
office of the City Commission of the City of Yaki ,,a at the City Hall,. Yakima, Yakima
County, Washington, or as soon thereafter as the same may be heard, and that notice of
such hearirx; be given by posting by the City Clerk in three of the most public places
in the city, and a like notice in a conspicuous place on the street sought to be vacated
as provided by law.

The Planning Commission recommending that the zoning code be amended with regard to
Service Stations and an ordinance having been submitted and considered at. previous
meetings of the City Commission and 'set aside for,_further,.study and now being brought

on for further consideration, it was MOVED by Schutt, seconded by Mathews that said
ordinance be referred back to the Planning Commission with the following recommendationE
Commissioner Mathews recommending that Service Stations be restricted to B -3 Zone;
Mayor Alderson recommending t'b. Unless separated there from by a street, alley,
`.other public way, no service station building.stall hereafter be erected or
located within one hundred fifty (150) feet of any school, park, playground,
hospital, church or any of the residential zones. Existing service stations,
otherwise conforming and located in this zone, shall not be subject to the re-
quirements of this paragraph. ":

An Ordinance providing for a full time City Attorney and increasing the annual salary
of said City Attorney-to $ $10,000.00 per year was read in its entirety and laid on the
table to be read and considered at the next regular meeting of the 'ity Commission,
since said ordinance is declared to be an emergency.
Moved by Schutt, seconded by Mathews that Resolution No. C -1614 providing for the
transfer of $1,666.67 be transferred from the "Assistant City Attomy item within the
1958 budget to the City Attorney item, be passed as read: carried, Alderson, Schutt
and Piathews voting aye on roll call.
RESOLUTION? NO. C- 1614, A RESOLUTION providing for the transfer of funds within the
1958 appropriation of the Salary Fund of the Legal Department.
WHEREAS, the 1958 Budget provided for an annual salary of
6,0.00.00 dollars for a City Attorney on a part,time basis, and for an annual salary of
84;500.00 dollars for an Assistant City Attorney on a part time basis, and
/ WHEREAS, the City Commission, by proper ordinance, has changed
the employment of a City Attorney to a full time basis and has increaded the annual
salary of the posistion of City Attorney to $10,000.00 dollars, and
WT EREAS, there are sufficient funds within the Salary Fund of
the Legal Department to increase said annual salary and the City Commission deems it in
the best interest of the City to make the transfer provided herein, and
WHEREAS, the actions contemplated herein is authorized by
R.C.W. 35.33.120
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE.
CITY OF YAKIMA,
Sectionl. That the sum of $1,666.67 dollars be transferred
from the "Assistant City Attorney" item within the 1958 appropriation of the Legal
Department to the "City Attorney" item in said appropriation, all of said items being
within the Salaries classification in said appropriation.
Section 2. That the City Treasurer is hereby authorized and
directed to make the aforementioned transfer provided for herein.

to call for bids for eleven identifying lights for alarm boxes for the Fire Department,
said bids to be received up tbrthe hour of 10 o'clock a.m. on Wednesday the 20th day of
August, 1958: carried, Alderson,.Schutt and Mathews voting aye on roll call.
Moved by Mathews, seconded by Alderson that the City Clerk be and is hereby authorized
to call for bids for a new four inch centrifugal /portable gasoline powered pump for the
Water Department: carried, Alderson, Schutt an` Mathews voting aye on roll call.

it was MOVED by Mathews, seconded by Alderson that said work be accepted as recommended
bye the City Engineer and the City Clerk be and is here by authorized tp draw the
necessary warrants in payment of said claims: carried, Alderson and Schutt voting aye
on roll call.
Fischer & Porter Company having filed with the City of Yakima, a check in the amount of
$485.92 or 5% of the total value of their bid sutmitted.in connection with the purchase
of magnetic Flow Meters, said amount to be forfeited on failure to deliver said meters
on or before May 30, 1958 and the City Engineer advising that the meters were received
on or about July 1, 1958, it was MOVED by Mathews, secor.ed by Schutt that this check
be accepted as a forfeiture and the City Treasurer be and is hereby instructed to credit
said amount to the Water Sewer Fund, carried, Alderson, Schutt and Mathews voting aye on
roll call.

ADJOURNED MEETING, WEDNESDAY, AUGUST 7, 1958, 11:00 A.M.
The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Schutt
and Mathews and City Attorney Arntson present on roll call.
An ordinance increasing the salary of the Building Inspector and providing for the
transfer of funds within the 1958 budget to'take care of the additional salary and de-
claring an emergency due to the fact that it is impossible to obtain the services of a
qualified person to fill the position, was read in its entirety and laid on the table
to be read and'considered at the next regular meeting of the City Commission one week
from this date:
Moved by Schutt, seconded by Mathews that we do now adjourn to meet again in regular
session at the hour of 10:00 a.m. on Wednesday the 13th day of August, 1958: carried,
Alderson, Schutt and Mathews voting aye on roll call.
