HomeMy WebLinkAbout04/23/1958 Business MeetingX340 X APRIL 23, 1958 The City Commission met in regular session, Mayor Alderson, Commissioners Schutt and Mathews and City Attorney Hawkins present on roll call.` The minutes of the regular meeting of April 16, 195$ and special meeting of April 22, 1958 were approved as read. An ordinance providing for an' accountant, salary and office expense, being an emergency ordinance appropriating $5,100.00 for salary, $109.00 for office expense and X120.00 for training office personnel, was read for the first time on April 16, 195$ in its entirety and laid on the table for,one week and now being read for the second time, it was MOVED by Schutt, seconded by Mathews that Ordinance No. B -2153 providing for said accountant, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -2153, AN ORDINANCE providing for an accountant and necessary office expense and specifying his duties and declaring an emergency. Moved by Mathews, seconded by Schutt that Resolution No. C -1575, being a resolution of intention to improve Lenox Avenue from the O.W.R. & N. Railway line to Landon Avenue and from South 3rd Avenue to South 16th Avenue by the construction of concrete curbs and gutters and sidewalks, and fixing the time for hearing at the hour of 10 o'clock on Wednesday the 21st day of May, 1958, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. SOLUTION NO. C -1575, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following streets by grading, ballasting, surfacing with asphaltic concrete, and constructing concrete curbs and gutters, together with the necessary drainage features, and by constructing concrete sidewalks onL:both sides of said streets: West Lenox Avenue from O.W.R. & N. W'ly R/W line to Landon Avenue. West Lenox Avenue from South 3rd Avenue to South 16th Avenue. That it is also its intention to improve the following street by constructing concrete sidewalks on both sides of said street: West Lenox Avenue from Landon Avenue to South 3rd Avenue Said proposed district is to embrace all property adjacent to the above improvements which is subject to assessment for the cost of said improvements as provided by the laws of the State of Washington. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear at a meeting of the City Commission to be held at its of-rice in the City Hall in the City of' Yakima, Yakima County, Washingtoz at the hour of 10 o'clock on Wednesday, the 21st day of May, 1958, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvements,, and for determining the method of payment for said improvements; and the City Clerk is hereby directed to gave due notice of said hearing and of the intention to make the afore- said improvements. All costs and expense in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by the laws and as above described., with the exception that on the officially designated arterial street of Lenox Avenue, the City shall bear the cost in excess of that required to construct a standard 32 foot residential street; also the City shall bear the cost of two feet of the width of the sidewalks. The City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other informa- tion required by law to be by him submitted; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk., ATTEST: J. ORDINANCE NO. B -2154, AN ORDINANCE rezoning certain specific property situate in the Cit of Yakima, County of Yakima, Washington; and declaring an emergency. The Planning Commission certifying that the statuatory procedure has been completed for the plating of property beginning at 'a point 349.3 feet West and 176 feet South of the. North East corner of the South East quarter of'Section 26, Township 13'North, Range 1$ EWM. thence West 279.3 feet, thence South 283.6 feet, thence East 279.3 feet, thence Nortl 283.6 feet to the point of beginning, except the 112 feet of the East 139 feet, excepting also the South 56 feet of the West 140.3 feet thereof, being the proposed plat of Lyle V. Washburn and Harriet Washburn, it was MOVED by Mathews, seconded by Schutt that said plat be accepted: carried, Alderson, Schutt and Mathews voting aye on roll call. Meyer, Ted S: Clark and.Phyllis M. Clark, and John J1 Bennett and Evelyn Ann Bennett, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C' -1577, A RESOLUTION authorizing the City Attorney to compromise a law- suit involving an appeal from certain assessments within Local Improvement District No. 853. WHEREAS, Ilah J. Meyer, a widow, Ted S. Clark and Phyllis M. Clark, husband and wife, and John J. Bennett and Evelyn Ann Bennett, have, on December 20, 1957, appealed to the Superior Court in and for Yakima County, from the action of the City Commission confirming the assessment roll for Local Improvement District No.853 as it pertained to Lot 11 and 13, Block 3, Rose Park Addition, the assessments being in the respective amounts of $344.08 and $317.93, and WHEREAS, the above mentioned owners are willing to compromise a settle said pending lawsuit upon the basis of one half of the assessments as they now appear upon the assessment roll, and WHEREAS, it is deemed to be in the best interests of the City to compromise said lawsuit upon the basis indicated hereinabove, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the City Attorney is hereby authorized to compromise the Superior Court action referred to hereinabove, being Cause No. 42331, to the extent that the assessments of the properties of appellants as they now appear upon the assessment roll of Local Improvement District No. 853 shall be reduced by one -half. of April, 1958. B -2155, AN ORDINANCE providing for the acquisition by condemnation or purchase of easements and rights of way over, across and through certain real property more particularly described below for use by the City of Yakima in the installation, r,- 42 APRIL 23, 1958 - -- -- __- _-.------------ - operation and maintenance of an approach lighting system at the Yakima Municipal Airport; providing for the method of payment therefor; and declaring an emergency. An Ordinance providing for the expenditure of $15,000.00 for necessary easements and rights of way of the $35,000.00 general obligation bonds issued for the improvement of the Airport, was read in it's entirety for the first time and laid on the table for one week, to be read and considered at the next regular meeting of the City Commission. Moved by Mathews, seconded by Schutt that Resolution No. C -1578 compromising a claim against the City of Yakima by Paul V. Creamer in the sum of $200.00 be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -157$, A RESOLUTION compromising a claim filed against the City of Yakima by Paul V. Creamer. WHEREAS, a claim for damages has been timely filed against the City of Yakima by Paul V. Creamer in the sum of $485.87, said claim arising from the flooding of claimant's premises on or about January 12, 1958, and WHEREAS, a compromise settlement has been agreed upon between the City and the claimant in the sum of $200.00, and WHEREAS, it is deemed to be in the best interests of the City of Yakima to compromise said claim, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA: Section 1. That the claim of Paul V. Creamer in the sum of $485.87 be and the same is hereby compromised for the sum of $200.00, and the City Treas- urer is hereby authorized, empowered and directed to issue a warrant in payment of said claim chargeable against the Current Expense Gen' 1 Government fund; provided, however, that the treasurer shall not deliver said warrant to the claimant until a release is executed and filed with the City Clerk by the above named claimant relieving and releas- ing the City from any additional and further liability in connection with this subject matter. day of April, 1958. RESOLUTION NO. C -1579, A RESOLUTION creating two additional precincts to be designated Precinct Nos. 63 and 64 and establishing the boundaries thereof. WHEREAS, Precinct No. 51 as presently established has residing therein more than 300 voters, and WHEREAS, because of the increased voting population Precinct 51 should be divided into two additional precincts to be designated Precinct No. 63 and Precinct No. 64 with the respective boundaries as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1.
