The minutes of the meeting of January 22, 1958, were approved as read. This being the time for receiving bids for the purchase of a pickup truck for the Street Department and the Parking Meter Department, the following bids were received:,,;:. This being the time for receiving bids for a Sewer Rodder machine for the Street Department, three bids were received Waterworks Supplies. Co. of Portland Waterworks Supplies. Co. of Portland - alternate bid O'Brien Manufacturing Co., Chicago 3597.77 does not include sales tax 3747.77 additional attach- ments listed 397$•33 includes sales tax it was moved by Mathews and seconded by Schutt that the bids be referred to the Street Superintendent for recapitulation and recommendation: carried, Alderson, Schutt and Mathews voting aye on roll call. This being the time for receiving bids on the sale of received from the State Finance Committee at an inters moved by Schutt and seconded by Mathews that said bid further considered at the next regular meeting of the 5th day of February, 1958: carried, Alderson, Schutt call. ORDINANCE NO. B -2126, AN ORDINANCE confirming the- assessment roll covering Local Improv ment District No. 856 as created and established by Ordinance No. B -2065 of the Ordinan- ces of the City of Yakima. This being the time for awarding bids on coveralls, caps and patches for the Sanitation Department, it was moved by Mathews and seconded by Schutt that Mr. Sheeley's recommend- ation be accepted and the award for the above items be made to J. C. Penney.Company, in amount of $570.60: carried, Alderson, Schutt and Mathews voting aye on roll call. Moved by Mathews and seconded by Alderson that Ordinance No. B -2127 rezoning property situated in the City of Yakima, being Lot 10, Block 394, Capitol Addition from R -3 Zone to B -2 Zone, said rezoning being recommended by the Planning Commission, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -2127, AN ORDINANCE rezoning certain specific property situate in the City of Yakima, County of Yakima, Washington; and declaring an emergency. Moved by Mathews, seconded by Schutt that Ordinance No. B -2128 requiring permits to be issued by the Fire Marshall for the installation, maintenance, or use of gas appliances and amending Ordinance No. B -1$46, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. ORDINANCE NO. B -212$, AN ORDINANCE requiring permits issued by the Fire Marshall for the installation, maintenance, or use of gas appliances and piping; prescribing penalties for violation thereof and amending Ordinance No. B -1$46. " II � �3_12 JANUARY 29,-1958 An Ordinance appropriating $4,069.6f to cover certain items of Maintenance and'Operation in the Municipal Garbage Department was read for the first time and laid on the table to be read again at the next regular meeting February 5, 1958. Moved by Schutt, seconded by Alderson that Ordinance No. B -2129 providing for the transfer of $1622.67 within the 1957 Budget for the Airport, be passed as -read: carried, Alderson, Schutt and Mathews voting aye on roll call. 'ORDINANCE NO. B- 2129;, AN ORDINANCE providing for the transfer of funds within the 1957 appropriation of the Airport Department and declaring an emergency. Moved by Mathews, seconded by Schutt that Ordinance No. B -2130 providing for the transfer of $2418.98 from the Labor item within the "Salaries" classification of the Street Department 1957 Budget to the Auto Equipment and Parts item in the Maintenance.and Operation classification of said budget, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. 'ORDINANCE NO. B -2130, AN ORDINANCE providing for the transfer -of funds within the 1957 appropriation of the Street Department and declaring an emergency. Moved by Mathews, seconded by Schutt that Resolution No. C -1557 transferring funds in amount of $1671.24 within the Street Department Budget, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. C -15579 A RESOLUTION providing for the transfer of funds within the 1957 appropriation of the Street Department. ` WHEREAS, a shortage of funds exists in various items within the Maintenance and Operation classification of the Street Department appropriation in the 1957 Budget, while a surplus exists in other items within said classification and WHEREAS, the City Commission deems it in the best interests of the city to make the transfers provided for herein, and . WHEREAS, the action contemplated herein is authorized by R.C.W. 35.33.120, NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA- Section 1. Richardson and Virginia S. Richardson for assignment of airport ground lease, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -155$, A RESOLUTION authorizing.the Mayor and City Clerk to execute on behalf of the City a consent to assignment and modification of Airport Ground lease with respect to that certain lease executed on November 18, 1953, between the City of 'Yakima and Ralph R. Richardson and Virginia S. Richardson, lessees. WHEREAS, Ralph R. Richardson and Virginia S. Richardson, lessees of the Airport Ground Lease referred to hereinbelow have requested the consent of the city to assign said lease and modify paragraphs 13 and 14 thereof and WHEREAS, it is deemed to be in the best interests of the city to grant said request, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKI.MA: Section 1. That the mayor and City Clerk are hereby authorized to execute on behalf of the City of Yakima the consent to assignment and modification of Airport Ground Lease, a copy of which is attached hereto and made a part hereof. ALDERSON Mayor n II . 