Commissioner Schutt absent. Moved by Mathews, seconded by Alderson that the reading of the minutes of the regular meeting of May 14, 1958 be dispensed with due to the large attendance for the public hearing on the West Lenox Avenue local improvement district: carried, Alderson and Mathews voting aye on roll call. Schutt absent. This being the time for the hearing on Resolution No. C -1575, being a resolution of in- tention to improve West Lenox Avenue from O.W.R & N Wily R/W line to Landon Avenue and West. Lenox Avenue from South 3rd Avenue to South 16th- Avenue by surfacing and construct- ing concrete curbs and gutters and the protests having been heard and the City Engineer reporting orally that writteia;_.protests in the amount of 50.1% had been filed, it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -2165 creating Local Improve- ment District No. 864 be passed as rqad because - -th' s.pr,b.jectris -a- +-part of the overall planning for the Lenox Overpass: carried, Alderson and Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -2165, AN ORDINANCE providing for the improvement of certain property by grading ballasting, surfacing constructing concrete curbs and gutters, sidewalks, establishing a Local Improvement District, providing for the method of payrre nt thereof, and.creating a special fund. This being the time for the hearing on the assessment roll for L.I.D. Nb, 859, being the Suburban Acre Homes Sewer District, and there being no protest in writing or otherwise to said assessment roll, it wasMOVED by Mathews, seconded by Alderson that Ordinance No. B -2166 confirming said assessment roll and every part thereof, be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -2166, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 859 as created and established by Ordinance No. B -2084 of the Ordinances'_of °-the.:;City of Yakima. A hearing having been held on May 14, 1958 on Resolution No. C -1576, bein g a resolution of intention to improve West D St., East King Street and Maryland Street by surfacing with asphaltic concrete and therenbeing considerable protest and the City Engineer now reporting that the protests filed were 91.4% against West "D" Street and only 19.3% against East King Street and Maryland Street and recommending that West "D" Street be deleted from the district, it was MOVED by Mathews, seconded by Alderson that Ordinance B -2167 creating L.I.D. No. 865 be passed as read deleting West._ ".D" Street from said district: carried, Alderson and Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -21671 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, together with any necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and cfeatin.g. a special fund. Moved by Mathews, seconded by Alderson that Resolution No. C -1592 authorizing the Mayor and City Clerk on behalf of the City of Yakima to apply to the United States Government for an interest free loan to defray the cost of planning an preparation for the Lenox Avenue Overpass, be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. RESOLUTION NO. C -1592, WHEREAS, the "'ity of Yakima herein called the "Applicant ", after thorough consideration of the various-'aspects of the problem and study of available data has hereby determined that the construction of certain public works, generally described as LENOX AVENUE OVERPASS is desirable and in the public interest and to that end it is necessary that action preliminary to the construction of said works be taken immediately: and WHEREAS, under the terms of Public Law 560, 83rd Congress, as amended, the United States of America has authorized the making of advancesto publ -ic bodies to aid in financing the cost of engineering and architectural surveys, designs, plans, working drawings, specifications or other action preliminary to and in prepara- tion for the construction of public works; and WHEREAS, the Applicant has examined and duly considered such Act and the Applicant considers it to.be in the public interest and to its benefit to file an application under said Act and to authorize other action in connection therewith; NOW THEREFORE, BE,IT RESOLVED BY the City Commission of the City of Yakima; the governing body of said Applicant, as follows: 1. shat the construction of said public works is essential to and is to the best interests'of the Applicant, and to the end that such public works may be provided as promptly as practicable it is desirable that action preliminary to the construction thereof be undertaken immediately; 2. That the Mayor and the City Clerk be hereby,,-authorized to file in behalf of the Applicant an application (in form required by the United States and in conformity with said Act) for an advance to be made by the United States,to the Applicant to aid in defraying the cost of plan preparation for the above described public works, which shall consist generally of All field and office work to prepare preliminary and final plans for Lenox Avenue Overpass 3. That if such advances be made, the Applicant shall provide or make necessary arrangements to provide such funds, in addition to the advance, as may be required to defray the cost of the plan preparation of such public works; 4- The said Mayor and City Clerk is hereby authorized to furn- ish such information and take such other action as may be necessary to enable the appli- cant to qualify for the advance; 5. That the officer designated in the preceding paragraph is .353 F'354 MAY 21, 1958 is hereby designated as the authorized representative of the Applicant for the purpose of furnishing to the United States such information, data, and documents pretaining to the application for an advance as may be required; and otherwise to act as the author- ized representative of the Applicaht in connection with this application. 6. Chat certified copies of this resolution be included as part of the application for an advance to be submitted to the United States.
