No City Attorney present. The minutes of the regular meeting; of July 2.3, 1958 and the adjourned.meeting thereof, were approved as read. Bids having been received July 23, 1958 for the purchase.of two used four wheel drive vehicles for the Water Department and the Purchasing Agent and Street Engineer now recommending the purchase of the 1957 Dodge offered by Bell Wyman at the total cost r e d' th ^t all other bids be rejected of �p2474.83 Including sales tax and further recomm n ing u � and authority be given to purchase one other vehicle on the open market, cost not to exceed $1500.00, it was MOVED. by Schutt, seconded by Mathews that said recommendations be accepted and the 1957 Dodge offered by Bell Wyman be purchased and the two bids received from Inland Motor Company be and are hereby rejected: carried., Alderson, Schutt and Mathews voting aye on roll call. Moved by Schutt, secorJ ed by Mathews that the Street Engineer be and is hereby authoriz- ed to buy, one other 4 wheel dirve vehicle the cost of which is not to exceed $1500.00: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Mathews, seconded by Schutt that Resolution No. C- 1611, being a resolution of . ntention to improve Forty -first Avenue and other streets and the alley in .Block 352 :r Yordyts Supplemental Addition by constructing concrete curbs and gutters and asphaltic fixing surfacing and fixin the date of hearing at the hour ,of 10 o'clock on Wednesday the 20th day of August, 1958, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1611, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA,: That it is its intention to improve the following streets by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with any necessary'drainage features: Forty -first Avenue from Chestnut to a point approximately 225 feet North of Barge Avenue Barge Avenue from 42nd Avenue to 41st Avenue Cul -de -sac on North 38th Avenue between Summitview and Lincoln Avenue , That it is also its intention to improve the following alley by grading, ballasting, and surfacing with asphaltic concrete: Alley in Block 352, Yordy's Supplemental Addition That it is also its intention to improve the following street by constructing concrete curb and gutter: 40th Avenue South. from Tieton Drive to a point approximately. 210 feet South, and'adjacent to Lot 1 of Walnut Grove Addition. Said proposed district is to embrace all property adjacent to the above improvements which is subject to assessment for the cost of said improvements as provided by the laws of the State of Washington. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washing -' ton, at the hour of 10 o'clock on Wednesday, the 20th day of August, 1958, which time and place are hereby fixed for the hearing of all matters relating to said proposed im- provements, and for determing the method of payment for said improvements; and the City Clerk is herby directed to give due notice of said hearing and of the intention to make the afore:s.aid improvements. All costs and expenses in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by laws and as above described. The City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other infor- mation required by law to be by.h.im submitted; all of said improvements to be construct - edin full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. ALDERSON Mayor A claim for damages in the amount of $77.73 having been timely filed by Mrs. Letha Yeigh said damages arising from injuries sustained when claimant fell on a sidewalk in front of 305 South 4th Street and the City Commission finding this to be a justifiable claim, it was MOVED by Mathews, seconded by Schutt that Resolution No. C -1612 authorizing pay- ment, be passed as read:. carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -16121 WHEREAS, a claim for damages has been timely filed against the City of Yakima by Letha Yeigh, in the sum of $77.73 arising from injuries sustained when claimant fell on a sidewalk within the City of Yakima on or ato ut May 16, 1958, and WHEREAS, it is deemed to be in the best interests of the City of Yakima to allow said claim; NOW THEREFORE, BE IT RESOLVED FY THE CITY COMMISSION OF THE CITY OF YAKIMA That the claim•of Letha Yeigh in the sum of $77.73 be, and the same is hereby, allowed and the City Treasurer is hereby authorized and directed ,'3'75 ''37e JULY 30, 1958 to issue a warrant in payment of said claim; provided, however, that the Treasurer shall not issue said warrant until a Release is filed with the pity Clerk by the above - named claimant relieving and releasing the City from any additional and further liability arising-, out of the aforementioned accident. No. 861 being the 24th Avenue Irrigation District, be passed as read: carried, Alderson, Schutt and Mathews voting; aye on roll call. ORDINANCE NO. B -2190, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local. Improvement District No. 861, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. A petition praying for the vacation of a portion of 20th Avenue South lying adjacent to Lot 11 of .Chase Hill. Residence Tracts having been filed and a hearing having been held on the 9th day of July and the ordinance providing for said vacation, having been read, was set aside until, the regular meeting of July 16, 1958, at which time it was b.rddred to be ;-held -in abeyance for further consideration at that time, and the attorneys representing; the property owners now proposing that the vacation be granted subject to easement for foot traffic, it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -2191 broviding for said vacation, be passed as read: carried, Alderson, and Mathews voting aye on roll call. B -2191, AP, ORDINANCE providing for the vacation of Twentieth Avenue South lying adjacent to Lot 11 of Chase Hill Residence Tracts as shown on the plat of said Addition. Moved by Mathews, seconded by Alderson that ordinance No. B -2192 relating to the munici- pal water and sewerage systems and providing for an alternative procedure for extension, expansion and addition of said systems and amending Ordinance No. E -606 known ast the Water Code and repealing Ordinance No. B -1922 and certain sections of Ordinance No. B- 1462,be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt not voting. ORDIIA NCE NO. B -2192, AN ORDINANCE relating to the municipal water and sewerage systems and providing for an alternative procedure for extension, expansion, and addition of said water and sewerage systems, and providing for the method of financing,.thereof, and re- pealing Ordinance No. B -1922 and Sections 11 f and 11 m of Ordinance No. B -606, as amended by Ordinance No. B. -1462. Max Vincent, Attorney at Law filed with the City Commission a petition praying for the vacation of those parts of Lots 47, 48 and 49 of St. Paul Acre Lots of Yakima County, Petitioner being Rachel A. Whitaker.. A resolution fixing the time.of hearing on said petition was ordered to be prepared for the next regular meeting on. Wednesday the 6th day of August, 1958. Moved by Mathews, seconded by Schutt that we do now adjourn to meet again in regular session at the hour of 10 o1clock a.m. on Wednesday the 6th day of August, 1958, carried Alderson, Schutt and Mathews voting aye on roll call.
