Commissioner Schutt absent. The minutes of the regular meeting of April 30, 1958 were approved as read. This being the time for receiving bids for the purchase of two tr.uc.k chassis-for the Garbage Department and the following bids having been received: Burrows Motor Company 2 units 8s546-58 F.O.B. Yakima 2 units 8,124.98 F.O.B. Factory Hahn Truck Company 1 unit $5- :701.14 F.O.B. Factory 1 unit $4,016.30 F.O.B. Yakima Bell Wyman Company 1 unit $3,153.54 Freight 203.00 . Wagner Chevrolet 2 units $79210.53 F.O.B. Yakima 2 units $6,889.66 F.O.B. Factory it was MOVED by Mathews, seconded by Schutt that said bids be referred to the Superin- tendent of the Municipal Garbage Department for tabulation and recommendation: carried, Alderson and Mathews voting aye on roll call. A hearing having been held on April 30, 1958 on Resolution No. C -1573, being a resolution .of intention to improve certain property in the Lincoln'Heights area by constructing a domestic water system and there being considerable protest filed on that date and the Cit�T Engineer now reporting that the protest represents 41.5% of the total assessments and that the majority of the.protests were adjacent to Lincoln Avenue and are served City water through a 12" private line, it was MOVED by Mathews, seconded by Alderson that Ordinance No. B -2158 creating a Local Improvement District be passed as read: carried,. Alderson and Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -2158, AN ORDINANCE providing for the improvement of property in the City of Yakima by the construction of necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection, establishing a Local Improvement District, providing for the method of payment therefor, and creating a special fund; Moved by Mathews, seconded by Alderson that Ordinance No. B -2159 amending Section 5 of Ordinance No. B -2009 which established standardsfbr the construction and maintenance of residential streets, curbs and gutters,. and sidewal14 be passed as read :. carried, Alderson and Mathews voting aye on roll call. Schutt absent ORDINANCE.NO. B- 2159, AN ORDINANCE amending Section 5 of Ordinance No. B -2009, entitled "AN ORDINANCE establishing standards for the construction and maintenance of residential streets, curbs and gutters, and sidewalks, and for the maintenance thereof." An ordinance providing for the expenditure of $4800.00 for traffic control devices, said ordinance being an emergency ordinance providing for funds not provided for in.the 1958 budget, said amount to be charged to City Hall- Miscellaneous General Government as a capital outlay item, was read for the 1st time and laid on the table for one week to be read again and considered at the next regular meeting of the City Commission on the 14th day of May, 1958: carried, Alderson and Mathews voting aye on roll call. Schutt absent Moved by Mathews, seconded by Alderson that Ordinance No. B -2160 p'ovidir_g for the use of the Industrial Wastes sewerage system, naming substances not to be discharged into said system, and providing for other regulatory measures for said system, be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. ORDINANCE NO. B -21602 AN ORDINANDE regulating the use of the Industrial Wastes sewerage system and providing penalties for the violation thereof. A hearing having been held on April 9, 1958 by the City Commission on the Appeal from Decision of the Planning Commission filed by W. W. Nettleship in the matter of rezoning of property situated at 601,602, 603 and 604 South 13th Avenue and the City Commission now deeming it to be for the be.st interest of the City -of Yakima to affirm the decision of the Planning Commission, it was MOVED by Mathews, seconded by Alderson that Resolution No. C -1581 be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. RESOLUTION NO. C =1581, A RESOLUTION affirming the decision of the Planning Commission. WHEREAS, the Planning Commission of the City of Yakima denied the application of W. W. Nettleship for the rezoning of the property hereinafter describ- ed, and WHEREAS, the appeal from the decision of the Planning Commission has been taken to the City Commission, and WHEREAS, the City Commission has held a hearing upon said appeal, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF'THE CITY OF YAKIMA: Section 1. The decision of the Planning Commission denying the application of W. W. Nettleship for the rezoning of the following described property, to-wit: Lots 23 and 24 in Block 3 and Lots 1 and 2 in Block 4 of Richland 2nd 2nd Addition, said property being situated at 6019 602 and 603 and 604 South 13th Avenue, be and the same is, hereby approved, ratified and confirmed. Herr - -in the matter of rezoning of property situated at the Northwest corner of Tieton Drive and South 31st Avenue and the City Commission now deeming it to be for the best interest of the City of Yakima to affirm the decision of the - Planning Commission in this matter, it was MOVED by Mathews, seconde by Alderson that Resolution No. C -1582 be passed as read: carried, Alderson and Mathews voting aye on roll call. Schutt absent. RESOLUTION NO. C -15822 A RESOLUTION affirming the decision of the Planning Commission WHEREAS, the Planning Commission of the City of Yakima denied the application of Dr. Marion E. Herr for the rezoning of the property described hereinafter and WHEREAS, an appeal from the decision of the Planning Commission has been taken to the-City Commission, and WHEREAS, the City Commission has held a hearing upon said appeal, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. The decision of the Planning Commission denying the application of Dr. Marion E. An ordinance providing for the expenditure of $30,000.00 of the $35,000.00 General Obligation Bonds issued for the purpose of acquiring the necessary easements and rights of way for the installation of an approach lighting system at the Yakima - Municipal Airport, was read in itts entirety for the lst time and laid on the table to be read and considered again at -the next regular meeting of the City Commission on May.14, 1958. A petition for annexation having been filed with the City Engineer by R. 0. Lutz and others, praying for the annexation of property beginning at the intersection of the South line of the north one -half of the Northeast 1/4 of Section 13, Township 13, North, Range 18, E.W.M., with the centerline of North First Street, thence north along the center line of North First Street to the centerline of "N" Street; thence east along the centerline of "N" Street 170 feet; thence North parallel with North First Street to a, point twenty five feet north of Lot 14, Phillips Suburban tracts, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington; thence west to the east line of North ,First Street; thence north to the north line of Section 13, Township 13 North, Range 18, E.W.M.; thence west along said section line to the right of way line of the i�orthern Pacific Railway Co.; thence southeasterly along said R.O.W. line to.the south line of the north one half of the Northwest 1/4 of said Section 13, thence east to the point of beginning, it was MOVED by Mathews, seconded by Alderson that the City Clerk be and is hereby authorized and instructed to publish and post notice of hearing as provided by law, said hearing to be held on the 28th day of May, 1958: carried;, Alderson and Mathews voting aye on roll call. Schutt absent. RESOLUTION: IN THE MATTER OF: PRIMARY STATE HIGHWAY NO. 5, Jacobson to Fruitvale Bl#d. RESOLU`.PION BY THE BOARD OF COMMISSIONERS OF THE CITY OF YAKIMA, COUNTY OF YAKIMA, WASHINGTON. WHEREAS,. the City of Yakima is the record owner of a tract of land which is described as follows: Beginning at a point on the West line of the Northeast quarter of the Southeast quater of Section 9, Township 13 North, Range 18, E. W.M., at a point 37.5 feet Southerly measured at right angles to the center line of the track of the Naches Branch of the Northern Pacific Railway, said point being 423.4 feet South of the North- west corner of the 'Northeast qu,-nrter of the Southeast quarter of said section 9; thence South along the West line 310.2 feet; thence East 290 feet; thence North 140.5 feet; to the South right of way line of the afore said right of way; thence North 590 40t West along the South line of said right of way 336 feet to the point of beginning.