1 1 JANUARY 29, 1958 Moved by Schutt and seconded by Alderson that Resolution No. C -1559 authorizing transfer of funds within the 1957 Current Expense budget for the Administrative, Building, City Clerk, City Hall, and Meat Inspector, all transfers being within the Maintenance and Operation Classification, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -15591 A RESOLUTION providing for the transfer of funds within the 1957 appropriation within the Administrative, Building, City Clerk, City Hall, Legal, and Meat Inspector Departments, all within the Current Expense Fund. WHEREAS, a surplus of funds exists in various items of the Maintenance and Operation Classification in the 1957 appropriation in various depart- ments within the Current Expense Fund, while a shortage exists in various other items within these various departments, and 1 WHEREAS, the City Commission deems it in the best interests of the City to make the transfers provided for herein, and WHEREAS, the action contemplated herein is authorized by R.C.W. 35.33.1209 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That $115.32 be and the same is hereby transferred from the Miscellaneous Expense item within the 1957 appropriation of the Building Department to the Automobile - Maintenance and Insurance and Industrial Insurance and Medical items in the respective amounts of $5$.95 and $56'.37, all of.said items being within the Maintenance and Operation classification in said appropriation. Section 2. That $334.48 be and the same is hereby transferred from the Welcome Expense and Miscellaneous item within the Administrative department to the Office Supplies (changeover to Machine Acct.) and general Office Supplies in the City Clerk Department, in the, respective amounts of $57'.00 and $277.48, all of said items being within the Maintenance and Operation classification. Section 3. That $80.35 be and the same is hereby transferred from Repairs, City Owned Buildings of the City Hall Department appropriation to the Witness fees ,and Costs and Office Supplies and Expense items of the Municipal Court department in the respective amounts of $73.60 and $6.75, all of said items being within the "Maintenance and Operation" classification.. That the sum of $72$.40 and $154.48 be and the same are hereby transferred from the Industrial Insurance and Repairs, City Owne Buildings items respectively,, in the City Hall Department appropriation to the Water, Lights & Heat, Janitor's Supplies, Telephone and Telegrams, and Repairs items in the respective amounts of $779.17,$4$.20, $35.51 and $20.00, all of said items being within the "Maintenance and Operation" classification in said appropriation. Section 4. That $120.00 be and the same is hereby transferred from the Transportation item to the Auto Maintenance item within the Maintenance and Operation classification of the Meat Inspector Department within the 1957 appropriation. Section 5. That $140.20 be and the same is hereby transferred from the Repairs, City Owned Buildings, item within the City Hall Department to the Superior Court Expense, Transportation & Misc. and General Supplies items within the Legal Department appropriation in the respective amounts of $65.20, $50.00 and $25.00, all of said items being within the Maintenance and Operation classification. Section 6. That the City Treasurer be and she is hereby author- ized and directed to make the aforementioned transfers as provided for herein. ATTEST: J. A. ALDERSON Mayor Moved by Schutt and seconded by Mathews that Resolution No. 1560 authorizing the Mayor and City Clerk to execute an agreement with the Oregon - Washington Railroad & Navigation Company to construct, maintain and operate a sewer pipe on railroad right -of -way, be passed as read: carried, Alderson, Schutt and Mathews voting aye on roll call. RESOLUTION NO. C -1560, BE ITSREBOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That the Mayor and City Clerk are hereby authorized to execute on behalf of said City that certain agreement dated August 1, 1955 between Oregon - Washington Railroad & Navigation Company, a corporation of the State of Oregon, and its Lessee, Union Pacific Railroad Company, a corporation of the State of Utah, and the City is given the right, subject to the terms of said agreement, to construct, maintain and operate a sewer as described and in the locations indicated in said agreement beneath the tracks and on the right of way of said companies at Yakima, in Yakima County, Wash- ington. C- 1561D, BE IT RESOLVED by the City.Commission of the City of Yakima Yakima County, Washington, meeting in regular session on the 29th day of January, 1�5$, that the Mayor and the City Clerk be authorized and directed to execute termination rider terminating on behalf of said city that certain agreement dated January 28, 1957, between the City and Oregon - Washington Railroad & Navigation Company and its Lessee Union Pacific Railroad Company, collectively called "Railroad Company" covering license and permit to construct, maintain and operate a sewer pipe as described therein..
