The City Commission met in regular session, Mayor Alderson and CommissionersScliutt,-
and. Mathews `.and City,:Attorney: Hawk ns,.�present ' on roll.call:e.
The minutes of the regular meeting of April 30, 1958 were approved as read.
This being the time for the hearing on Resolution No. C -1576, being a resolution of in-
tention to improve -West "D" St., East King Street, and Maryland Street by grading,
ballasting and surfacing with asphaltic concrete and there being considerable protest to
the formation of a local improvement district, it was MOVED by Mathews, seconded by
Schutt that-the City Engineer tabulate said protests and make recommendations at the
next regular meeting of the City Commission: carried, Alderson, Schutt and Mathews
voting aye on roll call.
Moved by Schutt, seconded by Mathews that Resolution No. C -1583 authorizing the employ-
ment of Frame and Whiting as'consultants to improve accounting practices for the City
of Yakima: carried, Mathews and Schutt voting aye on roll call. Alderson not voting.
RESOLUTION NO. C -15831 A RESOLUTION authorizing the employment of Frame and Whiting as
consultants.
WHEREAS, the commission deems it advisable that complete account-
ing records should be maintained by the finance office, and
WHEREAS, the accounting records and the budget should be in con-
formity, and
WHEREAS , a complete classification of accounts has not hereto-
fore been established, and
WHEREAS, the firm of Frame & Whiting have previously made a pre-
liminary study and report of Yakima municipal accounting;
BE IT THEREFORE RESOLVED BY THE CITY COMMISSION:

1. hat the Finance division shall be privileged to consult with
the firm of Frame and Whiting on accounting procedures.
2. The firm of Frame and Whiting shall make such studies as are
requested by the Corrunissioner 'of Finance and Accounting.
3. Members of the firm of Frame and Whiting shall have access to
such records as is necessary for the above- mentioned purposes.
4. The cost of such services shall be charged to the item "Job
and Salary Classifications" within the Current Expense Fund.

North First Avenue by surfacing with asphaltic concrete and fixing the date of hearing
at the hour of 10 o'clock a.m. on Wednesday the 4th day of June, 1958: carried, Alderson
Schutt and Mathews voting aye on roll call.
RESOLUTION NO. C -1584, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF' YAKIMA:
That it is its intention'to improveir.the following street by gradi
ballasting, and surfacing with asphaltic concrete, together with the necessary drainage
features:
Elm Street from North First Avenue to 233.1 feet, more or
less, West of North First Avenue
The proposed Local Improvement District is to embrace all property
adjacent to the above mentioned improvements which are sub=ject to assessment.
All persons who may desire to be heard with reference to said pro-
posed improvements are hereby notified to appear at a meeting of the City Commission to
be held at its office in the City Hall in the City of Yakima, Yakima County, Washington:,.,
at the hour of 10:00 o'clock a.m. on Wednesday, the 4th day of June, 1958, which time
and place are hereby fixed for the hearing of all matters relating to said proposed imp:
provements or objections thereto, and for determining the method of payrrB nt for said
improvements; and the City Clerk is hereby directed to give due notice of said hearings
and of the intention to make the aforesaid improvements.
All costs and expenses in connection with the construction of said
improvement, including the engineering, inspecting, advertising, publication of notices
and all other expenses incident thereto, shall be levied and assessed against all of the
property legally and properly assessable; therefor as provided by law and as above de-
scribed; and the City Engineer is hereby directed to submit to the City Commission at or
prior to the date faxed herein for said hearing, all of the data and other information
required by law to be by him submitted; all of said improvements to be constructed in
full accordance with the plans and specifications to be prepared by the City Engineer and
filed with -the City Clerk.

RESOLUTION NO. C -1585, RESOLUTION PROVIDING FOR A FULL TIME CITY ATTORNEY
WHEREAS previous city attorneys have recommended that the City
of Yakima provide for a full time corporation counsel,
WHEREAS the city attorneys due to the extent of their private
practice have tendered their resignations,
WHEREAS tritd two city attorneys have been employed on a part time
basis at a total salary of $10,500, and
WHEREAS it is expected that one attorney could be employed.on a
full time basis at a salary of $7,200,
WHEREAS the firm of Hawkins & Loy, present city attorneys will
be available to the City of Yakima on a consulting basis to handle special problems of
unusual nature,
BE IT THEREFORE RESOLVED BY THE CITY COMMISSION of Yakima that
the employment of.Hawkins & Loy as city attorneys shall be terminated one May 31, 1958.
That a full time city attorney be employed at a salary of $7,200 a ear,�:be assisted by
outside counsel as needed, on a consulting basis. That the sum of 800.00 is hereby
transferred from the item "Assistant City Attorney" within the salary classification of
the Current Expense Fund, said transfer being for the purpose of providing sufficient
funds to hire one attorney on a full -time basis.

