APRIL 30, 1958
The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and
Mathews and City Attorney Hawkins present on roll call.
Minutes of the regular meeting of April 23, 1958, and adjourned meeting thereof, were
approved as read.
This being the time for hearing on Resolution No. C -1573 - Lincoln Heights Domestic Watei
System - and there being a number of protests registered,by property owners against the
formation of the district, it was moved by Schutt, seconded by Mathews that the ordinancE
creating a Local Improvement District be tabled until the next regular meeting of the
City Commission on May 7, 1958, and the City Engineer instructed to report on the percent
age of protests: carried, Alderson, Schutt and Mathews voting aye on roll call.
An ordinance providing for the expenditure of $15,000.00 in the airport improvement fund
having had its first reading on April 23, 1958, the Commission deemed it advisable to
hold up said ordinance until some future date.
The City Engineer reporting the completion of L.I.D. x#859, being the Suburban Acre Homes
Sewer District, it was moved by Mathews, seconded by Schutt that the City Clerk be and
is hereby instructed. to give notice of hearing on said assessment.roll for Wednesday the
21st day of May 1958: carried, Alderson, Schutt and Mathews voring aye on roll call.
An Appeal from Decision of,t he Planning Commission having been filed by John W. Maloney
and Zita B. Maloney with regard to zoning of property designated as the Southeast corner
of 16th Avenue and Summitview Avenue and the City Commission finding it to the best
interest of the City of Yakima to allow said rezoning as per application made by Mr.
Maloney, it was moved by Schutt, seconded by.TAldbruon that Ordinance No. B -2157 rezoning
said property from B -1 Zone to B -2 Zone, be passed as read: carried, Alderson and Schutt
voting aye on roll call. Mathews voting nay.
ORDINANCE NO. B -2157, AN ORDINANCE zoning and rezoning certain specific property situate
in the City of Yakima, County of Yakima, Washington.
An annexation petition having been filed by R.O. Lutz with the City Engineer for annexat-
ion of property contiguous to the City of Yakima, it was moved by Mathews, seconded by
Schutt that said petition be .referred to the City Attorney for documentary proceedings:
carried, Alderson, Schutt and Mathews voting aye on roll call.
Moved by Mathews, seconded by Schutt that Resolution No. C -1580 be passed as read and
the Mayor and the City Clerk be authorized to execute a lease with Robert F. Tormaschy
for orchard property adjacent to the cemetery for one year: carried, Alderson, Schutt
and Mathews voting aye on roll call.
RESOLUTION NO. C -15$0, WHEREAS, the City of Yakima is the owner of real property describ�
ed as:
The South onebhalf of the South one -half of the Northeast
quarter of the Northeast quarter of Section 35, Township
13 North, Range 18, E.W.M., Yakima County, Washington,
upon which is situate a fruit orchard, and
WHEREAS, said premises are not being used for City purposes and
it is for the best interest of the people of the City of Yakima that said fruit orchard
be taken care of and. the premises maintained, and
WHEREAS, the City has received an offer from Robert F. Tormaschy
to lease said premises above described for a period commencing January 1, 1958 and ending
January 1,1959, on a crop -share basis, all as more fully set forth in the attached lease
which offer is the best that can be obtained for the lease of said premises and the care'
of said premises. NOW, THEREFORE,
WASHINGTON:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA,
That the City of Yakima enter into a lease agreement with Robert
F. Tormaschy for the above described premises upon the terms hereinabove stated, and that
the Mayor, Joe K. Alderson, and the City Clerk, James A. Smith, be and they are hereby
authorized and directed to execute said lease for and on behalf of the City of Yakima.

session at 10:00 a ".. m. Wednesday, the 7th day of May, 1958: carried, Alderson, Schutt
and Mathews voting aye on roll call.
Moved by Mathews, seconded by Schutt that R.F.M. Rotsaert be appointed City Accountant
effective April 28, 1958: carried, Alderson, Schutt and Mathews voting aye on roll call.
