No City Attorney present. The minutes of the regular meeting of June 4, 1958 and adjourned meeting- thereof, were approved as read. An ordinance recommended by the Planning Commission, amending the Zoning Code, or Ordinance No. B -2095, setting forth rules for locating service stations in the City of Yakima, was read by the City Clerk and after consideration, it was MOVED by Schutt, seconded by Mathews that said ordinance be referred back to the Planning Commission, recommending that certain portions be deleted and the ordinance be rewritten: carried Alderson, Schutt and Mathews.voting aye on roll call. Moved by Mathews, seconded by Schutt that Ordinance No. B -2178 rezoning the North 85' of Lot 1 and the North 150 feet of Lot 2 Sumitview Acre Tracts, said property located on the NW corner of 16th Avenue & Lincoln Avenue, from R3 zone to B -2 zone, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE N0. B -21781 AN ORDINANCE rezoning certain specific property situate in the City of Yakima, County of Yakima, Washington; and declaring an emergency. A petition having been filed•by R.B. Pamplin Corp. et al praying for the vacation of all of Martin Street, it was MOVED by Mathews, seconded by Schutt that Resolution No. C -1597 fixing the time for hearing on said petition for the 9th day of'July, 1958 at the hour of 10 o'clock a.m., be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO.. C -1597, A RESOLUTION fixing the time for hearing on the Petition. for Vacation of ALL CF MARTIN STREET (approximately 640feet more or less in length) as shown on the plat of said street. WHEREAS , a Petition has been filed with the City Commission of the City pf Yakima, a municipal corporation, praying for the vacation of,all of a street, described as follows, to -wit: ALL OF MARTIN STREET(approximately 640 feet more or less in --length) - , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, That said Petition shall be brought on for hearing and de- termination on Wedne -sday, the 9th day of July, 1958, at the hour of 10:00 a.m., at the office of the City Commission of the City of Yakima at .the City Hall, Yakima, Yakima County, Washington, or as soon thereafter as the same may be heard, and that notice of such hearing be given by posting by the City Clerk in three of the most public places in the city, and a like notice in a conspicuous place on the street sought to be vacate as-provided by law. day of June, 1958. C -1598, A' RESOLUTION fixing the time for hearing on the petition for Vacation-of Twentieth Avenue South lying adjacent to Lot 11 of Chase Hill Residence Tracts, according to the plat thereof recorded in Volume A of Plats, Page 142, Records of the Auditor's office of said Yakima County, Washington. WHEREAS, a Peition has been filed with the City Commission of the City of Yakima, a municipal corporation, praying for the vacation of a portion of a city street, described as follows, to -wit: Twentieth Avenue South lying adjacent to Lot 11 of Chase Hill Residence Tracts, according to the Plat thereof recorded in Volume A of Plats, Page 142, Records of the Auditor's office of said Yakima County, Washington, and extending southerly from Lombard Lane to the right -of -way of Naches and Cowiche Canal do hereby request that the east 10 feet of the west 20 feet of the above described portion of 20th Avenue South be vacated, Subject to all easements and rights -of -way in favor of the City of Yakima, and others for public utilities of all kinds now established and used over, under or through said property. Richter City Treasurer An ordinance setting forth the policy concerning Water and Sewer Service to areas out- side the City of Yakima having been read by the City Clerk, it was MOVED by Mathews, seconded by Schutt that said ordinance be tabled for further consideration: carried, Alderson, Schutt and Mathews voting aye on roll call. Paul Probach, plumbling inspector for the City of Yakima being of compulsory retirement age and the Building Inspector asking for the extension of his employment in accordance with Resolution No.. C -1596, it was MOVED by Mathews,.seconded by Schutt that the employ- ment of this employee be extended for one year:. carried, Alderson, Schutt and Mathews voting aye on roll call. Robert N. Mills, an employee of the Sanitation for the City of Yakima being of compul- sory retirement age in accordance with the Statewide City Employees retirement law, it was MOVED by Mathews, seconded by Schutt that this employee be retired as of July 1, 1958 in accordance with Resolution No. C -1596: carried, Alderson, Schutt and Mathews voting aye on roll call. The resignation of Mr. A. C. Cherry creating a vacancy in the Civil Service Commission, it was MOVED by Alderson, seconded by Schutt that Walter J. Robinson, attorney at law be and is hereby appointed to serve out the unexpired term of Mr. Cherry or until December 31, 1961: carried, Alderson, Schutt and Mathews voting aye on roll call.