The City Commission met pursuant to adjournment, Mayor Alderson, Commissioners Schutt
and Mathews present on roll call. City Attorney Hawkins absent.
Moved by Mathews seconded by Schutt that the second reading and consideration of an
ordinance providing for the expenditure of $4800.00 for traffic controls which was in-
troduced-and read for the first time on May 7, 1958 and laid on the table for one
week, be dispensed with and this item be considered at the time for making the 1959
budget: carried, Alderson, Schutt and Mathews voting aye on roll cal.
Moved by Schutt, seconded by Mathews that Ordinance No. B -2161 providing for the expendi-
ture of $30,000.00 of the $35,000.00 General Obligation Bond issued for the approach
lighting for the Airport, said ordinance having been read for the first time on May 7,
1958 and laid on the table for one week and now having been read "for the second time,
be passed am read: carried, Alderson, Schutt and Mathews voting aye on roll call.
ORDINANCE NO. B -2161, AN ORDINANCE providing for the expenditure of funds in the
Airport Improvement Fund not provided for in the 1958 Budget and declaring an emergency.

goods, wares, merchandise and services and amending ordinance No. B -875 known as the

ORDINANCE NO. B -2163, AN ORDIIY -NCE relating to the Irrigation Department, and providing
for service charge for blowing out irrigation lines by compressed air and declaring an
emergency.

the sale and trade of Cemetery Lots located in Section C of Tahoma Cemetery to Freda B.
Wieland and authorizing the City Clerk to execute a deed•conveyirg title to said
property, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll
call.
RESOLUTION NO. C -15862 WHEREAS, Freda B. Wieland now owns graves 6 and 7, Northwest
Quarter, Block 287, Section C of Tahoma Cemetery, having acquired title thereto by deed
dated October 21, 1948, and
WHEREAS, said graves have a value of $70.00 each, and
WHEREAS, said Freda B. Wieland now desires grave'2'and 3, South-
east Quarter, Block 30, Section E. said lots having a value of $100.00 -each, and desires
to trade graves 6 and 7 for graves 2 and 3, and paying the additional sum of $60.00 for
the difference in value of said graves; and
WHEREAS, it is deemed to be in the best interests of the City to
consummate the proposed transaction offered by said Freda B. Wieland,

Section 1. That the Mayor is hereby authorized to accept from
Freda B. Wieland title to graves 6 and 7, Northwest Quarter, Block 287, Section C, in
part payment for graves 2 and 3, Southeast Quarter, Block 30, Section E, all in Tahoma
Cemetery, and to receive the sum of $60.00 in total payment for graves 2 and 3.
Section 2. That the Mayor and city Clerk are hereby authorized
to execute a deed to said Freda B. Wieland conveying title to said graves 2-and 3.
day of May, 1958.

RESOLUTION NO. C -15872 A RESOLUTION providing for the transfer of funds within the 1958
appropriation of the Municipal Court Department within the Current Expense Fund.
WHEREAS, a surplus of funds exists in the Travel, Dues and Con-
ventions item of the Maintenance and Operation classification of the Municipal Court
Budget for 1958, while a shortage exists in the Office Expense item in said Budget, and
WHEREAS, the City Commission deems it in the best interests of the
City to make the transfer provided for herein, and
WHEREAS, the action contemplated herein is authorized by R.C.W.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF YAKIMA:
Section 1. That the sum of $100.00 be transferred from the Travel,
Dues and Conventions item within the 1958 appropriation of the Municipal Court Department
to the Office Expense item in said department, all of said items being within the
Maintenance and Operation classification in said appropriation.
Section 2. That the City Treasurer is hereby authorized and
directed to make the aforementioned transfers provided for herein.

'The City Engineer reporting on the completion of L.I.D. No. 857, being the Swan Tracts
and'29thAvenue Irrigation System, it was MOVED by Mathews, seconded by Schutt that said
work be accepted and the'City Engineer be and is hereby instructed to prepare the assess-
ment roll for said district and the City Clerk be and is hereby instructed and authorized
to give notice of hearing on said assessment roll for the hour of 10 o'clock a.m, on
Wednesday the 4th day of June, 1958: carried, Alderson, Schutt and Mathews voting aye
on roll call.
The City Engineer having filed with the City Clerk a petition to vacate the alley between
Lots 16 and 40, Shannon Home Plats, running from incest 28th Avenue to West 29th Avenue
reserving unto the City-an easement to the City of Yakima for a sanitary sewer and an
8 inch storm sewer now running along said alley, together with the right of ingress and
egress for the repa:ir'and replacment of said sewers; sub�j.ect to a provision that no build-
ings. be erected over said sewer lines, it.was MOVED by Mathews, seconded by Schutt that

agreement.
WHEREAS, an agreement was entered into July 18, 1946, between the
Oregon - Washington Railroad & Navigation Company and Union Pacific Railroad Company on the
one hand and the City of akima on the other for certain easements, and
WHEREAS, it is desired to supplement that agreement, NOW, THEREFORE
BEIT RESOLVED BY THE CITY OF YAKIMA:
That the Mayor and the City Clerk be and they are hereby authorized
on behalf of the Cityodf Yakima.to enter into the attached supplemental agreement between
the City of Yakima and the Oregon- Washington Railroad & Navigation Co., and Union Pacific

mission to cross the right of way of the Canal Company on South 39th Avenue with an

That the Mayor and the City Clerk be and they are hereby authorized
on behalf of the City of Yakima to enter into an agreement, a copy of which, is attached
hereto, with the Yakima Valley Canal Company, granting permission to cross the right of
way of the Yakirs Valley Canal Company on South 39th Avenue with an eight inch sewer pipe
